NOTICE OF TYPE I DEQSION MIS2007-00003-POT1S LOT LINE ADJUSTMENT PAGE 1 OF 4 • CONDITION OF APPROVO THE FOLLOWING CONDITION SHALL BE SATISFIED PRIOR TO RECEIVING ANY BUILDING PERMITS: Unless otherwise noted, the staff contact shall be Emily Eng in the Planning Division at (503) 718-2712. 1. The applicant shall record the lot line adjustment survey map with Washington County within 18 months of this decision. The applicant shall provide a copy of the recorded map to the City within 15 days of recording. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information and History: Lots 1 ax Lot 9900) and 2 (Tax Lot 10100) are located on SW 135th Avenue near its intersection with SW Walnut Street. Lots 1 and 2 were created through an approved 3-lot partition, MLP2004-00009 (Alexander Partition). Lot 1 is a flag lot with access to SW 135 Avenue through a 15-ft easement. Lot 2 has frontage on SW 135th Avenue. Proposal Description: The applicant requests approval to adjust two (2) lot lines, which will reconfigure two (2) different lots. Lot 1 is 7,132 sq 1t and will become 7,615 sq ft. Lot 2 is 23,954 sq ft and will become 23,471 sq ft. The applicant desires a lot line adjustment so that the proposed new house will comply with the 10-ft side yard setback standard for flag lots. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request Section 18.410.040 - Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; An additional parcel is not created by the lot line adjustment. Two lots exist and two lots will remain. By reducing the lot size the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Reducing the size of Lot 2 will no t cause either of the structures on Lot 1 or 2 to violate the site development or zoning regulations, as shown below. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: • The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; • The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; • Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and • Setbacks shall be as required by the applicable zoning district. NOTICE OF TYPE I DECISION MIS2007-00003-POT 1S LOT LINE ADJUSTMENT PAGE 2 OF 4 Y The resulting parcels comply with the dimensional standards of the R-7 zoning district, as shown below: • The average width of the building envelope area for Lot 1 will be 69 ft and for Lot 2 will be 117 ft, both of which exceed the minimum of-50 ft. • Lot 1 will be 7,615 sq ft and Lot 2 will be 23,471 sq ft, both exceeding the minimum lot size of 5,000 sq ft. • Lots 1 and 2 were created through the partition process. Lot 1 has a recorded 15-ft access easement. Lot 2 has a frontage of 117 ft both of which meet or exceed the standard. • Lot 1 will have setbacks as follows: 42-ft front, 15 and 12-ft side and 15-ft rear. Lot 2 will have setbacks as follows: 72-ft front 16.5 and 27-ft side and 90-ft rear. The minimum setbacks in the R-7 zone are 15-ft front, 5-ft side and 15-ft rear. Both garages exceed the minimum setback of 20 ft. Therefore,the resulting parcels exceed the minimum setback requirements. With regard to flag lots: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. • A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Lot 1 is a flag lot and will maintain side yard setbacks of at least 10 ft. The partition approval for MLP2004-00009 indicates that the applicant will be providing a 4-ft hedge along the proposed driveway,where it is within 10 ft of the neighboring lot. Therefore,this criterion is met. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. The partition approval for MLP2004-0009 indicated that the length of the access way would not be a • fire hazard. Therefore,this criterion does not apply. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. A common drive was proposed for the purposes of the partition. A reciprocal easement ensuring access and maintenance rights has been recorded with the approved partition plat (Partition Plat No. 2006-043,Document No. 2006096648). Therefore,this critenon has been met. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. The proposed access way was approved with the partition approval, MLP2004-00009, and complies with the standards in Chapter 18.705. Exemptions from dedications: A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required. No floodplain, greenway or right-of-way dedication shall be required as a result of this lot line adjustment. Variances to development standards: An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370,Variances and Adjustments. The applicant does not request a variance. FINDING: Based on the analysis above, Staff finds that the Lot Line Adjustment criteria have been met for Lots 1 and 2. The findings and conclusions on which the decision is based are noted in Section IV. NOTICE OF TYPE I DECISION MIS2007-00003-POI"15 LOT LINE ADJUSTMENT PAGE 1 OF 4 CONDITION OF APPROVAL • THE FOLLOWING CONDITION SHALL BE SATISFIED PRIOR TO RECEIVING ANY BUILDING PERMITS: Unless otherwise noted, the staff contact shall be Emily Eng in the Planning Division at (503) 718-2712. 1. The applicant shall record the lot line adjustment survey map with Washington County within 18 months of this decision. The applicant shall provide a copy of the recorded map to the City within 15 days of recording. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information and History: Lots 1 (Tax Lot 9900) and 2 (Tax Lot 10100) are located on SW 135th Avenue near its intersection with SW Walnut Street. Lots 1 and 2 were created through an approved 3-lot partition, MLP2004-00009 (Alexander Partition). Lot 1 is a flag lot with access to SW 135 Avenue through a 15-ft easement. Lot 2 has frontage on SW 135` Avenue. Proposal Description: The applicant requests approval to adjust two (2) lot lines, which will reconfigure two (2) different lots. Lot 1 is 7,132 sq It and will become 7,615 sq ft. Lot 2 is 23,954 sq ft and will become 23,471 sq ft. The applicant desires a lot line adjustment so that the proposed new house will comply with the 10-ft side yard setback standard for flag lots. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request Section 18.410.040 - Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; An additional parcel is not created by the lot line adjustment. Two lots exist and two lots will remain. By reducing the lot size the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Reducing the size of Lot 2 will not cause either of the structures on Lot 1 or 2 to violate the site development or zoning regulations, as shown below. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: • The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; • The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; • Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and • Setbacks shall be as required by the applicable zoning district. NOTICE OF TYPE I DECISION MIIS2007-00003-POTI'S LOT LINE ADJUSTMENT PAGE 2 OF 4 • The resulting parcels comply with the dimensional standards of the R-7 zoning district, as shown below: • The average width of the building envelope area for Lot 1 will be 69 ft and for Lot 2 will be 117 ft, both of which exceed the minimum of 50 ft. • Lot 1 will be 7,615 sq ft and Lot 2 will be 23,471 sq ft, both exceeding the minimum lot size of 5,000 sq ft. • Lots 1 and 2 were created through the partition process. Lot 1 has a recorded 15-ft access easement. Lot 2 has a frontage of-117 ft both of which meet or exceed the standard. • Lot 1 will have setbacks as follows: 42-ft front, 15 and 12-ft side and 15-ft rear. Lot 2 will have setbacks as follows: 72-ft front 16.5 and 27-ft side and 90-ft rear. The minimum setbacks in the R-7 zone are 15-ft front, 5-ft side and 15-ft rear. Both garages exceed the minimum setback of 20 ft. Therefore,the resulting parcels exceed the minimum setback requirements. With regard to flag lots: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. • A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Lot 1 is a flag lot and will maintain side yard setbacks of at least 10 ft. The partition approval for MLP2004-0009 indicates that the applicant will be providing a 4-ft hedge along the proposed driveway,where it is within 10 ft of the neighboring lot. Therefore,this criterion is met. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. The partition approval for MLP2004-0009 indicated that the length of the access way would not be a fire hazard. Therefore,this criterion does not apply. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. A common drive was proposed for the purposes of the partition. A reciprocal easement ensuring access and maintenance rights has been recorded with the approved partition plat (Partition Plat No. 2006-043,Document No. 2006096648). Therefore,this criterion has been met. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. The proposed access way was approved with the partition approval, MLP2004-00009, and complies with the standards in Chapter 18.705. Exemptions from dedications: A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required. No floodplain, greenway or right-of-way dedication shall be required as a result of this lot line adjustment. Variances to development standards: An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370,Variances and Adjustments. The applicant does not request a variance. FINDING: Based on the analysis above, Staff finds that the Lot Line Adjustment criteria have been met for Lots 1 and 2. The site plan for the Lot Line Adjustment will need to show setbacks to the existing structure, but I also suggest you have a professional site your house on lot 2 just to make sure that is where the line needs to be moved. Another thing to ask your surveyor is if the access easement will need to be revised if the lot line is adjusted. That way you can have it re- recorded with the lot line adjustment. What about another possibility of moving the south lot line over 5 feet(so the west line would change from 65' to 70') and then moving the little "jog-in" east 10 feet(so the south line is 81' at it's longest point, moves north 12.84', then continues 34' to the east). Hope you're following me here...I tried to label it on the attached diagram in red. I changed the house back to 45' wide (previously drawn at 42') in the attachment. This way, I wouldn't have to apply for an adjustment to the side yard set back, would only have to do the lot line file://C:\Documents%20and%20Settings\pottsd\Local%20Settings\Temp\GW}00001.HTM 2/21/2007 Page 2 of 2 adjustment, and also would not have to do any revisions to my house. The structure must meet the setback from the property line and that corner is part of the property line. If you get the adjustment for that southern side lot line, then the setback would be 8 feet. One solution is to redesign the house. The other possible solution is to do a lot line adjustment to make the property line 8 feet from the structure and still keeping a 5 foot setback with the existing deck on the Alexander's home. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district. By reducing the lot size,the lot or structure(s)on the lot will not be in violation of the site development or zoning district regulations for that district. This criterion is satisfied. The resulting parcels are in conformity with the dimensional standards of the zoning district,including a.
