Durham Road for Lot 638, Plat No 11 Sunmerfield Dear Mr. Brown: Your request is for approval for access onto S. W. Durham Road, which is designated as a county arterial road, to serve a few ihdiv)idual lots with a private driveway. As you know, our normal procedure is to provide internal access on residential developments along arterial streets with the orientation of the development away 1 from the arterial. In this particular case, there appears to be no other access available at the present time. I am not completely aware of the procedures used by the City of Tigard, but in Washington County we have a design review procedure in which the actual improvements and access are indicated on a site plan and approved by Planning staff with Director approval." The reason I mention this is because I feel the design of this development should show how the adjacent parcel to the west, which i8 a tax lot not included in the Summerfield development, could be developed in the future with internal access. In other words, the long-range goal would be to provide all those residential Units with access from an internal Street in the Summerfield • plat rather than onto Durham Road. SO Public Works would recommend that prior to a building Permit for those sites that al"gre plan 4.- su t- to the City of Tigard • which would indicate the layout of the entire portion showing eventual acceSS to the • interior street. „ One of the problems with the proposed access that will arise in the future is the fact that the City of Tigard has indicated they will build Durham Road with a landscape median with left turn access only at street intersections'. The street intersections on the north side of Durham Road as far as SUmmerfield is concerned would function very well becaUse they are located a distance of over 400 feet each Way from Lot 638. The problem i8 there is a street intersection going south from Durham Road in the proximity of your proposed access request, With a landscape median in left turns for street intersections that the City of Tigard has for S.W. CALL TO ORDER Chairman Whittaker called the meeting to order at 7:40 p.m. 2. ROLL CALL Present: Ball, Hansen, Nicoli, Popp, Sakata, Wakem and Whittaker; Staff: Powell • 3. APPROVAL OF MINUTES The minutes of the February 18, 1975, meeting were read. Commissioner Ball pointed out the omission of some discussion on the Robertson Minor Land Partition, stating he felt that the minutes of this particular case should be as complete as possible. He also stated that his intent on page 5, item D-2, with respect to density and Planned Development was to ensure that the density restriction was voluntary. Chairman Whittaker ' directed that the minutes be amended and be brought back to a subsequent meeting for approval. Chairman Whittaker read a letter he had drafted for City Council with respect to the Council 's recent decision on the Neighborhood Planning Organization #1 Comprehensive Plan Review. 4, PUBLIC HEARINGS 4.1 Zone Change ZC 2-75 (Iron Mountain Investment Co. ) An application for a Planned Development of ten acres of SW 121st Ave. south of "Summercrest". A. Staff Report read by Powell (see attached) B. Public Testimony Mr. Henry Votterberg, architect for the applicant, pPO- sented the general plan for the proposed program, pre- senting into testimony a map of the proposed planned development and an alternative showing development as a standard subdivision. Mr. Ralph Butz, SW 121st St. 9 asked about density of 'the , proposed Planned Development. Applicant responded that the density would be less than would be allowed as a standard subdivision. * Mrs. Brill indicated she felt that the subdivision could not be approved and wanted to know why it was put up. Mr. Park asked the cost in sq. footage of the houses proposed. Applicant responded $409000-$45,000 and 1500 to 2000 Sq. •ft. Mrs. Bonnie 114 -# 7 ,; ked if the applicant was aware that t e w -~ elevation in the winter time was 172 ft. in that P area. Applicant responded that he did know that. Mr. Darryl Demster asked about the wildlife habitat in the wetlands and about the trees on the westerly portion of the site -- whether they could be preserved or not. The applicant responded that every effort was being made to preserve the trees and that the Planned Development had been planned to minimize intrusion on the wetlands area. Mr. David Osborne asked if the streets would be standard and the applicant answered they would. Mr. Lou Grele asked where the traffic would go and what the traffic generation would be from the project. The applicant responded that he did not know whether the traffic would go north or south on 121st from the project,1 but that the traffic generation would be the samo as it wCuld be were the project a standard subdivision. Mrs. Betty Miller asked if it were not true that the de- veloper was planning a project of ticky-tacky houses. The applicant did not respond. Mr, Beeler asked if the City could or would maintain the parkland provided by the developer or if it would be another "Jack Park" which he said had become a dump. • Chairman Whittaker responded that the City had to acquire parkland when and where it could -- that maintenance was a budgetary problem. PO MinUteS - March 18p 1975 - page 2 4 , 1 6 Mrs. BoiLle Owens, SW Summercrest 'ILI indicated that if it was necessary to develop this land, then she would rather see a Planned Development of this sort than a standard subdivision or lesser Planned Development, Mr. Jim Asp indicated that this was one of the best Planned Development proposals he had seen. Mr. Ervin Park stated he was opposed to the project. Mrs. Park stated she was opposed to the project. Mr. Beeler asked that the Commission table it and ask for more information. • Mr. Davis, SW Summercrest Dr. , indicated that Iron Mt. • Investment had been turned down by the Planning Corn- mission on their first Planned Development; had appealed to the City Council and the community felt that that , development had been "shoved down their throats". Mr. Metcalf said he had called Planning staff and asked tbout the project and had been told that the project • 4 would be of $350000 houses and that now it seemed that they would be $45,000. He indicated that he felt that lot pricing of $10,000 was inflationary and that the streets were substandard. Mrs-. Scheckla indicated she felt the lots were too small for children to play. • Mr. Collins indicated that he would prefer a standard subdivision. Mr. Butz indicated his opposition. C. Staff Recommendation Approval with the conditions that (1) an addit,Lonal 5 ft. be dedicated a.' SW 121st Ave. (2) no land filling will be allowed in the wetlands area (3) no finished floor will be lower than 172 ft, M8L (4) developer will provide a pathway along the easterly • edge of the wetlands connecting to sidewalks on each end • (5) all streets and oul-de-sacs are to conforM to City standards PC Minutes - March 18, 1975 - page • • 1 (6) a 11..4,addscape plan must be submit ,ed to the site de- sign review board before preliminary plat approval may be given (7) minimum landscaping of hornesites as well as common areas will be provided by developer before occupancy permits may be given (8) a l5 utilities easement will be granted by the developer along the north lot lines D. Commission Discussion and Action Mr. Whittaker indicated that he was not convinced that the subdivision as shown as an alternative was a viable alternative and he felt that the applicant must demon- strate that the Planned Development proposed was the best way of developing the site, even though he said he felt it was a well-conceived development. Hansen asked if street plugs would be provided at the ends of the indicated dead end streets. Motion for denial (Popp) on the basis that he felt that the application provided insufficient information, seconded (Porter) . Nicoli said he agreed with the concept of the Plan; however, he could not agree with the specific Plan. Whittaker indicated his dissatisfaction with the applicant's demonstration of need for 5,000 sq. ft. lot. 8akata asked that a lot be provided for play area Ball indicated a desire for a more complete submission. Vote was unanimous for denial. 4.2 Conditional Use CU 6-75 (Gevurtz Furniture) Request for a conditional use permit to allow a furniture store and warehouse in an M-4 zone. A. Staff Report read by Powell (see attached) B. Public Testimony . . Dick Waker, an engineer for Murray-McCormick Environ- mental Corp40 presented the Plan and program for development of a furniture store on the site Opposing Testimony There was no opposing tootimony,, PC Mituteo - March 18, 1975 - page 4 . „,. C. Staff Reommendation Approval with conditions: (1) all parking areas and access roads on site will con- form to City standards (2) any future expansion will require a new conditional use permit D. Commission Discussion and Action Chairman Whittaker indicated he saw a potential traffic problem. Ball asked about the wording of the M-4 ordinance. Staff responded that an amendment had been made a year ago to allow specifically this kind of project in an M-4 zone. Hansen indicated that the ordinance amendment had been made specifically to allow the Gevurtz store on the par ticular site in question. It was moved to table (Ball) on the basis that the ordinance, as stated in the staff report, did not specifically allow retail sales. 4 N Hansen responded that the staff was in error on the specific wording and that the ordinance revision did read specific- ally retail sales. Ball withdrew his motion. Motion to approve (Wakem) , subject to staff-recommended conditions. Second (Hansen) , motion passed unanimously. 4.3 Variance V 3-7 (Puturistic Homes) A request by ruturistic Industries for a variance of the zoning • code to allow a 10 ft. setback from a side street on a corner lot located at SW 106th and Clydesdale Court. A. Staff Findings Staff report was read by Powell. 'B. ' Iron. Mountain Investment Co. en 's Request Approval of a 10 acre planned development of 28 dwelling units on an R-7 zoned site, including variance of the underlying zone district to allow 5,000 sq. ft. building sites. Staff Findings • 1. 1n1969 the City of Tigard approved two zone changes on this site (ZC 3-69 and ZC 4-69) changing a 170 x 238 ft. parcel on SW 121st to C-5 from County S-R and changing the balance of the site to R-7 from County S-R. 2. A conditional use permit was granted at the same time for • a "planned residential" development to consist of townhouses, four-plexes and duplexes. A Phase I developiiient plan was • approved in 1970, but expired along with the conditional use in 1972. . 3. Generally the site slopes from northeast and southwest toward Summer Creek which traversed the site from northwest to southeast. A large marsh-type wetlands area along Summer Creek dominates the site. Traversing from east to west the vegetation ranges from low grasses to typical • marsh littoral which yields to brush and some large second growth conifers interspersed with some mid native deciduous • trees. 4. A portion of this site (See enclosed "wetlands" map) is in the Flood Plain district as defined in Tigard Ordinance 74-50 and identified by Washington County ept. of Public Works on sheet 5, HUD 701 Project Mo. 73-16-06. That pro- • ject defined the intermediate regional flood as the transit- ion in vegetation and, soils from wetlands types to drained • or dry lands types. In this area, that transition occurs at about 165t elevation Historic (winter 1972-73) evidence exists of local flooding to a water surface elevation of approximately 170' j 500 ft. north of the north line of the site. Average water surface grade is about 1 ft. fall in 600 of stream length. Accordingly, the historic flood . level at the site could be expected to have been about 169' . Comparison of the 1972-73 flood elevation to the 6 intermediate regional flood (100 year flood) is risky be- , i.ause of the statistical nature of projected flood levels. However, the 1972 water surface elevation on Fanno Creek lat the "Main Street Bridge" was approximately 1 foot less than the statistically projected intermediate regional flood water surface elevation. Since the tributary area of Summer Creek upstream of the site is subject to development in the relatively near future, an additional 1 to 3 feet of freeboard ought. to be allowed making the loWest flood free elevation, assuming full development and intermediate flood, on the site about 172 ft,. elevation (USGS Datum) . 5. Present land use to the north and east of the site is single family residential (about 4 families/acre) . No development has occurred immediately south or west of the site although tax lot 1204, south of the west half of the site has been acquired by Tigard School District 23-j for an elementary school. The school district site will have its access on the south of its site. Their development plans indicate possible construction in 2-4 years. 6. The C-5 zoned parcel on 121st adjacent to the proposed development site has not been developed but could be developed to a maximum 3 or 4 establishment neighborhood commercial site, depending on the scale and nature of the establishments proposed. 7. ' .idence indicates that soils in this area are generally poorly drained. Local complaints of drainage problems and impermiable soils are common. • 8. Sewerage is available approximately 60' from the east line of the site and developer proposes to sewer all sites. 1. 9. An 8' public water main is located in SW 121st St. 10. Storm drainage has not been addressed. City policy is en- couragement of on-site retention of storm water run-off; however, an engineering study of soil permiability and • retention facilities appropriate to the site would be necessary for final determinations to be made. U. Streets sidewalks and cul-de-sacs appear to conform to City code. Street right-of-way lines are not shown (50' right- of-way required) . 12. SW 121st adjacent to the development has presently a 50' right-of-way, is designated a collectcr street calling for an additional 5t street dedication on each Side Of 121st. The site is within the area designated "urban low density • residential" in the Tigard Community Plan and conforms to ' the policies of that plan with respect to land development • and densities particularly well. 14. Applicant proposes a "density trade off" in this project ' . fe requetting 5000 sq. ft. building sites in exchange for J...." approximately 2i acres of wetlands permanently dedicated II. to public open space. The developer, by this act, essentially • - '., transferred the "right" he has to develop all his site to the portion he wishes to develop. It should be noted that he could plat the entire tract as a subdivision and obtain a minimum of 3O building sites (assuming that the City would demand a reserve strip along the creek equal to a couple of ,.. building sites) . It is true that the land thus "traded off" is undevelopabie and of little value as a park or recreation site; however, the purpose of open space is not necessarily to provide a place for swings and teeter-totters. Staff e feels the density trade off offered in this case fulfills the purpose and intent of open space land and Greenway develop- ment under the Tigard Community Plan and under applicable -,.. provisions of the Tigard Code (Planned Development District and Flood Plain Distric4:) . / Alternative development concepts for the land are standard ,. subdivision, multi-family development or public open space. the Development proposed appears to best fit the Tigard .. Staff Findinvs 1. A previously approved PD (ZC 3-69 and 4-69 and CU 1-69) for Lake Terrace; Henry Potter, applicant; has not been formally vacated although development has not occurred. A phase I development was approved by the Tigard City Council in 1970. 2. A portion of this site is in the flood plain district as identified by Washington County Dept. of Public Works on sheet 5, HUD 701 project No. 73-16-06. 3. Surrounding present land use is single family residential. 4. The site to the south of the proposed project 1.8 owned by • Tigard School District 23-J and they plan to develop in 3-5 years. 5. The C-5 zoned site to the east of the proposed PD Wa6 a part of the previous preliminary PD site plan and has not been developed. 6. The site slopes from SW and Ng toward Summer Creek which traverses the site from NW to SE. A large marsh area along Summer Creek dominates the site. 7. The site is fairly open to the northeast with the marshy area in a characteristic littoral vegetation and brushy vegetation to the south west. S. Drainage characteristics of the soils are unknown, bUt • probably not good. It is noted that drainage problems and septic drainfield problems have been reported to • the ,immediate north of the subject site. 9. Sewerage is within 100 ft. of the east property line of the proposed PD, but Tigard Public Works has not yet determined if the sewer serving that area is large enough to handle additional units. 10.
