COMPREHENSIVE PLAN DESIGNATION: Medium-Density Residential. ZONING DESIGNATION: R-7: Medium-Density Residential. R-7: Medium-Density Residential District. The R-7 zoning district is designed to accommodate attached single-family homes, detached single-family homes with or without accessory residential units, at a minimum lot size of 5,000 square feet, and duplexes, at a minimum lot size of 10,000 square feet. Mobile home parks and subdivisions are also permitted outright. Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.390, 18.410 and 18.510. SECTION II. Prior to recording, a Lot Line Adjustment survey map and legal descriptions showing the existing and proposed lot lines shall be reviewed and approved by the Engineering Department. 2. The applicant shall record an access easement, minimum 15 feet in width to serve Tract 2, until such time that improved and dedicated right of way fronts this tract. This access may extinguish once private or public street frontage is available. The applicant shall further note that the 15 foot wide easement is only adequate to serve a maximum of 2 dwelling units. 3. If the access easement is located within 10 feet of an abutting lot of record, then a landscape plan shall be submitted along with the lot line adjustment survey showing a screen along the length of the easement that falls within 10 feet of the adjoining lot(s). This screen shall be provided upon construction of the driveway serving Tract 2. 4. Following recording, the applicant shall provide evidence to the City that the Lot Line Adjustment survey map was recorded within 18 months of this decision. 5. Prior to issuance of a building permit on Tract 2, the applicant shall consult with Tualatin Valley Fire & Rescue (TVF&R) regarding the need for a fire hydrant. If a hydrant is deemed necessary the applicant shall bear the responsibility and cost of installing the hydrant. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject tracts are located on the south side of SW Bull Mountain Road just east of the intersection at SW 133` Avenue in the area where the proposed Alberta Rider Elementary School was approved. On the site is a life estate area and residential buildings reserved for Ms. Alberta Rider, which will be included in the reconfigured Tract number 1 along with the new school buildings. Tract number 2 is vacant. When reconfigured, Tract number 2 will encompass an area determined to be surplus land and was presented as such during the initial Conditional Use Permit application. This surplus land will likely be conveyed to a third. party for subsequent development. It is also noted that Tract number 2 is presently adjoining city limits and was required to be included in annexation as part of the School's approval. Following the lot line adjustment, the area will no longer be adjoining current city boundaries (but may soon be as part of a pending annexation effort of Arbor Summit No. 1 and 2, casefile number ZCA2004-00001). A previous approval (casefile number CUP2003-00012) affects both these parcels. Future development of the properties that are subject of this application will be required to be consistent with those previous conditions, as determined to be still relevant. This includes, most notably, the requirement for annexation of the parcels prior to final building inspection occurring on the school building (as it was not a land division, annexation was not tied to plat approval). There is a possibility that Tract number 2 may be submitted for subdivision approval before the school is constructed and before the adjoining property has been annexed. In this case, the subdivision (or other development) may be delayed until the property is eligible for annexation (either through adjoining annexations occurring, or completion of the school and subsequent Tract number 1 annexing). NOTICE OF TYPE I DECISION PAGE 2 OF 5 MIS2004-00018-ALBERTA RIDER LOT LINE ADJUSTMENT . • • Proposal Description: The applicant is proposing to adjust one (1) property line, which will reconfigure two (2) different lots. The adjustment is in preparation to convey surplus property for the Alberta Rider School Site to a third party for subsequent development. Tract #2 will be conveying 2.64 acres to Tract#1. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request: Section 18.410.040 - Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional.parcel is not created by the lot line adjustment, and the existing parcel 1 reduced in size by the adjustments is not reduced below-the minimum-lot size established by the zoning district; No additional_parcels will be created. Both tracts have not been reduced below the minimum lot size of 5,000 sq. feet (approximately 0.11 acres) as required for (R-7) zoning, tract 1 will be 9.97 acres and tract 2 will be 0.74 acres. Therefore, this criterion is met. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; The resulting lot sizes will remain above the minimum required in the R-7 zone. Tract 2 will not have frontage on a public or private street but will be required to maintain an easement for access until physical street frontage is provided with the platting of Arbor Summit Number 2. There are no structures on Tract number 2, and the proposed school has been planned so that it will not encroach into the required 20 foot setback on this side. Therefore, this criterion is met. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: • The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; • The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; • Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement; and • Setbacks shall be as required blithe applicable zoning district. As described previously, both tracts will continue to meet the minimum standards of the R-7 zone. The minimum lot width is the R-7 zone is 50 feet for single-family units. Tract 1 contains both a single family residence as well as a future school. The width of this tract is 322 feet. Tract 2 will have approximately 274 feet of width. Tract 1 will continue to front SW Bull Mountain Road, and as discussed previously, Tract 2 will be required to have a legally recorded access easement through Tract 1 until physical street frontage (in the form of improved and dedicated right of way) is available. Also, as previously discussed, all setback requirements are met by this lot line adjustment. With the following condition, this criterion is satisfied: NOTICE OF TYPE I DECISION PAGE 3 OF 5 MIS200400018-ALBERTA RIDER LOT LINE ADJUSTMENT , • • .� CONDITION:The applicant shall record an access easement, minimum 15 feet in width to serve Tract 2, until such time that improved and dedicated right of way fronts the subject tract. This access may extinguish once private or public street frontage is available. The applicant shall further note that the 15 foot wide easement is only suitable for serving 1-2 dwelling units. With regard to flag lots: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also 'be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Tract 2 is an exi Ling land -locked lot Mat will be considered aflag -lor for future development purposes. Until the access easement is recorded and the driveway is constructed it is not known whether this will be within 10 feet of a lot of record. Therefore, this criterion is met by the following condition: CONDITION: If the access easement is located within 10 feet of an abutting lot of record, then a landscape plan shall be submitted along with the lot line adjustment survey showing a screen along the length of the easement that falls within 10 feet of the adjoining lot. This screen shall be provided upon construction of the driveway in the easement serving Tract 2. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. This standard will be reviewed at time of building permit application, and a new fire hydrant may be required if deemed necessary by the fire district. Therefore, this standard is met with the following condition: CONDITION:Prior to issuance of a building permit on Tract 2, the applicant shall consult with TVF&R regarding the need for a fire hydrant. If a hydrant is deemed necessary the applicant shall bear the responsibility and cost of installing the hydrant. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. No common drive is proposed as part of this lot line adjustment. However, Bull Mountain Road is a collector and has limited access. No additional access will be permitted onto SW Diull Mountain Road. The applicant may provide the easement from the dedicated 1 32nu Terrace separately or jointly through the school's access onto this street. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. The required access easement shall be a minimum of 15 feet in width. If more intensive development is proposed on Tract 2 prior to the availability of dedicated and improved frontage, a full street shall be required to serve that parcel. Floodplain, greenway and right-of-way dedications are not required as part of this application. Therefore, this statement is met. Variances to development standards: An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370, Variances and Adjustments. The applicant has not requested a variance or an adjustment with this application. FINDING: Based on the analysis above, Staff finds that the Lot Line Adjustment criteria have been met. SECTION V. The R-7 zoning district is designed to accommodate attached single-family homes, detached single-family homes with or without accessory residential units, at a minimum lot size of 5,000 square feet, and duplexes, at a minimum lot size of 10,000 square feet. The findings and conclusions on which the decision is based are noted in Section IV. NOTICE OF TYPE I DECISION PAGE 1 OF 5 MIS2004-00018—ALBERTA RIDER LOT LINE ADJUSTMENT • • CONDITIONS OF APPROVAL PRIOR TO THE RECORDING OF THE LOT LINE ADJUSTMENT, THE FOLLOWING' CONDITIONS SHALL BE SATISFIED: UNLESS OTHERWISE NOTED, THE STAFF, CONTACT SHALL BE MORGAN TRACY IN THE PLANNING DIVISION AT 503-639-4171. 1. Prior to recording, a Lot Line Adjustment survey map and legal descriptions showing the existing and proposed lot lines shall be reviewed and approved by the Engineering Department. 2. The applicant shall record an access easement, minimum 15 feet in width to serve Tract 2, until such time that improved and dedicated right of way fronts this tract. This access may extinguish once private or public street frontage is available. The applicant shall further note that the 15 foot wide easement is only adequate to serve a maximum of 2 dwelling units. 3. If the access easement is located within 10 feet of an abutting lot of record, then a landscape plan shall be submitted along with the lot line adjustment survey showing a screen along the length of the easement that falls within 10 feet of the adjoining lot(s). This screen shall be provided upon construction of the driveway serving Tract 2. 4. Following recording, the applicant shall provide evidence to the City that the Lot Line Adjustment survey map was recorded within 18 months of this decision. 5. Prior to issuance of a building permit on Tract 2, the applicant shall consult with Tualatin Valley Fire & Rescue (TVF&R) regarding the need for a fire hydrant. If a hydrant is deemed necessary the applicant shall bear the responsibility and cost of installing the hydrant. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject tracts are located on the south side of SW Bull Mountain Road just east of the intersection at SW 133 Avenue in the area where the proposed Alberta Rider Elementary School was approved. On the site is a life estate area and residential buildings reserved for Ms. Alberta Rider, which will be included in the reconfigured Tract number 1 along with the new school buildings. Tract number 2 is vacant. When reconfigured, Tract number 2 will encompass an area determined to be surplus land and was presented as such during the initial Conditional Use Permit application. This surplus land will likely be conveyed to a third, party for subsequent development. It is also noted that Tract number 2 is presently adjoining city limits and was required to be included in annexation as part of the School's approval. Following the lot line adjustment, the area will no longer be adjoining current city boundaries (but may soon be as part of a pending annexation effort of Arbor Summit No. 1 and 2, casefile number ZCA2004-00001). A previous approval (casefile number CUP2003-00012) affects both these parcels. Future development of the properties that are subject of this application will be required to be consistent with those previous conditions, as determined to be still relevant. This includes, most notably, the requirement for annexation of the parcels prior to final building inspection occurring on the school building (as it was not a land division, annexation was not tied to plat approval). There is a possibility that Tract number 2 may be submitted for subdivision approval before the school is constructed and before the adjoining property has been annexed. In this case, the subdivision (or other development) may be delayed until the property is eligible for annexation (either through adjoining annexations occurring, or completion of the school and subsequent Tract number 1 annexing). NOTICE OF TYPE I DECISION PAGE 2 OF 5 MIS2004-00018-ALBERTA RIDER LOT LINE ADJUSTMENT • • Proposal Description: The applicant is proposing to adjust one (1) property line, which will reconfigure two (2) different lots. The adjustment is in preparation to convey surplus property for the Alberta Rider School Site to a third party for subsequent development. Tract #2 will be conveying 2.64 acres to Tract #1. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request: Section 18.410.040 - Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No additional parcels will be created. Both tracts have not been reduced below the minimum lot size of 5,000 sq. feet (approximately 0.11 acres) as required for (R-7) zoning, tract 1 will be 9.97 acres and tract 2 will be 0.74 acres. Therefore, this criterion is met. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; The resulting lot sizes will remain above the minimum required in the R-7 zone. Tract 2 will not have frontage on a public or private street but will be required to maintain an easement for access until physical street frontage is provided with the platting of Arbor Summit Number 2. There are no structures on Tract number 2, and the proposed school has been planned so that it will not encroach into the required 20 foot setback on this side. Therefore, this criterion is met. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: • The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; • The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; • Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement; and • Setbacks shall be as required blithe applicable zoning district. As described previously, both tracts will continue to meet the minimum standards of the R-7 zone. The minimum lot width is the R-7 zone is 50 feet for single-family units. Tract 1 contains both a single family residence as well as a future school. The width of this tract is 322 feet. Tract 2 will have approximately 274 feet of width. Tract 1 will continue to front SW Bull Mountain Road, and as discussed previously, Tract 2 will be required to have a legally recorded access easement through Tract 1 until physical street frontage (in the form of improved and dedicated right of way) is available. Also, as previously discussed, all setback requirements are met by this lot line adjustment. This access may extinguish once private or public street frontage is available. The applicant shall further note that the 15 foot wide easement is only suitable for serving 1-2 dwelling units. With regard to flag lots: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Tract 2 is an existing land locked lot that will be considered a flag lot for future development purposes. Until the access easement is recorded and the driveway is constructed it is not known whether this will be within 10 feet of a lot of record. Therefore , this criterion is met by the following condition: CONDITION:If the access easement is located within 10 feet of an abutting lot of record, then a landscape plan shall be submitted along with the lot line adjustment survey showing,a screen along the length of the easement that falls within 10 feet of the adjoining lot. This screen shall be provided upon construction of the driveway in the easement serving Tract 2. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. This standard will be reviewed at time of building permit application, and a new fire hydrant may be required if deemed necessary by the fire district. Therefore, this standard is met with the following condition: CONDITION:Prior to issuance of a building permit on Tract 2, the applicant shall consult with TVF&R regarding the need for a fire hydrant. If a hydrant is deemed necessary the applicant shall bear the responsibility and cost of installing the hydrant. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. No common drive is proposed as part of this lot line adjustment. However, Bull Mountain Road is a collector and has limited access. No additional access will be permitted onto SW Bull Mountain Road. The applicant may provide the easement from the dedicated 132nu Terrace separately or jointly through the school's access onto this street. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. The required access easement shall be a minimum of 15 feet in width. If more intensive development is proposed on Tract 2 prior to the availability of dedicated and improved frontage, a full street shall be required to serve that parcel. Floodplain, greenway and right-of-way dedications are not required as part of this application. Therefore, this statement is met. Variances to development standards: An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370, Variances and Adjustments. SUBJECT SITE AND ABUTTING PROPERTY INFORMATION SUBJECT SITE The subject property contains approximately 10.71 acres located on the south side of SW Bull Mountain Road, in the R-7 (Residential—5,000 SF) zone. It is comprised of Tax Lots 2S 1 09AC, #2100 and 2S 1 09AD, #1300, as owned by Tigard-Tualatin School District 23J. The subject property has recently received City approval for construction of an elementary school; refer to CUP 2003-00012. CHAPTER 18.410 LOT LINE ADJUSTMENTS SECTION 18.410.010 PURPOSE The purpose of this chapter is to provide rules, regulations and criteria governing approval of lot line adjustments. SECTION 18.410.020 APPROVAL PROCESS A. Decision-making process. Lot line adjustments shall be reviewed by means of a Type I procedure, as governed by Chapter 18.390, using approval criteria contained in Section 18.410.040. B. Time limit on approval. The lot line adjustment approval by the Director shall be effective for a period of 1-1/2 years from the date of approval. C. Lapsing of approval. The lot line adjustment approval by the Director shall lapse if 1. The lot line adjustment has been improperly recorded with Washington County without the satisfactory completion of all conditions attached to the approval; or 2. The final recording is a departure from the approved plan. D. Extension. The Director shall, upon written request by the applicant and payment of the required fee, grant an extension of the approval period not to exceed one year provided that: 1. No changes are made on the original plan as approved by the Director; 2. The applicant can show intent of recording the approved partition or lot line adjustment within the one year extension period; and 3. There have been no changes in the applicable Comprehensive Plan policies and ordinance provisions on which the approval was based. Response: The preceding is guidance for the City and therefore does not require a response. SECTION 18.410.030 APPLICATION SUBMISSION REQUIREMENTS A. General submission requirements. All applications shall be made on forms provided by the Director and shall include information required for a Type I application, as governed by Chapter 18.390. B. Specific submission requirements. All applications shall include the preliminary lot line map and necessary data or narrative, detailed information for which shall be obtained from the Director. Response: A copy of the required forms for this Type I lot line adjustment application have been included as Exhibit A. This application addresses the applicable requirements for approval of a lot line adjustment in the City of Tigard Community Development Code. The Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; Response: The subject property contains approximately 10.71 acres located on the south side of SW Bull Mountain Road, in the R-7 (Residential—5,000 SF) zone. It is comprised of Tax Lots 2S 1 09AC, #2100 and 2S 1 09AD, #1300, as owned by Tigard- Tualatin School District 23J. The proposal is to essentially carve out a 0.74 acre lot which is intended to be sold to the developers of an adjacent subdivision. The proposed lot line adjustment, as shown on the Preliminary Record of Survey, does not create an additional parcel. After the proposed adjustment is approved, the subject tax lots will have the following areas: • Adjusted, Tax Lot 2S 1 09AD, #1300 is proposed as 0.74 acres; • Adjusted, Tax Lot 2S 1 09AC, #2100 is proposed as 9.97 acres; The minimum proposed lot size in the R-7 zone is 5,000 square feet. As shown above, each of the proposed lot line adjustment will result in parcels that exceed the required minimum lot size. This criterion is satisfied. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Response: The proposed lot line adjustment will not create lots that are in violation of the site development or zoning district regulations for the R-7 district. The existing structures located on-site are not located in close proximity to the adjusted lot lines nor will they encroach in the required setbacks. This criterion is satisfied. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; Response: The average minimum lot width for detached units in the R-7 zone is 50 feet, per Table 18.510.2, Development Standards in Residential Zones, City of Tigard Development Code. The proposal is for a lot width of approximately 122.50 feet, which exceeds the minimum requirements. This criterion is therefore satisfied. Access to the proposed tax lot 1300 will be by means of new public right-of-way in conjunction with the subsequent development of the adjacent subdivision plat. This criterion is satisfied. c. All proposed setbacks, exceed the minimum requirements. This criterion is therefore satisfied. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard,provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Response: Again, access to the proposed tax lot 1300 will be by means of new public right-of-way in conjunction with the subsequent development of the adjacent subdivision plat. This criterion is satisfied. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. Response: As a part of the School Site Development and in conjunction with the subsequent development of the adjacent subdivision plat, effective fire hydrant services are proposed. This criterion is therefore satisfied. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. Response: As discussed above, independent access will be created for each lot. This criterion is therefore satisfied. 7. Any accessway shall comply with the standards set forth in Chapter 18.705, Access, Egress, and Circulation. Response: As discussed above, independent access will be created for each lot. Both lots will have access to public streets that are designed to meet the standards in Chapter 18.705 of the City of Tigard Development Code. B. Exemptions from dedications. Response: The subject property is not located within the floodplain or a greenway. Right-of-way dedication is not a part of this proposal. As appropriate, right-of-way dedications will be made to the City as part of recording for the subdivision plat to the east and by separate dedication deed for the westerly access. This criterion is satisfied. C. Variances to development standards. An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370, Variances and Adjustments. Response: No variance from the development standards is being requested with this application (refer to prior Conditional Use approval, CUP 2003-00012); therefore this standard does not apply. SECTION 18.410.050 RECORDING LOT LINE ADJUSTMENTS A. Recording requirements. Upon the Director's approval of the proposed lot line adjustment, the applicant shall record the lot line adjustment with Washington County and submit a copy of the recorded survey map to the City, to be incorporated into the record. B. Time limit. The applicant shall submit the copy of the recorded lot line adjustment survey map to the City within 15 days of recording and shall be completed prior to the issuance of any building permits on the re-configured lots. Response: Following approval of the proposed lot line adjustment, a copy of the survey map will be recorded with Washington County and a copy will be submitted to the City within 15 days of recording. This requirement is satisfied.
