Existing Safeway store is built on the property line along Hall Boulevard and proposed addition would extend the building an additional 56 feet from the present 128 feet to a length of 184 feet along Hall. 2. The 10' front yard setback in the C-3 one plus the 40' center- line setback for Hall Blvd. would make the minimum legal setback from the property line here 20° . 3. Parking ratio proposed is 2.7/1000 square feet gross lease area for the whole project, assuming full occupancy (a portion of the shopping center, about 20,000 square feet, has never been completed or occupied). 4. According to typical standards, Tigard Plaza has, about the minimum parking space that it can stand, although it has far more than Tigard's minimum standards require. It is staff's opinion that Benol could safely reduce its number of parking • spaces by 10 to 15 percent without creating a parking problem. Also the parking areas, as presently designed are wasteful of space and could be redesigned to accomodate as many or more automobiles as well as landscaping. 5. Minimum landscaping requirements are; 101 land, lape setback from front property line, major landscape feature (shade tree) 70 feet on center (both ways) in parking lot, 2 landscape buffer and sight obscuring fence or hedge between parking and adjacent residential areas, and, a minimum of 15% of total lot area must be landscaped, 6. Main Street Tigard, OR 97223 RE: Application for Variance to Zoning Code for Safeway Store • -Addition at our TIGARD SHOPPING PLAZA • Gentlemen: • We respectfully request your approval of the above. The following are pertinent facts and our reasons for this application: 1. Safeway Stores have been the prime tenant in our centre since it was completed in 1962. They find that their business has expanded to the point where they must increase the size of their store to handle their present and future requirements. They therefore requested that we provide additional space of approximately 10,000 square feet, so we have arranged to purchase sufficient additional property to accommodate their requirements. The only way we can do this is to add a small addition at the front and a larger addition at the rear and both additions are required to be at the property line, to line up with their existing space which is and has always been, on the property line. The present zoning of both our pro- perty and the property we have purchased is C-3, which, if we were planning a new • project, would apparently require a setback from Highway 217 (Hall Boulevard) of ten feet. While we consider this a "side yard") which would require no setback techni cally it apparently must be considered a "front yard", so we request that you grant us approval to build the additions with no setback. 2. Conditions of our application do not apply generally to other properties in the same vicinity. 3. We believe our variance request is necessary to protect our property, and is reasonable. In fact, to involve a setback now, would create an unworkable building for commercial purposes. 4. Authorization of this variance will not be contrary to the purpose or intent of the zoning code; nor will it cause or allow injury or detriment to other properties . In the same zone or vicinity, because the completed addition will be at the same property line location as the existing building. Purthermore) after discussion with the Planning Department) our variance application seems reasonable and will not be contrary or detrimental to the intent or objective of any City plan or policy. .ryV,.m......,,..+„....,.M».......... ...,.._e«..,,...M.....,,.a,........,,_.,-,.,,,,....-,.,..,..+,...-+,+,..-.,...x,...,-:.,..,,.,.—.-..,-IN.....w..-M»,,..M,..,_,..,...,.,.»,........L..y...,..w,T.,.,.7:.;:C,:.:,...x.,:=.1':...6,:..,«',w::..,..4........,._..,...,.........•k .w r;aS:V L :`Ir.'...vcL...6P.-. ,4 F. v r ” ( • _2_ • Planning Commission February 10, 1976 5. Commission Discussion and Action o Nicoli asked if the present parking would be adequate for the proposed use. o Staff stated that it would, probably, but that week- end operation of the flea market would conflict with the proposed billiard parlor in that their peak operation hours would coincide. o Ems stated he was not aware of any parking problem on that site as he had never seen a deficit of parking availability. o Sakata asked Sherr how much landscaping he was pro- posing, what his hours of operation were, what signing he would use and if he had looked for alter- native sites. 0 Chairman Popp directed Mr. Sherr to answer. o Sherr responded that his hours of operation would be 12 noon to midnight, 7 days a week; that he would use the existing signs on the premises; that he had anticipated providing landscaping along the edge of the sidewalk, between the sidewalk and the parking areas and that he had looked for other areas to lo- • cate this establishment. • o Moore asked the applicant if he was presently oper- ' ating a similar type business. o Sherr responded that he was not presently operating this kind of business. A o Sakata stated she did not feel the site Was suitable for the establishment proposed. o Goldbach concurred. o Moore stated he felt the proposed occupancy load Would clearly exceed the availability of parking, even if the sites mentioned by the applicant were reserved. o Ens stated that the Commission, he felt, was reaching beyond what the code required for parking; that there was only a partial conflict of hours of oipemtion and the Commission ought to approve a conditf6tal use subject to annual review. ._ r ,u a. -.r..a .. .. ...........__.-...__ --...+...,.--._...-....,.--.........,_.._._..-...w...-...,..._-,....._ r.,,MI eK.-.-M.,.-,. «..M..«.._......-..-.,- -.,a ,......._a.4,=f..+tA-..'.« :.._..._.N....._„ti:,,«...'::-m,,._..--..a+............_.M..».«-.,.:...t.. ... - page 3 PC Minutes . Main, Street Tigard, OR 97223 RE: Application for Variance to Zoning Code for Safeway Store Addition at our TIGARD SHOPPING PLAZA • Gentlemen: We respectfully request your approval of the above: The following are pertinent facts and our reasons for this application: 1. Safeway Stores have been the prime tenant in our centre since it was completed in 1962. They find that their business has expanded to the point where they must increase the size of their store to handle their present and future requirements. They therefore requested that we provide additional space of approximately 10,000 square feet, so we have arranged to purchase sufficient additional property to aaccommodate their requirements. The only way we can do this is to add a small cc addition at the front and a larger addition at the rear, and both additions are required to be at the property` l.ne, to line up with their existing space which is and has always be ert and the y,we have property The we were planning new ety lxize, present zoning of both our pro- . p Y property p haled is C-3, which, if p g a n , prod require a setback from Highway 217 (Hall Boulevard) of ten project, would apparently z ` ile we consider this a "side yard", which would requ7.re no setback, techni- cally us apparently are considered a '"front yard", so we request that you must be consi g pp to build the additions with no setback. the Conditions of,our application do not a' l- generally r pp j apply g Y to other properties in y. - W3 e believe our varianc e request is necessary to protect our property, and is reasonable. In fact, to invv a setback now, would create an unworkable building for commercial purposes. 4. Authorization of + , thisi variance will not be contrary to the purpose or intent ` Varian of the zoning code; nor will it cause or allow injury or detriment to other roerties zone or vicinity, because the completed addition will be at the same g j J properties a property g buildin trthermore after 'discussion in the same location ter discus with the Planning application seems reasonable and line og Departmente oursva.riance a g j ' will not be contrary or detrimental to the pp intent or objective of an City tan or policy, '" .. ' y p -4 - .4,4,, • 1 * N, ,0* -2- Planning Commission February 10, 1976 5.
