Twality Jr. High School Tigard, Oregon DOCXET: V 5-76 REQUEST: A variance to the lot size and landscaping requirements in the M-4 zone. : LOCATION: 12985 SW Hall Blvd. , intersection of SW Hail Blvd and SW Burnham St . (Wash. Co. Tax Map 2S1 2DA, tax lot 200) , APPLICANT: R. C. Malin Company BASIC FACTS : 1. Site is designated industrial on the "Neighborhood Plan I" and zoned M-4 "Industrial Park" , 2. The surrounding land use is trus joist manufacturing plant across SW Burnham St . , food processing plant across SW Hall 81vd, landscaping contractor ' s office and supply office immediately south, and Schramm Plastic Products Company on the west . 3, Section 18 , 76 , 020 states that no variance shall be granted by the Planning Commission unless can be shown that all the following conditions exists: A, Exceptional or extraordinary conditions applying to the property that do not apply generally to other properties in same zone and vicinity Which conditions are result of lot size or shape, topography or other circumstances over which the applicant has no control , B. The variance is necessary for perservation of property right of the applicant is substanially the same as is possessed by owners of other property in the same zone • or vicinity, C The authorization of the variance shall not be materially detrimential to the purpose of this title be injurious to the properties in the zone or vicinity it which the property is located or be otheriviso detrimential to the objectives of any city development plan or policy, D, The variance requests is a minimum variance from the provisions and standards of this title which will alleviate the hardship, STAFF REPORT Agenda 5 .2 July 20, 1076 Page 2 4. SW Hall Blvd is designated an arterial and SW Burnham is designated a collector street on the Tigard Community Plan. FINDINGS : 1 . The applicant is requesting variance to Section 18. 52. 030 and 18 . 58. 080 (2) of Tigard Municipal Code that require a minimum parcel size of 40,000 sq. feet in the M-4 zone and the front 20 feet be landscaped. 2. The Planning Commission on July 3, 1973 issued a variance to reduce the rear yard setback requirement 20 ' to 10 ' to allow construction of an 8500 square feet office ware- house building. That use was never constructed but the variance runs with the land and is still applicable for • consideration of this proposed building. 3. Section 18, 12 . 100 of the Tigard Municipal Code desginated SW Hall Blvd as an arterial and requires an additional 40 ' setback from center line. The right of way width on SW Hall is presently 40 to 50 feet at this site. In order to to provide for the 80 width required for an arterial 40 ' from center line needs to be provided on the west side of the street , This appears to require an additional 14 ' of dedication . Front yard setback for an M-4 zone is • 40 ' of which the first 20 ' must be landscaped. This • requires a total of setback from center line of 80 ' for any permanent structures. 4, SW Burham is desginated a collector street on Section 18 , 12 . 100 Tigard Municipal Code which requires a 30 ' setback from center line, SW Burnham is presently a 40 ' right of way, This requires an additional 301 from center line, The southwest side of the parcel is also a front yard re- . quiring a 40' setback from that front yard in which no permanent structures may be erected, 5, The site is presently approximately 84, 000 sq, feet whereas section 18 , 52 ,080 of the Tigard Municipal Code requires that the lot size be a minimum of 40,000 sq, feet and section 18. 12 ,090 Tigard Municipal Code allows that those lots existing prior to August 24 , 1970 (date of adoption of the ordinance) smaller than those required in the zone may be used as either as a single family dwelling or use permitted out right in the zone, The applicant is proposing an office structure which is a conditional use of the zone and with- out the variance to the minimum lot size requirement this use would not be possible, • • 7 STAFF REPORT Agenda 5. 2 July 20, 1976 Page 3 6. This tax lot was created prior to August 24, 1970 and has been in separate ownership from those around it . 7. Section 18. 58.080 subsection 2 requires that a minimum of the front 20 ' shall be landscaped in a M-4 zone. The applicants requesting a variance to that to reduce that to 15 along both Burnham and SW Hall . The applicant has stated that this is necessary due to the small size of the lot and the required dedication for SW Burnham and SW Hall. If these dedications were not required the 20 ' landscaping could be satisfied. The intent of the 20 ' landscape strip along the front of buildins is to improve the aesthestics of the site. The applicant has proposed to satisfy the aesthestic need of this site with additional landscaping within the smaller area and achieve the same effect . CONCLUSIONARY FINDING: 1 , There is a public need for the future for the widening for SW Burnham and SW Hall . The widening of these two streets reduces the usable of the lot . 2. The lot has two front yards so is faced with extraordinary setback requirements not applied to other lots in the general area or in the M-4 zones, 3, The intent of the landscaping requirements in the code are intended to improve the aesthestic s of the front yard set- , backs, This can be achieved by additional vegetation and landscaping, 4, The intent of the code 1.8 not damaged by the development of an existing small parcel , 5. The need for this variance is brought about in conforming to the Tigard Community Plan in that SW Burnham and SW Hall Blvd, are desginated as collector and arterial streets respectively. The variance further conforms to the Tigard • • Community Plan in that the intent is to upgrade the visual impact along major streets, • STAB RECoMM8NDATIOPS : .
