(tax lot 400, Wash. Co. tax map 251 3DD) . Staff .Findings 1. The applicant has submitted a letter describing the proposed uL3 and the need for the variance. A response to the "Fasano question" has been submitted, although not necessarily required for consideration of a variance. 2. The staff has reviewed the granting ,conditions for variances (TMC -• 18.76.020) with respect to this application. While a strict adherence to these guidelines could cause the Planning • Commission to find against the applicant's request, the staff finds that exceptional conditions reti ulting from the considerable amount of unused property to the ream of the existing residential structure (to be converted) makes the request worthy of Planning Commission consideration. s. 3. The proposed parking lot is well placed in terms of highway access and visibility. The gravel lot is environmentally desirable and will not prove a hindrance toward planning the - eventual development of the entire site at some future time. Opponents o Opponents to the proposal appeared, asking that their land not be rezoned: Mr. Verharen on Hall Blvd. was opposed to rezoning. Mr. Art Tarlow (attorney) representing the property owners on SW 97th testified in opposition. Mr. Tarlow brought a recent action of the Wash. Co. Planning Commission to the attention of the Planning Commission, asking that the City and county coordinate their actions. Commission Discussion and Action o Chairman Whittaker voiced his concern over the county's approval of high density apartments adjacent to City limits as brought up by Mr. Tarlow. Whittaker observed that the county's action contravenes Tigard's Comprehensive Plan. o Ball asked why staff had recommended approval in view of public testimony by Dr. Davis and Mr. P Tarlow. o Motion to table (Hansen) to the next meeting. o Seconded (Hartman) o Carried (unanimously) o Hansen asked that the county zoning adjacent the City limits in NPO #2 be available for the Planning Commission at the next meeting and that City Planning staff contact the county to determine the county's position with respect to their rezoning policy in the City Comprehensive Plan area. 4.1 ZONE CHANGE ZC 4-75 (Bunn/Bonn planned Development) A request by Jerry Bonn and Kenneth Bunn for approval of a zone change from R-7 to R-7 Planned Development on an 8.5 acre parcel south of SW Murdock St. , extending north along SW 109th Ave. to SW Canterbury Lane (tax lot 8800, Wash. Meyers Engrs. presented the applicant's General Plan and Program (attached to staff report) . o Several citizens in attendance asked for detailed information from Mr. Dragoo. Opposed o Jack Kreitzer testified that he is the owner of a house built by Mr. Bonn and is dissatisfied with his relationship with Mr. Bonn and was opposed. 5` o Gary Patterson, President of Calway Hill Home- ,. owners Association, testified in opposition on the basis of project density,, N' o Libby Anderson, a neighbor, testified in oppo- sition on the basis of adverse community impact. p o Bruce Erikson, a neighbor, testified in oppo- sition on the basis of adverse community impact. He was concerned about the value of the trees on the south end of the Bonn site to thin community. Mr. Erikson officially entered a letter from his father who was unable to attend. o Marge Davenport, a neighbor, testified in oppo- 0 : sition representing herself and also Barney McPhillips. Ms. Davenport entered a letter from Mr. McPhillips. .3 o Michael Salsberg testified in opposition. C. Staff Recommendation • Approval with the following conditions: 1. Dedication of a 50 to 100 ft. strip across the south end of the PD with a minimum 1/2 acre de- veloped recreation site at the westerly end, adjacent 109th. 2. The cul-de-sac at the end of SW Bonn Ct. be moved northerly to the edge of the stand of trees. 3. Site plan for the entire project will be reviewed by the Design Review Board; building sites will be surveyed and all significant (over 12" caliper) trees identifid on site development plan. PC Minutes - June 3, 1975 - page 4 D. Commission Discussion and Action o Hartman indicated he felt he could not support approval of the project as proposed. He asked staff if preservation of the wooded area at the south end o1 the project was staff's objective in its recommendation. o Whittaker asked Mr. Dragoo to summarize his answer to the issues brought up by Fasano A vs. Washington County. o Whittaker discussed briefly for the audience what the alternatives available to the commission were and what the issues that the commission could decide on would be. o Popp said that he could not support the project on the basis of adverse community impact. o Sakata indicated she was not satisfied with the applicant's answer to "Fasano". o Porter asked that a legal opinion be furnished with respect to the validity of the prior Wash. Co. planned residential development plan. o Nicoli indicated that he felt that higher density development could be accomplished on a portion of the site, leaving the "natural" portion of the site vacant. o Motion to deny (Wakem) based on findings that community impact had not been adequately addressed by the developer and that it appeared that adverse impact would result from the project. o Seconded (Hartman) . o Carried (Hansen abstaining) . 4.5 VARIANCE V 6-75 (Cubby's Corner/Margaret Culbertson) A request by Mrs. Culbertson for a variance of Section 18.60.170 TMC (parking and loading) to allow a gravel parking lot where paved parking is required at 13735 SW Pacific Hwy. OTHER BUSINESS o Commissioner Popp indicated that it had been brought to his attention that more businesses have located in "Security Storage" project since the Planning Commission action. o_ Chairman Whittaker said that Randall Construction had been advertising for business development in that project. The advertisement is currently running in the Tigard Times. o Chairman Whittaker said that inasmuch as this was his last meeting he wanted a parting shot and asked the Commission to refer more frequently to their copies of the TMC and set out a list of projects that the Commission ought to be thinking of for future action' Examples: development of a median divider in Pacific Hwy. ; development of a new sign code; encouragement of more and better landscaping on major streets; development of a civic center with recommendations from the Commission for how it should be developed, where it should be developed and in what time frame; definition of the City's boundaries as a function of land use and of ... the City's growth and development and carry those definitions as recommendations to the Boundary Review Commission, City Council and Washington County, as well as other local govern- , ments; for the Commission to get into an active role with respect to attracting appropriate business and industry, rather than a passive role and simply regulating where and how they locate . 6. I wish to go on record that my purchase of the property was predicated on my belief that this area in question was to remain a park. If it does not, I .believe my property would be extensively damaged and I would have grounds for recourse. In any case, it is obvious to anyone who has taken the time to inspect the area, that it is even more essential today that this property under debate be left as open space. The high density development that has already taken place makes this need critical! There is urgent need for play space for children; need for walking, and "get away" space for adults. I have observed that the area has high usage--kids ride their horses here; people walk their dogs , and many persons hike in, and enjoy these woods. .`'. Although I r•cognize that the pressure is on, especially in areas , : like Tigard, and that there is a real push to blacktop and subdivide I= almost every remaining open space, I hhink the City of Tigard would i . be remiss if it failed to recognize the value of preserving this very unique 8.5 acres at this time because it is an extremely valuable resource that can never be replaced once it is lost, destroyed and developed. The area in question has what is, as far as I can determine, the only substantial stand of old growth Douglas Fir in Tigarde It is a beautiful park-like area where Trilliums and other wild flowers E;'.. bloom in the spring, and where deer (yes , deer) , grey squirrels, mope /2 raccoons, Chinese Pheasants, and many other birds live within the City Limits in relative harmony with their neighbors. As we learn more about the environment and more about the necessity of preserving the few places like this that are left--if man is to survive and withstand the assaults of noise pollution, overcrowding and the tensions of everyday living, we recognize the tremendous responsibility that City Planners and government officials have. • �( 1 Not only in providing equitably for peol-le, who live here •today, but also responsibility to future generations. 1 I urge the Tigard Planning Commission and Tigard City Officials to reject this development proposal and zone chanVe at this time, and to immediately set to work to assure that this unique parcel of land is permanently preserved. If its preservation as "open space" and dedication as a public park was a required part of the Canterbury Development, as the record shows, ... the land owner should be held to this obligation. Otherwise, our planning and zoning laws and regulations are a mockery. On the other hanL,, if preservation means purchase of the property and setting it aside as an "open space, ' "wild space, " or park, I ' hope the commission and city officials will exial rb all available possibilities to do this. My first reason for objecting - when the County approved f , the Canterbury 1partments on the property purchased from Jack Armand , it was to be developed in 3 phases with this ll wooded area along the forth of what is now Tax Lot 8900• i to be left as a wooded with riding trails , etc , ` and Oicni.c areas . 1v second reason - this is one of , if not the only grove of 1st erowt.h timber left in the city of Tigard. I would ask each one at this meeti.n r to t_dke a few minutes to walk through this area before making up his mind on this change. 1 : y . Pacific Highway for purpose of operating a business •,: known as Cubby s Corner".. The business has been operating = in our home for over a year (started as a hobby) , but is now ., at a point where it is necessary to expand in order to continue 4 growth. The business consists of instructing students in painting plaster artware (statuary, wall hangings, etc.) and selling that same plaster artware to our students through day ':.. and night classes. There will be occasional drop-in p-in retail customers, i.e. , three in one month. After renting the premises, we discovered the City Code requires parking to be paved. Because of the position of the home on the property and because of the two driveways that • exist, we chose to put the parking furtherest from the entrances to the Hudson Gas Station which adjoins the property. Thus, the parking area lies 115 feet down the driveway behind trees on the property. Students walk from this area to the house. The paving requirement was very shocking to us as we were not aware of this rule. Me cost for blacktopping is prohibitive to us and if it is required, we probably will not be able to continue the business as our budget is stretched to the breaking point now. We have invested in the rent, of course, telephone installation and deposit, floor covering for the house, pegboard in three rooms to display the plaster, several hundred dollars in additional stock, rototilling and grading of the parking area, tables, chairs, paint, plastic, and the $50,00 .` fee to the Planning Commission. At this point, we must curtail expenditures until our business builds and creates additional monies. We believe our business enhances this lovely home and preserves some beauty to S.W. Pacific Highway. The driveway . chosen for parking entrance alleviates congestion that might otherwise exist. The parking area is hidden by trees and not .s visible from the highway. Paving the parking area which lies almost at the mid- point of the property would create a blacktopped area which most likely would have to be destroyed in the event of future commercial development of this property by other than ourselves. • • ` r T^^ �r' 4 ax ; a • City Planning Commission Page No. 2 May 23, 1975 The following are numbered answers to your "Application for Zoning Map Amendment' which we are told must be answered. • 1. We are only requesting a variance for the requirement to blacktop our parking area to the rear and side of the dwelling. • We wish to gravel the parking area rather than blacktop. 2. Is the rguested zoning in conformance with Ti aq_� rdW!s adopted Comprehensive Plan and other adE2ped precise plans as m_ay be related to your request? It is our understanding that Tigard wishes to enhance the beauty of Pacific Highway and to deny any large business concern which will create a traffic-problem. Our little art shop will be an attractive, homey, lovely shop and will enhance the entire neighborhood. The house will not be changed other than the addition of a small sign and the gravel parking area, it it is allowed. • 3- Does your proposed zone change fulfill a community need -for the proposed use? Yes, parking is located so as to prevent congestion onto the highway. We are not a high traffic business. Our use also enhances the existing property including the colorful landscaping. 4. Have there been changes in conditions, ioreo land use, street 2acity, availability of sewer and water service, etc,, that would justify a chance in zone? The change in land use from a dwelling to commercial occupancy is usually a very awkward situation necessitating major .t~enovation, destruction of trees and lawn area.
