The findings_and conclusions -`on which the decision is based are noted Section : NOTICE OF TYPE I DECISION PAGE 1 OF 5 MIS2007-00010-MIDDAUGH LOT LINE ADJUSTMENT • • CONDITIONS OF APPROVAL PRIOR TO THE RECORDING OF THE LOT LINE ADJUSTMENT, THE FOLLOWING CONDITION SHALL. BE SATISFIED:- -UNLESS OTHERWISE NOTED, THE STAFF CONTACT SHALL- BE CHERYL •CAINES IN THE PLANNING DIVISION AT 503-639-4171... 1. Prior to recording, a Lot Line Adjustment survey map and legal descriptions showing the existing and proposed lot lines shall be reviewed and approved by the Planning Department. The survey map shall include all access and utility easements. 2. Following recording, the applicant shall provide evidence to the City that the Lot Line Adjustment survey map was recorded within 18 months of this decision. THIS APPROVAL SHALL BE VALID:FOR18.MONTHS .. FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcels are located in the northwest portion of Tigard between 65th Avenue and 69th Avenue near the Portland city limits. Both parcels are surrounded by residential uses and both parcels are larger than the minimum requirement of 7,500 square feet. Both lots are developed with single- family residences. The two parcels share a rear property line. Proposal Description: The applicant is proposing to adjust one (1) property line,which will reconfigure two (2) separate parcels. The rear lot line of Parcel 1 will be moved approximately 100 feet to the north, thus making Parcel 2 a smaller lot. Parcel 1 of 18,498 will become 27,098 square feet. Parcel 2 of 18,498 will become 9,898 square feet respectively. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request: Section 18.410.040 - Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No new lots will be created as part of this adjustment; two (2) lots exist and two (2) lots will remain after the proposed adjustment. The R-4.5 zone has a minimum lot size of 7,500 square feet. In any event, the lots will be 27,098 and 9,898 square feet after the adjustment. Therefore, this standard is satisfied. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; NOTICE OF TYPE I DECISION PAGE 2 OF 5 MIS2007-00010-MIDDAUGH LOT LINE ADJUSTMENT The resulting lot sizes will Slain above the minimum required in OR-4.5 zone. Based on the site plan provided, the existing residences on both lots currently meet all setback requirements. The only lot line being adjusted it the rear property line, which is the northern boundary of Parcel 1. After the adjustment this adjusted will be approximately 34 feet away from the existing home on Parcel 2 and over 230 feet from the home on Parcel 1. Therefore,this standard has been satisfied. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: ♦ The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; ♦ The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; ♦ Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and ♦ Setbacks shall be as required by the applicable zoning district. The reduced lot size of lot 2 from 18,498 to 9,898 square feet still provides adequate width and size to meet the dimensional requirements of the R-4.5 zoning district. The above standard requires lots created through the partition process to front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement. The proposed adjustment will have no effect on the street frontage of either lot. Both parcels will continue to have 86 feet of frontage along either Walnut Terrace or Alfred Street. This standard refers to the partitioning of parcels only. Setbacks were discussed previously in this decision. The dimensional standards of the zoning district are met. With regard to flag lots: ♦ When the partitioned lot is a flag lot, the developer may determine the location of the front yard,provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. ♦ A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The proposed lot line adjustment does not involve flag lots. Therefore,this standard does not apply. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. Both parcels have direct access to either Alfred Street or Walnut Terrace. No accessways are involved or being created with this application. This criterion is met. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. No common drives exist or are being proposed with this adjustment. This criterion is not applicable. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. No new accessways are proposed with this application. Each residence will continue to utilize individual driveways with direct access onto the streets that front the parcels (Alfred Street and Walnut Terrace). Both are local streets. There are no spacing standards for driveways along local streets. This criterion is met. NOTICE OF TYPE I DECISION PAGE 3 OF 5 MIS2007-00010-MIDDAUGH LOT LINE ADJUSTMENT • • Exemptions from dedications: A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required. Floodplain, greenway and right-of-way dedication is not required as part of this application. Therefore, this standard does not apply. Variances to development standards: An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370,Variances and Adjustments. The applicant has not requested a variance or an adjustment with this application. FINDING: Based on the analysis above, Staff finds that the Lot Line Adjustment criteria have been met. SECTION V. BACKGROUND INFORMATION Site Information: The subject parcels are located in the northwest portion of Tigard between 65`h Avenue and 69th Avenue near the Portland city limits. Both parcels are surrounded by residential uses and both parcels are larger than the minimum requirement of 7,500 square feet. Both lots are developed with single- family residences. The two parcels share a rear property line. Proposal Description: The applicant is proposing to adjust one (1) property line, which will reconfigure two (2) separate parcels. The rear lot line of Parcel 1 will be moved approximately 100 feet to the north, thus making Parcel 2 a smaller lot. Parcel 1 of 18,498 will become 27,098 square feet. Parcel 2 of 18,498 will become 9,898 square feet respectively. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request: Section 18.410.040 - Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No new lots will be created as part of this adjustment; two (2) lots exist and two (2) lots will remain after the proposed adjustment. The R-4.5 zone has a minimum lot size of 7,500 square feet. In any event, the lots will be 27,098 and 9,898 square feet after the adjustment. Therefore, this standard is satisfied. • By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; NOTICE OF TYPE I DECISION PAGE 2 OF 5 MIS2007-00010-MIDDAUGH].OT LINE ADJUSTMENT The resulting lot sizes will 'aim above the minimum required in t -4.5 zone. Based on the site plan provided, the existing residences on both lots currently meet all setback requirements. The only lot line being adjusted it the rear property line, which is the northern boundary of Parcel 1. After the adjustment this line will be approximately 34 feet away from the existing home on Parcel 2 and over 230 feet from the home on Parcel 1. Therefore, this standard has been satisfied. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: ♦ The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; • The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; • Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and • Setbacks shall be as required by the applicable zoning district. The reduced lot size of lot 2 from 18,498 to 9,898 square feet still provides adequate width and size to meet the dimensional requirements of the R-4.5 zoning district. The above standard requires lots created through the partition process to front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement. The proposed adjustment will have no effect on the street frontage of either lot. Both parcels will continue to have 86 feet of frontage along either Walnut Terrace or Alfred Street. This standard refers to the partitioning of parcels only. Setbacks were discussed previously in this decision. The dimensional standards of the zoning district are met. With regard to flag lots: ♦ When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. • A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The proposed lot line adjustment does not involve flag lots. Therefore, this standard does not apply. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. Both parcels have direct access to either Alfred Street or Walnut Terrace. No accessways are involved or being created with this application. This criterion is met. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. No common drives exist or are being proposed with this adjustment. This criterion is not applicable. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. No new accessways are proposed with this application. Each residence will continue to utilize individual driveways with direct access onto the streets that front the parcels (Alfred Street and Walnut Terrace). Both are local streets. There are no spacing standards for driveways along local streets. This criterion is met. Floodplain, greenway and right-of-way dedication is not required as part of this application. Therefore, this standard does not apply. Variances to development standards: An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370,Variances and Adjustments. The applicant has not requested a variance or an adjustment with this application. FINDING: Based on the analysis above, Staff finds that the Lot Line Adjustment criteria have been met. SECTION V. Per Chapter 18.410 a property line adjustment is a Type I procedure. The rear lot line between both tax lots is proposed to be adjusted exactly 100.00 feet to the north. After the property line adjustment is complete tax lot 3500 would be .22 acres in size, have a north south (depth) dimension of 115.10 feeand an east west (width) dimension of 86.0 feet. Tax lot 5000 would be .62 acres in size have a north south dimension of 315.10 feet and east west directions of 86.0 feet. It is both owners' intention the leave the entire site in an undisturbed state as a result of this application. No new development is proposed with this application. Access to each lot will not change as a result of this application. Tax lot 3500 would continue to access directly onto SW Walnut Terrace and tax.lot 5000 would continue to access directly onto SW Alfred Street. Tax Lot 3500 would:maintain the required more then the minimum 7,500 square foot area and 15 foot rear yard setback in the R-4.5 zone as shown on the existing conditions plan submitted with this application. All front and side setbacks would remain unaltered as a result of this property line.adjustment. Chapter 18.390 DECISION-MAKING PROCEDURES 18.390.010 Purpose A. Purpose. The purpose of this chapter is to establish a series of standard decision-making procedures that will enable the City, the applicant, and all interested parties to reasonably review applications and participate in the local decision-making process in a timely and effective way. Each permit or action set forth in Chapters 18.320- 18.385 has been assigned a specific procedure type. 18.390.020 Description of Decision Making Procedures A. General. All development permit applications shall be decided by using one of the following P rocedure types. The procedure type assigned.to each action governs the decision-makin g process for that permit, except to the extent otherwise required by applicable state or federal law. The Director shall be responsible for assigning specific procedure types to individual permit or action requests, as requested. Special alternative decision-making procedures have been developed by the City in accordance with existing state law, and are codified in Section 18.390.070. B. Types defined. There are four types of decision-making procedures, as follows: 1. Type I Procedure. Type I procedures apply to ministerial permits and actions containing clear and objective approval criteria. Type I actions are decided by the Director without public notice and without a public hearing; Lot Line Adjustment 18.410.040 . :.6 • • FINDING Per table 18.390.030 a property line adjustment is a Type 1 procedure. Due to this fact this application will be reviewed as a Type 1 procedure in the City of Tigard. Chapter 18.410 Lot Line Adjustments • 18.410.010 Purpose • A. Purpose. The purpose of this chapter is to provide rules, regulations and standards governing approval of partitions. 18.410.020 Approval Process A. Decision Making Procedures Lot,line adjustments shall be reviewed by a Type I procedure, as governed by Chapter 18.390, using approval criteria contained in section 18.410.040. B. Time Limit on Approval. The lot line adjustment approval by the Director shall be effective for a period of 1 '/2 years from the date of approval:- C. Lapsing of approval. The lot line adjustment approval by the Director shall lapse if: 1. The lot line adjustment has been improperly recorded with Washington County without the satisfactory completion of all conditions of approval; or 2. The final recording is a departure from the approved plan D. Extension. The director shall upon written request by the applicant and payment of the required fee, grant extension of the approval period not to exceed one year provided that: 1. No changes are made on the original plan as approved by the director; 2. The applicant can show intent of recording the approved partition or lot line adjustment within the one year extension period; and 3. There have been no changes in the applicable. Comprehensive Plan policies and ordinance provisions on which the approval was based. FINDING The applicant understands the above described approval process and plans to complete all conditions of approval set forth by the city and record the approval in due diligence with Washington County as required. 18.410.030 Application Submission Requirements A. General Submission Requirements. All applications shall be made on forms provided by the Director and shall include information required for a Type"I application, as governed by Chapter 18.390. B. Specific submission requirements. All applications shall include the preliminary lot line map and necessary data or narrative, detailed information for which shall be obtained from the Director. 7 • FINDING The applicant has submitted this application:for a property line adjustment on forms provided by the director and has included all of the information required for a Type I procedure. The application submittal package includes an existing conditions plan, proposed preliminary lot line map, narrative and detailed information as required by the director and listed in Bold on the City of Tigard Lot Line Adjustment application. A. Approval Criteria. The Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structures on the lot will not be violation of the site development or zoning district regulations for that district. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelop area shall meet the lot requirement of the applicable zoning district; b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; c. Each lot created through the partition process shall front a public right of way by a least 15 feet or have a legally recorded minimum 15-foot wide access easement; and d. Setbacks shall be as required by the applicable zoning district. FINDING No additional parcels will be created as a result of this application. Tax lot 3500 will be reduced in size as a result of the adjustment but, it will maintain an area well above the required minimum lot area of 7,500 square feet. As shown on the plan set submitted with this application the reduction in lot size would not cause any structures on either lot to be in violation of the site development or zoning code. The existing rear yard setbacks of each lot will change as a result of this application but tax lot 3500 would still retain a 34 foot rear yard. The R-4.5 zone requires a minimum of 15 feet. Both of the resulting:parcels are in conformity with the dimensional standards of the zoning district as identified on submitted plan set. The minimum width of the R-4.5 zone requires a minimum width of 50 feet, Both tax lots are 86.0 feet in width which will not change as a result of this application..:,A flag lot will not be created as a result of this application. All setbacks required by the R-7.5 zone will continue to be satisfied as a result of this application. • 8 �. • 4. With Regard to flag lots...... FINDING A flag lot will not be created as a result of this application. Therefore, this criterion is not applicable to this application. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have detrimental effect on fire fighting capabilities. FINDING An access way will not be created as a result of this application; therefore this section is not applicable to this particular land use review. Chapter 18.510 RESIDENTIAL ZONING DISTRICTS 18.510.010 Purpose A. Preserve neighborhood livability. One of the major purposes of the regulations governing development in residential zoning districts is to protect the livability of existing and future residential neighborhoods, by encouraging primarily residential development with compatible non-residential development -- schools, churches, parks and recreation facilities, day care centers, neighborhood commercial uses and other services-- at appropriate locations and at an appropriate scale. B. Encourage construction of affordable.housing. Another purpose of these regulations is to create the environment in which construction of a full range of owner-occupied and rental housing at affordable prices is encouraged. This can be accomplished by providing residential zoning districts of varying densities and developing flexible design and development standards to encourage innovation and reduce housing costs. 18.510.020 List of Zoning Districts D. R-4.5: Low-Density Residential District. The R-4.5 zoning district is designed to accommodate detached single-family homes withYor without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally. FINDING The zoning of the both sites is R-4.5. No development will occur on either lot. As shown in the plan set submitted with this application both tax lots will continue to exceed the minimum lot size requirement in the R-4.5 zone of 7,500 square feet. Therefore, the criterion is met. 9. • • • 18.510.030 Uses A. Types of uses. For the purposes of this chapter, there are four kinds of use: 1. A permitted (P) use is a use which is permitted outright, but subject to all of the applicable provisions of this title. If a use is not listed as a permitted use, it may be held to be a similar unlisted used under the provisions of Chapter 18.230; 2. A restricted(R) use is permitted outright providing it is in compliance with special requirements, exceptions or restrictions; 3. A conditional use (C) is a use the approval of which is discretionary with the Hearings Officer. The approval process and criteria are set forth in Chapters 18.310 and 18.320. If a use is not listed as a conditional use, it may be held to be a similar unlisted used under the provisions of Chapter 18.230; 4. A prohibited(N) use is one which is not permitted in a zoning district under any circumstances. B. Use table. A list of permitted, limited,:conditional and prohibited uses in residential zones is presented in Table 18.510.1. FINDING All uses are existing and allowed within the zone. No new development will occur on either lot as a result of this application. Therefore, this criterion is met. 18.510.040 Minimum and Maximum Densities+: A. Purpose. The purpose of this section is, to establish minimum and maximum densities in each residential zoning district. To ensure the quality and density of development envisioned, the maximum density establishes the ceiling for development in each zoning district based on minimum lot size. To ensure that property develops at or near the density envisioned for the zone, the minimum density for each zoning district has been established at 80%of maximum density. B. Calculating minimum and maximum densities.-:.The calculation of minimum and maximums densities is governed by the formulas in Chapter 18.71.5,Density Computations. FINDING No additional parcels will be created as a result of this application therefore; this criterion is not applicable to this application. . C. Adjustments. Applicants may request an adjustment when, because of the size of the site or other constraint, it is not possible to accommodate the proportional minimum density as required by Section 18.715020C and still comply with.all of the development standards in the underlying zoning district, as contained in Table 18.510.2 below. Such an adjustment may be granted by means of a Type I procedure, as governed by Chapter 18.390, using approval criteria in Section 18.370.020.C.2. • 10 • • • FINDING The applicant is not proposing divide the property to minimum or maximum densities as a result no adjustments are requested and, as a consequence, this section of the code does not apply to this particular land use review. 18.510.050 Development Standards • A. Compliance required. All development must comply with: 1. All of the applicable development standards contained in the underlying zoning district, except where the applicant has obtained variances or adjustments in accordance with Chapters 18.370; 2. All other applicable standards and requirements contained in this title. B. Development Standards. Development "standards in residential zoning districts are contained in Table 18.510.2. FINDING Both of the parcels meet the minimum requirements as described throughout this narrative and depicted on the submitted plan set. The smallest lot that will be created is greater 7,500 square feet in size. The homes and associated development on both tax lots of record meets all required area, width and setbacks. No new development is proposed on either parcel. Therefore, the criterion is met.
