The applicant is requesting a variance to the 400 ' maximum cul-de-sac length prescribed in the Tigard Community Plan, -" 1971 and Section 17.28. 110 of the Tigard Municipal Code The applicant proposes a 660 ' long cut,-de--sac, 2, . 0n February 1, 1977 thePlannin ; Commission granted prelimi,- nary plat approval to the "Cloud Cap" subdivision at SW. 97th } Avenue:, S .W. Murdock Street and S .W .W . Pembrook Street. The prelimi ai y pl at created a 6 O ► cul-de-sac out of S .W. Pem-' - ' brook Street . Upon reviewing the record the City Council; on February 140 1977 determined that procedural defects in notification and proper findings were apparent c.nt a,nd remanded the matter back to the Planning Commission for reconsiderati oni ". 3, The Pembrook Subdivision is entirely out of the city. It is clear from the lack of a turn around at the eastern terMinus • and it being Pembrook Street (not Court , Drives Loop, etc. ) that the street was intended to continue through to S.W. 97t,h Avenue . 4 , The unique characteristics of the site involve its topography and tree cover in the northwest portion of the site There is a 28 ' change in elevation in 350 ' (8%) from the east to the west side of the parcel, A street across this change in eleva- tion would not violate the ma 'imum 12% grade requirements of the subdivision code for local. ,streets The placement of a 100 ' wide cul-de.-sac turn around as proposed would remove more trees than the 50 ' through street .
