BACKGROUND INFORMATION Site Information: Parcels 1 (Tax Lot 3800) and 2 (Tax Lot 4000) are located at the Southeast corner of SW Cedarcrest Street and SW 74th Avenue within Tigard's Incorporated Boundary. A single-family dwelling exists on each parcel. There have not been any previous land use decisions on Parcel 1 or 2. Proposal Description: The applicant proposes to adjust one lot line, which will reconfigure two different lots. Parcel 1 is 26,564 square feet and will become 32,638 square feet; Parcel 2 is 14,433 square feet will become 8,359 square feet. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request: Section 18.410.040 - Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; Two parcels exist and two parcels will remain. Both lots will continue to exceed the minimum lot size. Therefore, no additional lots are created by this lot line adjustment and neither parcel is reduced below the minimum lot size (7,500 square feet) established by the zoning district. This criterion is met. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Parcel 1 will not be reduced and reducing the size of Parcel 2 will not cause the existing dwelling to be in violation of site development regulations or those of the R-4.5 zone. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: • The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; • The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; • Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and • Setbacks shall be as required by the applicable zoning district. NOTICE OF TYPE I DECISION MIS2006-00014-BURKE LOT LINE ADJUSTMENT PAGE 2 OF 4 1) The building envelope width of Parcel 1 is approximately 166 feet and of Parcel 2 is approximately 70 feet. Therefore,both exceed the minimum standard of 50 feet. 2) Both lots will continue to comply with the minimum lot area of the R-4.5 zone and neither lot will be a flag lot. 3) Parcels 1 and 2 will continue to have direct access to SW Cedarcrest Street. Parcel 1 will have a frontage of 70 feet and Parcel 2 will have a frontage of 166.54 feet, thereby meeting the 15-foot frontage requirement. 4) The existing dwellings on Parcels 1 and 2 remain in compliance with setback standards, as shown on the preliminary map. FINDING: Based on the analysis above, this criterion is met. With regard to flag lots: • When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. • A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Neither lot is a flag lot. Therefore, this criterion does not apply. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. The fire hydrant is located at the intersection of SW Cedarcrest Street and SW 74th Avenue and is able to serve Parcels 1 and 2 without detrimental effects to fire-fighting capabilities. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. The applicant has not proposed a common lot. Therefore, this criterion does not apply. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. Accesses to the existing dwellings have not changed and comply with current standards. The applicant has not proposed any new accesses for the purposes of this lot line adjustment. Therefore, this criterion is met. Exemptions from dedications: A lot line adjustment is not considered a development action for purposes of determining whether floodplain,greenway, or right-of-way dedication is required. This lot line adjustment is not a development action. Variances to development standards: An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370,Variances and Adjustments. The applicant does not request any variances or adjustments. Therefore, this criterion does not apply. FINDING: Based on the analysis above, Staff finds that the Lot Line Adjustment criteria have been met for Parcels 1 and 2. Approval criteria. The Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Comment: The application requests a lot line adjustment between two separate lots located at 7414 SW.Cedarcrest Avenue(1S125CA/4000) and 7412 SW Cedarcrest Avenue (1S125CA/3800). The application requests adjusting the common lot line by moving the lower half of the common lot line to form the new southern boundary of the 7414 SW Cedarcrest Avenue lot. See Sheet XX. No additional parcels will result in this • adjustment. The parcels are both located in the zoning district R 4.5, which has a minimum lot size of 7,500 sq. feet. With the adjustment,the lot at 7414 SW Cedarcrest Avenue will be 8,008. Lot 7412 SW Cedarcrest Avenue will be 26,564 sq. feet. The reduction of the western lot size will not be in violation of the site development or zoning district regulation for that district. This criterion is met. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation; c. Each lot created through the partition process shall front a public right- of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and d. Setbacks shall be as required by the applicable zoning district. Comment: The application requests a lot line adjustment of two parcels. The minimum width of the building envelope that will result will meet the lot requirement of 7,500 square feet in conformance with the applicable zoning district. The lot area of each parcel will be 8,008 and 26,564 square feet and each lot that will be created will front a public right of way by at least fifteen feet. The application complies with the minimum setbacks as found in Table 18.510.2. See Sheet 1 of 1. 1 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard,provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Comment: The application for the lot line adjustment does not propose to develop a flag lot. Therefore, this criterion is not applicable. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. Comment: There is a fire hydrant located at the intersection of SW 74th Avenue and Cedarcrest Street. The hydrant is able to serve the entire area without detrimental effects on fire-fighting capabilities. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. Comment: The application does not propose a common drive to serve more than one lot. Therefore, this criterion is not applicable. 7. Any accessway shall comply with the standards set forth in Chapter 18.705, Access, Egress, and Circulation. Comment: The applicant will comply with the standards set forth in Chapter 18.705.
