Prior to recording the lot line adjustment survey map, the accessory structure on Lot 1 shall be removed. 2. BACKGROUND INFORMATION Site Information and History: Lot 1 (Tax Lot 200) and Lot 2 (Tax Lot 101) are located on Sunrise Lane within Tigard's unincorporated Urban Service Area. An accessory structure, but no dwelling, exists on Lot 1. One single family dwelling and its accessory structures exist on Lot 2. It should be noted that the time this application was received by the City of Tigard (June 16, 2006),Lot 1 was being consolidated with a third lot (Tax Lot 100) through a separate Washington County process. On June 20, 2006, Washington County approved the consolidation of Lot 1 with Tax Lot 100 (see document in file). Tax Lot 100 is located directly south of Lot 2 and directly east of Lot 1. No structures exist on Tax Lot 100. Washington County Assessment and Taxation now identifies tax Lot 200 (Lot 1) and Tax Lot 100 as Tax Lot 100. This application has been filed with the City of Tigard prior to the date that the zoning of the properties convert back to Washington County designations (July 22, 2006). Therefore, the application is being processed according to the restrictions applicable at the time of the application. Proposal Description: The applicant proposes to adjust one (1) lot line, which will reconfigure two (2) different lots. The applicant desires to adjust the lot line separating Lots 1 and 2 to increase the size of Lot 2. Lot 1 is 2.87 acres (125,017 SF) and will become 2.85 acres (124,066 SF); Lot 2 is 0.95 acre (41,382 SF) and will become 1.42 acres (62,014 SF). In addition, the west property line of Tax lot 100 has been vacated through Washington County's consolidation process as of June 23, 2006. Lot 1 loses 0.47 acres (20,632 SF) from the lot line adjustment, but gains 0.46 acres (20,037 SF) from its consolidation with Tax Lot 100, for a total of 2.85 acres (124,066 SF). Because the consolidation of Lot 1 and Tax Lot 100 is separate from this lot line adjustment, this decision addresses Lots 1 and 2 only (and not Tax Lot 100). However, this decision includes Tax Lot 100 in calculating the resulting area of Lot 1. NOTICE OF TYPE I DECISION MIS2006-00012-CACH LOT T,TNE ADJUSTMENT PAGE 2 OF 4 SECTION IV. )PLICABLE REVIEW CRITER.AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment,request: Section 18.410.040 - Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; An additional parcel will not be created by the lot line adjustment. Two (2) lots exist and two (2) lots will remain for the purposes of this adjustment only. This criterion is met. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; As of the date of this decision, Lots 1 and 2 are in an R-7 zone, which requires a minimum lot size of 5,000 square feet. Both lots will continue to exceed the minimum lot size after the lot line adjustment and setbacks will not decrease. This criterion is met. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: • The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; • The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; • Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and • Setbacks shall be as required by the applicable zoning district. 1) No building exists on Lot 1, other than an accessory structure. However, an accessory structure is not permitted if it is not in conjunction with a principal structure on the same tax lot. Therefore, the accessory structure shall be removed prior to recording the lot line adjustment survey map. Otherwise, the resulting parcels are in conformance with the dimensional stan�ards of the zoning district. The building envelope width on Lot 2 will remain the same and is in compliance with minimum standards. 2) Lot 1 will remain a flag lot. However, there is currently no access way for Lot 1 and the resulting flag pole would be substantially wider than those of typical flag lots (110.05 feet). If an access way were created,it would not span the width of the entire flag pole. When or if an access way is created,it shall not be included in the lot area calculation. 3) No new lot has been created through the partition process. 4) The existing dwelling and accessory structures on Lot 2 comply with current setback standards. Lot 1 contains an accessory structure, which is not permitted without a principal structure and shall be removed prior to recording the survey map. With regard to flag lots: • • When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet Structures shall generally be located so as to maximize separation from existing structures. • A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. NOTICE OF TYPE I DECISION MIS2006-00012-CACH LOT LINE ADJUSTMENT PAGE 3 OF 4 While Lot 1 will become aS lot, the flag pole will be 110.05 feet and the lot will not be used for home construction. Rather,it will become part of a reservoir site,which will include the two immediate tax lots to the south (WCTM 2S105DC, Tax Lots 300 and 400). Currently, only one accessory structure exists on Lot 1 and this accessory structure shall be removed. No new access way or paved drive will result from this lot line adjustment. Therefore, this criterion is met. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. The applicant does not propose to change any access ways. Therefore, this criterion does not apply. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. A common drive has not been proposed or shown to be necessary at this time. Therefore, this criterion does not apply. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. A new access way has not been proposed or shown to be necessary at this time. No residents or principal structures exist on Lot 1. Therefore,this criterion does not apply. Exemptions from dedications: A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required. This lot line adjustment is not a development action. Variances to development standards: An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370,Variances and Adjustments. The applicant has not applied for a variance. FINDING: Based on the analysis above, staff finds that the Lot Line Adjustment criteria have been met for Lot 1 and Lot 2. Final Decision: A Lot Line Adjustment is a Type I procedure. As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant,whichever occurs first. Lot 2 (Tax Lot 101) are located on Sunrise Lane within Tigard's unincorporated Urban Service Area. An accessory structure, but no dwelling, exists on Lot 1. One single family dwelling and its accessory structures exist on Lot 2. It should be noted that the time this application was received by the City of Tigard (June 16, 2006), Lot 1 was being consolidated with a third lot (Tax Lot 100) through a separate Washington County process. On June 20, 2006, Washington County approved the consolidation of Lot 1 with Tax Lot 100 (see document in file): Tax Lot 100 is located directly south of Lot 2 and directly east of Lot 1. No structures exist on Tax Lot 100. Washington County Assessment and Taxation now identifies tax Lot 200 (Lot 1) and Tax Lot 100 as Tax Lot 100. The applicant desires to adjust the lot line separating Lots 1 and 2 to increase the size of Lot 2. Lot 1 is 2.87 acres (125,017 SF) and will become 2.85 acres (124,066 SF); Lot 2 is 0.95 acre (41,382 SF) and will become 1.42 acres (62,014 SF). In addition, the west property line of Tax lot 100 has been vacated through Washington County's consolidation process as of June 23, 2006. Lot 1 loses 0.47 acres (20,632 SF) from the lot line adjustment, but gains 0.46 acres (20,037 SF) from its consolidation with Tax Lot 100, for a total of 2.85 acres (124,066 SF). Because the consolidation of Lot 1 and Tax Lot 100 is separate from this lot line adjustment, this decision addresses Lots 1 and 2 only (and not Tax Lot 100). However, this decision includes Tax Lot 100 in calculating the resulting area of Lot 1. NOTICE OF TYPE I DECISION MIS2006-00012-CACH LOT LINE ADJUSTMENT PAGE 2 OF 4 SECTION IV. APPLICABLE REVIEW CRITEROPAND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request: Section 18.410.040 - Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; An additional parcel will not be created by the lot line adjustment. Two (2) lots exist and two (2) lots will remain for the purposes of this adjustment only. This criterion is met. By reducing the lot size the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; • As of the date of this decision, Lots 1 and 2 are in an R-7 zone, which requires a minimum lot size of 5,000 square feet. Both lots will continue to exceed the minimum lot size after the lot line adjustment and setbacks will not decrease. This criterion is met. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: • The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; • The lot area shall be as required by the applicable zoning district. In the case of a flag lot,the access way may not be included in the lot area calculation; • Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and • Setbacks shall be as required by the applicable zoning district. 1) No building exists on Lot 1, other than an accessory structure. However, an accessory structure is not permitted if it is not in conjunction with a principal structure on the same tax lot. Therefore, the accessory structure shall be removed prior to recording the lot line adjustment survey map. Otherwise, the resulting parcels are in conformance with the dimensional standards of the zoning district. The building envelope width on Lot 2 will remain the same and is in compliance with minimum standards. 2) Lot 1 will remain a flag lot. However, there is currently no access way for Lot 1 and the resulting flag pole would be substantially wider than those of typical flag lots (110.05 feet). If an access way were created, it would not span the width of the entire flag pole. When or if an access way is created, it shall not be included in the lot area calculation. 3) No new lot has been created through the partition process. 4) The existing dwelling and accessory structures on Lot 2 comply with current setback standards. Lot 1 contains an accessory structure, which is not permitted without a principal structure and shall be removed prior to recording the survey map. With regard to flag lots: • When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. • A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Rather,it will become part of a reservoir site,which will include the two immediate tax lots to the south (WCTM 2S105DC, Tax Lots 300 and 400). Currently, only one accessory structure exists on Lot 1 and this accessory structure shall be removed. No new access way or paved drive will result from this lot line adjustment. Therefore, this criterion is met. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. The applicant does not propose to change any access ways. Therefore, this criterion does not apply. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. A common drive has not been proposed or shown to be necessary at this time. Therefore, this criterion does not apply. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. A new access way has not been proposed or shown to be necessary at this time. No residents or principal structures exist on Lot 1. Therefore, this criterion does not apply. Exemptions from dedications: A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required. This lot line adjustment is not a development action. Variances to development standards: An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370,Variances and Adjustments. The applicant has not applied for a variance. FINDING: Based on the analysis above, staff finds that the Lot Line Adjustment criteria have been met for Lot 1 and Lot 2. Final Decision: A Lot Line Adjustment is a Type I procedure. As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant,whichever occurs first. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot,the accessway may not be included in the lot area calculation; c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and d. Setbacks shall be as required by the applicable zoning district. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. 7. Any accessway shall comply with the standards set forth in Chapter 18.705, Access, Egress, and Circulation. B. Exemptions from dedications. A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required C. Variances to development standards.
