Public Testimony: Opponent: • o Bibianne Scheckla, 10890 S .W. Fairhaven Way, said the plan was creating an illegal cul-de-sac, NPO #3 t specified there should be single family residences abutting each other - no common wall duplexes, the maintenance on private Streets would be questionable, all the lots should be 10,000 square feet according to the NPO document. o Melvin Johnson, 10860 S.W. Fairhaven Way, stated: (1) the surrounding property owners bought property assuming single family residences; (2) the plan looked • t like lots of dead end streets; (3) the property de-, " f serves better; (4) questioned the Homeowners Association strength; and (5) wanted the longevity of the town considered: o Ramsdale, 11635 S.W. Terrace Trails, asked about the delay in a traffic analysis - needed a study on in- pactto Gaarde Street, and noticed a lack Of access and bike path to Pacific Highway in the plan. D. Section 17 .44. 030 and .040 of the Tigard MuniCipal Code 11 states that curbs shall be constructed in accordance with standards adopted by the city and five foot sidewalks shall be installed along both Sides of the street adjacent to the property line. . , 3. The applicant is requesting a deviation from the local street Standards by providing asphalt paths in lieu of concrete sideWalkS and curbs to be installed along the Grant AVenUe frontage only. il 4 Section 17.481020 of the Tigard Municipal Code authorizes li the Planning ComMISSion to grant a variance to the sUbdi vision code, provided the Commission finds from the facts , presented at the hearing all of the following: (1) That the are special circumstances or conditions ' effecting the property which are unusual and peculiar . to the lands or development of the project involved as compared to other lands similarly situated, , . . , (2) That the variance sought is necessary and the minimum required for the preservation and protection of a 1 substantial property interest of the petitioner to , the degree that egtraordinary hardship Would result from strict coMpliance with the regulations of this , • N . ! * 1 f a •. . Special Circumstances 2, Z7E7gordinary HardshiP ,,, Prankly, we can neither show special circumstances or extraordinary hardship for the proposed variance, The .. ' . only argument that can be stated is an explanation of ,— , of what street improvements exist In the immediate area and the willingness of the planning staff and Planning Commission to maintain the existing park-like atmosphere. The majority of collector streets in the area do not have curbs or sidewalks. Watkins Avenue, the closest improved street, has a full 34 foot paved street with curbs ; but . . no sidewalks. The installation of cUrbs and sidewalks in this development and on Grant Avenue would result in an isolated street improvement which will not dovetail into any present or future development. , . 3. Effect on Adjacent Properties . No economic effects are expected due to this variance. i The adjacent properties do not haye curbs , sidewalks , , or the required Tight ,of way width. Since it is our intent to provide the street paving to the City of Tigard .• standards , we anticipate no detremental effects. 4. Conformance to Remainder of Land Partitioning Aequirements ,. The intent of the proposal is to develop the street right of way, sewers , and water service :bo the City of Tigard . , • standards, ' ,.• . - t . • ' . * 1 . • 1 g, • - 1 1 , , . . ..
