Motion denied by unanimous vote of Council present. • Councilman Moore abstained from voting because of his I close association with Mr. Penrose. 15. TRAFFIC SIGNAL - S.W. MAIN, JOHNSON & HIGHWAY 99W (a) City Administrator stated he had received preliminary plans from the State of Oregon for the traffic signal. The State will call for bids January 16th and work to be complete in 120-240 days. Administrator requested Council to consider the possibility of prohibiting left hand turns on Highway 99W. If left hand turns were allowed it may destroy effect of pretiming system being installed. Council to study the matter further. OTHER BUSINESS A. CANTERBURY SQUARE SEWER EASEMENT (1) Director of Public Works advised Council the Day Care Center was built over part of the sewer easement and Praggastis-Alexander were requesting the easement be modified to take care of the encroachment. City Attorney stated City had bought easement from private owner. Alexander-Praggastis et al are the new owners and cannot correct the matter by giving the City a new deed. A request for variance approval to delete side . !�a.lk rer1�r ?^er�ents within the Penrose Terrace Subdivision. °. 1, George Penrose explained that without side 5`" walks he could more adequately accomodate the utilities and retain the existing trees. 2 The City Planner recommended that the variance be denied. He said the variance application ` did not appear to meet variance standards . or.. within the Subdivision Code and would possibly set a precedent for future subdivisions. 3 The Public Works Director stated that the area where the trees were of most concern were along S.W. Inez Street near 93rd Avenue, and that variance to allow 4-foot sidewalks (instead of 5' ) might help the problems 4. It was moved (Goslin) seconded _(Whittaker) and 9 passed by a unanimous vote of the Commission present to approve 4-foot sidewalks within the Penrose Terrace Subdivision, based on the staff findings.
