VICINITY INFORMATION The property to the northeast is developed as commercial. The land to the west and south is zoned and developed as single family residential. The property across Pacific Highway is designated and partially developed for commercial uses. 4 . SITE INFORMATION Approximately 1. 5 acres of the total 12 .06 acres is developed. At the present time, there is one retail building on the south-- west end of the site which is occupied by the TigardPaint Center and Feeks and Stongs Potato Pub. Adjacent to that is the Heinz Auto Europe Auto Repait Shop. The remaining 10. 5 acres is • undeveloped. The property slopes towards the southeast and has several large trees along the south and western boundaries. The remainder of the site is densely covered with brush and grass . 5. APPLICABLE LAND USE POLICIES AND STAFF ANALYSIS A. LCDC GOALS AND GUIDELINES Citizen Involvement: Goal 1 - The intent of this goal is to insure the opportunity for citizens to be involved in all phases of the planning process. Owners of record . . within 250 feet of the site were notified by mail on October 18, 1982. In addition, a legal notice was published in the Tigard Times on October .14i 1982 . Land Use Planning: Goal 2 - All applicable LCDC gOals and guideline , NPO #1 policies and Tigard Municipal Code sections have been considered in review of the application. Natural Disasters and Hazards : Goal 7 - The intent of this goal is to insure that any development which ocCtr'S in an area of natural hazards shall incorporate appropriate safeguards to prevent property daMage or losS of life. • Chapter 18. 57 of the Tigard Municipal Code addresses these considerations by requiting a permit proCess for any s4 development in Seft8itiVe Lands areas . In the case of this application, there is a drainage swale and some steeply sloping lands inVolVed in the relocation of the storm drain and sewer lines . The applicant has stbititted detailed information as required in the Sensitive Lands Permit Ordinance which will be evaluated for compliance prior to approval of the 8e1isitive Lands Pnrmit. Presently, there is an 8" sewer line which runs through the site. The applicant has submitted a Sensitive Lands Permit application to relocate the sewer line on site. In addition, the applicant is proposing to relocate the storm drain line. Water is available from a line in SW Pacific Highway in adequate quantities and pressure to serve both fire and domestic needs . Transportation: Goal 12 - The intent of the goal is to provide a safe, convenient and economic transportation system. The site is accessible from Pacific Highway. The applicant has proposed three access points onto Pacific Highway. The Oregon Department of Transporation has reviewed the applicant's plan and granted conditional • approval. (See attached letter) B. NPO # 1 POLICIES POLICY 18 : Pacific Highway is developing as a strip commercial highway. The traffic carrying capacity of this highway should have the highest priority and adjacent commercial development should be subordinated to this need. POLICY 19 : Ih the interest of safety and efficiency, the number of highway access points must be kept to a minimum, Wherever possible, businesses on Pacific Highway should be clustered and share common parking facilities and driveways. As a new development occurs, the number of access points should not exceed the number necessary for proper on-site traffic circulation and where possible should be combined • with access to adjacent businesses. Also, it was in conflict with the An Green Subdivieion Plan. This property was previously planned for apartment units and the pond was proposed to be retained. Apartment development attempts have occured on this property over the 1Lot 6 to 7 years, and no development has occured. This is the reason the subject property is converting to single family residential housing on 5000 square foot lots. • • T118 drai.ftage way alteration will create a better storm drainage system ., than the rcurrent natural drainage system. As shown in Exhibit "C", the current dv-ainage channel meanders through the property and creats new channels every year. When phase . 2 of the An Groti subdivision is completed, the storm drainage system will be identical to the Morning Will Subdivision to the south. The drainage system in the Morning Hill development is completely underground -• . within storm sower pipes. The Morning Hill Strom sewer system has not •created any adverse problems, and nei:bher will the An Green storm Sewer system. I do not know the true intent of providing this supplemental pipe, but at that time the subject property was proposed as an apart- ment site. This 24" pipe is not in the natural direction of water flow, is not of any value to the An Green development, and it is our intent to plug and abandon it. It is proposed that the lake will be filled and that the ground contours will be re-stored to approximately what existed prior to construction of the lake. The grading of the site and drainage facilities provided will be designed to ensure there will be no adverse impacts on the properties in the Morning Hill subdivision or to the undeveloped property to the East. A specific site grading plan will be provided in the very near future prior to any grading and filling of the site. • This plan will be more specific than the plan submitted with the tentative plat and will be an interim step to the construction plans for public facilities in phase 2. STORM DRAINAGE The major feature of the drainage basin is the Morning Hill subdivision. Plans of the Morning Hill subdivision provided by the City of Tigard and on-site inspection show that all drainage of the development was directed to a point 930 feet East of S.W. 135th Ave. which is almost immediately South of the lake area. The plans and on-site inspection reveal that the Morning Hill improvements incorp- orated a storm drainage detention system apparently in the form of a large under.. ground pipe along the North property line and an open basin in what is designated as Tract 'u" on the plat. The outlets to the pipes are buried and the basin is silted in, through lack of maintenance the detention system is obviously not working as deaigned. For that reason the detention system will be treated as if it doesn't exist and I will assume the worst case situation for designing of facilities in An Green. Phase 1 of An Green is not a portion of the major drainage way nor affected by it Drainage in phase 1 is adequately served by a 12" diameter pipe in S.W. Shore Drive provided by the Witter take development.
