Hawthorne, Portland, stated he agreed with the '' staff report and addressed himself to the 3 points under Staff Rec. #7 and clarified that-there would not actually be 80' of asphalt but would be broken up with landscaping and street trees. He agreed to the points required in the letter from Joe Greulich, Fire Marshall. C. Public Testimony: None. .�, D. Staff Recommendation: Staff recommends approval of the preliminary plan and program with the following conditions. 1. That the points of concern raised in findings of fact;A,p B, any C, - be addressed in the general plan and program when submitted. 2. Sakata seconded. Wood asked if they could give direction to the applicant. ^` The motion failed with a 4-2 vote- Quimby and Sakata voted yes. Brian made a motion for approval based on staff recommendations and with two additional conditions 3) no lot be less than 3500 sq ft. and 4)the recreation area be relocated to be more accessible. . Corliss seconded and asked if it was fair to tie the developers down at this time ; there was no designation of 3500 sq. ft. anywhere else. O Brian stated it would, be best to do now. Laws stated it was an arbitrary lot size and the NPO had never decided on a minimum lot size. Wood stated they would be under separate parcel own.ea'ship. Brian withdrew 1-;is motion. Wood moved approval based on, staff recommendations with the following additional conditions 3) the childrens recration area be more appropriately located 4) the minimum lot size be 3,000 sq ft. $ Hartley stated many buyers would be eliminated with a 3,000 sq. ft. minimum. ' Svendsen stated the 8 units/acre was based on useable land. '. Wood asked who they would hurt with the increased density. Applicant's Presentation: n .; err "Terry Houcic , Attorney for Western Oregon Marine, stated the plateau on the lower level of the property would not be used; they were requesting postponement of the paving so they would be able to move into tile site as soon as Santry vacated. Mr. Reed, V'kstern Oregon Marine, stated the fire wcs costly and all their parts had been burned and it would be a financial impossibility for them to pave the site at this time. Wood stated it would be a violation of the city code if they failed to" comply. Wood made a ipotion for approval with the variance expiring May 31, 1979. Quimby seconded. cc, The vote was unanimous. 6. OTHER BUSINESS,. . , Quimby could see no reason why Sakata, Tepedino and Popp would need another interview to retain their positions. Wood stated the Planning Commission was confident the members of City Council ,'. were informed of the performance of the Planning Commission members and. recommended additional interviews not he required with respect to the re- appointment of existing members of the' Planning Commission; existing memliers should stand on their past performance. Corliss asked why they would not want to go for interviews Quimby stated if they were not looked at favorably by the City Council they would not be reappointed'anyway. c. Sakata stated they could use the minutes of past Commission meeting to make a decision. Wood recommended it was not necessary. Quimby stated personalities shoUld not enter into the decision. Sakata stated it was turning into a,politic∎.l decision. Wood suggested the Commissioners submit, a formal recommendation to Council Corliss stated prhople' .like the commissioners in' question. were needed on the Commission and they should go for the interview to retain their st4U • Wood proposed a letter be sent to the City Councilmembers encouraging - them to consider the question of retaining continuity on the Commission while recognizing their responbibility to decide on Commissioners appointments: and not seeking to interfere in any way with their right to do so. Pacific Hwy. (Wash. Co. Tax Map 1S1 36DA, Tax • Lot 900) . Applicant: Western Oregon Marine I. Findings of Fact: 1. The site is designated Highway Commercial on the NPO #4 Plan and zoned C-3 General Commercial. 2 . Section 18. 60 .170 Improvements of the Tigard Municipal 4 Code required that all areas used for the standing or maneuvering of vehicles shall be improved to the same specifications as required for city streets . 3 . The applicant is requesting a deviation to the code standard by providing a gravel surface in lieu of a. hard surface pavement for on site parking and a display area for boats. 4. Section 18 .76.01a of the Tigard Municipal Code authorizes the Planning Commission to grant variances from the requirements of Title 18 , where it can be shown that, owing to special and unusual circumstances related to a specific piece of property, the literal interpretation of this title would cause an undue or unnecessary hardship. • 5. Section 18.76 .020 of the Tigard Municipal Code states that: "No variance shall be granted by the Planning Commission unless it can be shown that all of the. following conditions exist: (1) Exceptional or extraordinary conditions applying to the property that do not apply generally to other. properties in the same zone or vicinity, which • conditions are a result of lot size or shape, topograph' or other circumstances over which the applica,n�t has r. no control; : . (2) The variance is necessary for the preservation of a property right of the applicant substantially the same as is possessed by owners of other in the same zone or vicinity; (3) The authorization of the variance shall not be materi ally detrimental to the purposes of this title be } t. • 4 STAFF REPORT AGENDA 5. 5 June 20, 1978 Page 2 . injurous to property in the zone or vicinity in • which the property is located or be otherwise detrimental to the objectives of any city development plan or policy: _; (4) The variance requested is the minimum variance from the provisions and standards of this title which will alleviate the hardship. " • 5. There are presently two buildings on the site which are '. being a repair shop and offices by the currenty property owner. 6. The applicant has stated that a large "segment" of the site will be utilized in the operation of his business and that a financial hardship would be imposed upon him if he. L were to have, to pave all parking areas when viewed in respect to adjacent properties. Staff concurs with the applicant that to improve the entire :'- parcel to city standards may create a economic hardship at this time, in that the lower portion of the site is not planned for immediate use. The gravel that ,4.s being proposed ''for the boat display area should not adversely impact adjacent parcels from either an aesthetic or health stand point in that this area would not be utilized as intensively as the parking area in the northern portion , of the site which is also being proposed to be 'developed on a gravel base. However, it is staff's opinion that employee and customer parking on the upper plateau be paved because of the anticipated use that will be generated by vehicular traffic using this portion of the site. II Conclusionary Findings: 1. The proposed variance would not have an adverse impact on adjacent parcel nor be materially detrimental to this title. 2. Since the upper tier portion of the lot will he more ,, heavily used by both customer as well as employee activtyF; a gravel parking area would result in a less than desirable situation (e.g. dust resulting from loose gravel, and.`v:}inma=r..k •+'.° parking spaces) . Therefore, a paved parking surface should' .,. be provided in this area 4 .i I.II. Staff Recommendation: Staff recommends approval subject to the following condition: . 4A 1.
