BACKGROUND INFORMATION Site Information and Proposal Description: The subject property is located at 10104 SW Lady Marion Street in the Hood View subdivision,west of SW 100th Avenue. The _ot is 0.25 acre and the existing dwelling is 4,662 square feet. The applicant proposes to build a 745 square foot accessory residential unit to house a caretaker for the main resident. The accessory unit will be within the primary unit. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Chapter 18.710 of the Tigard Development Code permits an accessory residential unit by means of a Type I procedure, providing the accessory unit complies with all of the following standards: 1. An accessory residential unit may be created within or as an addition to a detached single family dwelling. For the purposes of this chapter, "addition" means the sharing of a common wall with the primary residence. A garage may not be converted to an accessory residential unit unless it is rebuilt as part of the primary structure; The accessory residential unit will be created within a detached single-family dwelling on the basement level, as indicated by the outlined area on the site plan. Therefore,this criterion is met. 2. An accessory residential unit may not exceed 50% of the size of the primary unit, up to a maximum of 800 square feet; The proposed accessory unit is 745 square feet, making up 15% of the primary unit. Therefore,this criterion is met. 3. The number of residents permitted to inhabit the accessory residential unit is regulated by the Uniform Building Code; Number of residents is not regulated by the Uniform Building Code; however, the Tigard Municipal Code Buildings and Construction) regulates the number of residents per dwelling unit. The Municipal Code states No dwelling unit shall be permitted to be overcrowded. A dwelling unit shall be considered overcrowded i there are more residents than one plus one additional resident for every 150 square feet of floor area of the habitable rooms in the dwelling unit" (14.16.290A). Using the formula above,the proposed 745-square foot accessory residential unit may not house more than 5 residents. One resident will be living in the accessory unit. Therefore,this criterion is met. 4. Either the primary or accessory residential unit must be owner-occupied; Carolyn Brown,co-owner,will occupy the primary unit. Therefore,this criterion is met. 5. A primary residence in which an accessory residential unit has been created may have only one home occupation; The applicant does not propose a home occupation in the accessory unit. In addition to the number of parking spaces required for the primary residence, as established in Chapter 18.765, one parking space shall be provided for the accessory residential unit. This parking space shall be paved and/or covered; The applicant indicates that one parking space shall be provided for the accessory unit. The parking space will be in the back of the home, near the rear entrance on a paved surface, as indicated by the paved area on the site plan. Therefore,this criterion is met. 7. The front door of the accessory residential unit shall not be located on the front facade of the primary unit unless the door is already existing; The front door of the accessory unit will be on the rear facade of the primary unit. Therefore,this criterion is met. 8.There shall be compliance with all development standards established in the base zone. The accessory residential unit is within the primary structure,which complies with all development standards in the R-3.5 zone. Therefore,this criterion is met. FINDING: Based on the analysis above, the approval criteria for an accessory residential unit have been satisfied. SECTION V. PROCEDURE AND APPEAL INFORMATION Final Decision: A setback Adjustment is a Type I procedure. As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant,whichever occurs first.
