Our street is a cul-de-sac with about eighteen residences. Please advise us what steps can be taken to have this right-of-way vacated. This has been discussed with our neighbors and they are interested • in a joint action to have the vacation accomplished. At the present time, we are anxious to make plans for construction of a garage as a result of the granting of our variance request and, before we commence, it would be advantageous to us to learn the . facts concerning the possible vacation of the right-of-way. That a storm water plan be submitted for public works department approval. Prior to submission for general plan and program review. 3. That easements be provided adcording to public works department specifications for drainage and utility purposes. • 4. That a street. T reef tree and landscape plan for all cul-de-sacs and the northern common area be submitted for design review approval. 5. That the common area along the Tualatin River be dedicated to the public. 6. That the lotting pattern along the east/west street on the southern • portion of the site be revised to meet the intent of the NPO #6 t. Plan for this area, and that this street be on a 50 foot right of way with 32 feet of pavement. 7. S. W. 79th Avenue in this area runs approximately the equivalent of two blocks and is a cul-de-sac. Between our property ' ' and our neighbor's property to the south, there is an unimproved area • • for a potential roadway off the cul-de-sac. Our property is an over- sized, double frontage lot, irregular in shape, on the east side of the street. The variance requested would be to allow construction within less than the required twenty feet from the property line. In our opinion this would not present unfavorable results to anyone and we have questioned our neighbors rnd they have no objection to this improvement to the area. There are now many cars parked in the street where room barely exists. Neither we, nor our friends, can seldom park in front of our property as other cars are already there. By our construction of this garage, we would be able to keep our cars off the street and allow our visitors to park in our driveway. This dedication of land was made at the time that the Twin Oaks Lane subdivision plat was recorded to accommodate any future street extension to the east which may become necessary. Tigard' s adopted plan for this area, NPO #4, contains a policy which addresses streets of this nature and is worded as follows: "Policy #33 - all existing dead end residential streets in the conversion units shall renain closed to through traffic until such time as 75% of the owner occupants have voted to convert the zoning to a non-residential category. " • Therefore, 79th Street will not be extended eastward as long as it remains a residential area. However, there could, conceivably be sometime in the distance future when this area would be converted from residential use which could possibly require the • use of this piece of right-of-way. It will be easier to know • this when the property to the east of Twin Oaks Lane subdivision does develop and a street pattern;has been established. . It therefore, appears to be premature at this time to consider vacating this portion of dedicated right-of-way . In the meantime, this property would be put to "no public use" but could be usable as yard and open space area for the adjacent dwellings . Your letter states an interest in purchasing this property if it :is not needed. Portions of dedicated right-of-way which are determined by the City Council to be unneeded for public street purposes may be vacated and returned to the ownership of the . adjacent parcels. In order to accomplish vacation, the adjacent property owners must petition the City of Tigard and a hearing will be held on this matter.
