Site information 1 R Several residences are under construction in the subdivision, however, the majority of the lofts are vacant including lots 1, 12, and 13. • 5. Proposal •DescriEti,orn The applicant contends that due to the small lot sizes involved, the setback variances for the garage and street side yards are necessary. Two of the requested street side yard variances are for the lots on the ,t, corner of Bond Street and 76th Avenue and the third is for the undeveloped lot on Bond Street and 79th Avenues. r r B. ANALYSIS AND CONCLUSION The Planning Commission denied the same garage setback variance request in July, 1983. The applicant has not presented any additional information that is sufficient to reverse the Commission's denial. The R-12 zone allows both sl,ngle and multiple family residential development but there is only one group of setback standards applied to \, all buildings. The R-7 (Residential, 7 units/acre) zone is a lower density designation which only permits single itamily dwellings. The :'. street side yard setback standard in this zone is 10 feet. The corner lots aredrelatively narrow (all approximately 50 feet) and the designs. Since the development +, narrow house g side yard standard will require exceptionally n evelopment involves single family residences which are consistent with the character of d.tvelopment allowed in the R-7 zone, a 10--foot street side yard setback appears justified. The requested 18 feet in this case is more than adequate. Most of the ears 'built , today are 15 feet or less in length. This reduc-ed set back will not be in conflict with the code, the comprehensive plan or other properties 1 in the area. This variance is interior in nature, and the not effect, ., will cause variable front yard Set backs and larger rear yards, without .„ impacting adjacent properties. There is no established set back trend. in the area. However, this vari- a,nce is consistent with the set backs proposed in Bond Park 2 and 3. COMMENT ON FINDING 2 . The lots are relatively small and vary in depth and many different house plans will be used, this variance will help create a more desirable and aesthetically pleasing environment by allowing maximum flexibility of ( front yard set baeks.
