The I-P zoning district provides appropriate locations for combining light manufacturing, office and small-scale commercial uses, e.g., restaurants, personal services and fitness centers, in a campus-like setting. Only those light industrial uses with no off-site impacts,e.g.,noise,glare,odor,vibration, are permitted in the I-P zone. In addition to mandatory site development review, design and development standards in the I-P zone have been adopted to insure that developments will be well-integrated, attractively landscaped, and pedestrian- friendly. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. NOTICE OF TYPE I DECISION T MIS2007-00013-McCALL OIL LOT LINE ADJUSTMENT PAGE 1 OF 4 • CONDITION OF APPROVV THE FOLLOWING CONDITION SHALL BE SATISFIED WITHIN 18 MONSTHS OF THIS DECISION: Unless otherwise noted, the staff contact shall be Emily Eng in the PIanning Division at (503) 718-2172. 1. Following recording, the applicant shall provide evidence to the City that the lot line adjustment survey map was recorded within 18 months of this decision. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: Lot 1 (Tax Lot 700) and Lot 2 (Tax Lot 4000) are located north of Pacific Highway. The properties are part of an industrial site that sits between the railroad line to the east and a narrow strip of Oregon Department of Transportation property to the west, along SW Tigard Street until it meets SW Tiedeman Avenue. There are no previous land use decisions related to either of the properties. An industrial building exists on Lot 1. Lot 2 is vacant and was recently consolidated with the property bordering its northeast boundary(WCTM 1S135CD, Tax Lot 1100), increasing the lot size of Lot 2 to 200,340 square feet. • Proposal Description: The applicant proposes to adjust one (1) lot line which will reconfigure two (2) different lots. The applicant desires to adjust the lot line between Lots 1 and 2. Lot 1 is 140,871 square feet and will become 173,122 square feet;Lot 2 is 200,340 square feet and will become 183,230 square feet. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request: Section 18.410.040 - Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district. Two lots exist and two lots will remain. Therefore, an additional parcel is not created by the lot line adjustment. By reducing the lot size the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district. There is no minimum lot size for properties in the I-P zone and both lots will continue to exceed the minimum lot width of 50 feet. There}ore, reducing Lot 1 will not violate site development or zoning district regulations. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: NOTICE OF TYPE I DECISION MIS2007-00013-McCALL OIL LOT LINE ADJUSTMENT PAGE 2 OF 4 • The minimum width f the building envelope area shall meet the lot requirement of the applicable zoning district; g P • The lot area shall be as required by the applicable zoning district. In the case of a flag lot,the access way may not be included in the lot area calculation; • Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and • Setbacks shall be as required by the applicable zoning district. The average width of the building envelope area for Lot 1 will be 220 ft, which exceeds the minimum of 50 feet. Lot 2 is a vacant lot. The property would not violate the minimum average lot width because it is a large and relatively wide lot. Lot 1 will be 173,122 square feet and Lot 2 will be 183,230 square feet. There is no minimum lot size in the I-P zone. Lot 1 has a frontage of 80-90 feet along an access easement, exceeding the standard of 15 feet. There is no access to Lot 2; however,there are no structures on it. Setback requirements in the I-P zone are 35 feet front, 0 feet side and 0 feet rear. The building on Lot 1 will a front setback of about 300 feet, an east side setback of over 100 feet, a west side setback of close to 0 feet and a rear setback of 304 feet, exceeding the requirements. There are no structures on Lot 2. With regard to flag lots: • When the partitioned lot is a flag lot the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. • A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Neither of the lots is being partitioned or is a flag lot. Therefore,this criterion does not apply. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. Tax Lot 700 has access to SW Tiedeman Avenue through an access easement. Tax Lot 4000 is vacant. The existing access will not be changed as a result of the Lot Line Adjustment and would not have a detrimental effect on fire-fighting capabilities. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. A common drive is not proposed or required. Therefore,this criterion does not apply. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. The existing access will not be altered as a result of this lot line adjustment. It complies with the standards of Chapter 18.705 in that it is pre-existing. Exemptions from dedications: A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required. I think I've figured that most of the problem comes from the site not being surveyed before. The plat of Greenburg Heights Addition shows Tax Lot 4000 (before the lot consolidation) at 3.87 acres. I don't know where the Assessor/Cartographer came up with 4.64 acres, but they were closer. I have 4.25 acres on the original Tax Lot 4000 (4.6 with the consolidation). The tough part of this boundary resolution was accurately measuring the railroad right of way(something not performed by many before me). Anyway, I feel good about the area listed on the map and actually double checked it earlier this morning.
