(a) ' Acting City Administrator recommended the City send a letter of intent to participate in the second year of funding for the R.I.D.E, program from November 16, 1973 to November 16, 1974, (b) Motion to approve i Councilman Bergmann, seconded by Councilman Moore. ' Approved by unanimous vote of Council present, 20, PACIFIC NORTHWEST BELL FRANCHISE (a) City Attorney stated he had not received reply as to whether the redrafted franchlse ordinance was acceptable to Pacific Northwest Bell and recommended the matter be set-over to July 9th meeting. 21, OTHER BUSINESS A. Director of Public Services & Facilities stated a request for street vacation of S,,W. 69th had been received. Council referred the request to the City Attorney for further study. B. Mayor Larsen urged all to vote at the budget election tomorrow. e C. Charles Samuels representing the Tigard Park Board asked Council to consider the proposed $500,000, bond issue for • acquisition and development of parks as well as the surcharge to be added to all residential building permit fees. Council will consider further and report back to Park Board, 22, Adjournment: 10420 P.M. 44 City Recorder * Ci of Tigard ATTEST: Mayor : City of Tigard PAGE 5 - COUNCIL MINUTES - JUNE 25, 1973 To: Tigard City Council From: Nick Hiebert, Director of Public Services Subject: Appeal of Planning Commissioners Decision APPEAL The Tigard City Council made a decision to expand the present city shop byilding to alleviate the space problem now present in the City Hail and the Shop. By constructing a two story building, the upper portion could be utilized by the Plenning Department and the Depart of Public Services and Facilities. The lower portion could be used as additional shop area. To expand this building, using the same type of contitruction, the structure would be 16 feet from the property line. The Zoning Ordinance for this zone requires a 20 foot setback. In order to comply with this requirement, the structure would need to be redesigned, the gas pumps and island would need to be relocated and the needed parking area would be lt. In order to comply with this 20 foot setback it will cost the tax- payers additional monies which are not available for this con* struction. This variance was presented to the Planning Commission on June 19, 1973. Their decision was denial by 2 no:72 yes and 2 abstaining4withottteanyefindings. One reason for abstaining was "because he did not think this building should be built on this property. feel that the planning Commission is not aware of the Council's decision for expanding this building. It is also my opinion that some of the Planning Commissioners did not address them- selves to the question of a variance; but to the use itself which was not at issue, request that the Tigard City Council set a time and place for a public hearing before the City Council on the proposed variance. * * :.s 1.t. * .. The total variance request is therefore for four feet. Location and Land Use of Subject Property The property is located on Ash Avenue 250 feet southwest of Burnham Street. It is occupied by the Tigard. Sewerage Treatment Plant and Tigard. City Shops. Surrounding Zoning and Land Use The surrounding property is zoned M-4, Industrial Park, except the property across Fanno Creek to the southwest which is zoned A-2, Multiple Family. The surrounding uses are primarily industrial with the exception of two houses on Ash between the site and Burnham Street and an apartment house across Fanno Creek on Ash. Staff Findings • The staff finds that: 1. The proposed use conforms with the comprehensive plan. 2. Exceptional circumstances arise from the fact that this land is owned by the public and the City washes to utilize the site to provide maximum efficiency per tax dollar invested. 3. The request preserves property rights-of-the public to use this site in accordance with the public need while not • interfering with the rights of surrounding property owners. 4. The authorization of this variance will not be materially detrimental to the purposes of the zoning ordinance or other property in this zone. 5. This request is for four feet, the minimum necessary to alleviate the hardship. Staff Recommendation The staff recommends that the request be approved with the .F‘ condition that the landscape plan which is submitted to the Planning Commission recognize problems resulting from the reduced setback area.
