The isting sign Was reviewed and approved in conjunction with the process, 3, Vicinity Information The. property is located on the northwest cornor of Pacific Highway and Gaarde Street, Except for the property directly north, which is zoned (kesidential, 7 units/acre), all surrounding parcels are also zoned 4, Site Information The sigh is situated toward the northern end of the property within the landscaped area Which separates the parking lot and Pacific Highway, The sign is approximately 93 sqUare feet ih size and 20 feet ih height, The applicant propose to add a J.0' 6" by 3' 2° reader board below the existing sign facto, This would result in a total sigh area of approximately 252 square feet, nJAL ORDER NO - PAGE I • , - A ( The basic dimensions allowed by the Code for a free-standing sign in the C-G zone is 70 square feet per side (140, total) and 20 feet in height, An allowance for additional sign size up to 90 square feet is permitted depending upon the setback of the sign. Since this sign is very close if not adjacent to the property line, 70 square feet would be the current size requirement for this sign. 5. Agency. and NPO Comments • • The Engineering Division and State Highway Division have no objection to the request, The Building Inspection Office is opposed because of the precedent that may be set for allowing the enlargement of non-conforming signs. B. FINDINGS AND CONCLUSIONS The relevant criteria in this case are Statewide Planning Goals 1 and 2, and Chapter 18,114 of the Community Development Code. The Planning Commission concludes that the application is consistent with the applicable Statewide Planning Goals based upon the following findingst 1. Goal # 1 is met because the City has adopted a Citizens Involvement program including review of all development applications, by the Neighborhood Planning Organziation (00), In addition, all public notice requirements were met, 2, Goal 112 is met because the City' applied all applicable Statewide Planning Goals, Corn phensiVe Plan policies and Development Code requirements to the application. 4 , The Planning Commission concludes that the proposal does not meet the applicable criteria ih the Community Development Code based upon the following findings! a, Section 10,114,145 of the code contains the criteria for approving a Sign Cede Exception, The Planning Commission shall approVe approVe with conditions, or deny a request for ah exception to the Sign Code based on findings that at least one of the following criteria are satisfied! (1) The proposed Sign Code Exception is necessary because a conforming building or sigh on ah adjacent property would limit the VieW of a sign erected oh the site in conformance with the Sign Code standards (2) The proposed exception to the height limits in the sigh code is necessary to make the in visible from the street • because of the topography of the site; (3) There is an access drive which sertiices the business or service from a street other than the street Upon Which it is located. A Sign Code Exception is necessary for all new and remodeled signs which. do not conform with the requirements of the City's sign ordinance (Chapter 18.114, Community Development Code). B. The application and approval process is a two-step procedure which i'Avolves • 1. Preapplication Conference Prior to submission of a Sign Code Exception application, the applicant must make an appointment with the planning staff to discuss the proposal as it relates to the applicable requirements. 2. Public Nearing before Planning Commission The application for a Sign Code Exception shall be reviewed at a public hearing and will be approved, approved with conditions, or denied by the Planning Commission based upon the relevant criteria. • Notice of the hearing will be given by the Planning Department as provided in the Community Development Code. 4 C.
