SECTION III. BACKGROUND INFORMATION , Site Information: The subject tracts are located on the east side of SW Hall, west of Highway 217, and just north of Pacific Highway. There is an apartment complex on Tract" 2, and an existing single family home is present on Tract 1 Proposal Description: • The applicant is proposing to adjust one (1) property line, which will reconfigure two (2) different lots. The intention is to widen the "flag pole" that serves the existing single family home from .15 to 30 feet. This is a necessary precursor to enable development of the parcel. While 15 feet is adequate for 1-2 single family residences, 20 feet is the minimum for 3-6 units, and any additional development would require a minimum of 30 feet access. The area of the increased access width will be offset by a portion of land that is directly adjacent to the apartment building. The property's current configuration prevents the owners of the apartment to grade the land away from the foundation of the building which is presently creating maintenance problems. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request: Section 18.410.040 - Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No additional parcels will be created. Both tracts have not been reduced below the minimum lot size of 3,050 sq. feet as required for (R-12) zoning, Tract 1 will be 32,224 sq. • feet, while Tract 2 will be 19,114 square feet. Therefore, this criterion is met. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; • The resulting lot sizes will remain above the minimum required in the R-12 zone. The adjusted lot line will place the side property line further away from the existing structure on tract 1. The apartment on Tract 1 has.10 units, and is non conforming with respect to density. However, more area will be added to the multifamily parcel, so the non conformity is being decreased by the proposal. The other parcel has a single family house on an oversized parcel. Subsequent development will be reviewed with a future application. Therefore, this criterion is met. NOTICE OF TYPE I DECISION PAGE 2 OF 4 MIS2004-00017-CHRISTIE LOT LINE ADJUSTMENT • • • • The resulting parcels are in conformity with the dimensional standards of the zoning district, including: • The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; • The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; • Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and • Setbacks shall be as required by the applicable zoning district. There are no minimum lot width requirements in the R-12 zone. Both lots exceed the minimum lot size (however Tract 1 is below the minimum size required for 10 units, but is a previous non conforming situation that will be lessened by this request). Tract 2 will be a total of 19,114 feet including the accessway, and approximately 14,674 square feet excluding the access area. Setbacks are not negatively affected by this request. This criterion is satisfied. With regard to flag lots: • When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. • A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Tract 1 is not a flag lot. Tract 2 is a flag lot; however, no development is being proposed with this application, and the flag previously existed. This access is within 10 feet of the parcel to the south, and Tract 1. The southern parcel has some screening in place, and Tract 2 is a part of this application request. No additional screening is deemed necessary as part of this proposal, but may be required with subsequent development. This criterion is met. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. This standard will be reviewed at time of building permit application, and a new fire hydrant may be required if deemed necessary by the fire district. The length of the accessway is not being affected and moreover, the wider access width will facilitate fire fighting capabilities. Therefore, this standard is met. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. No common drives are proposed. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. The existing access is adequate for the uses on site. Future development of Tract 2 may require consolidation of access with Tract 1 as determined by ODOT, based on the increased trip generation and street spacing standards on Hall Boulevard. Exemptions from dedications: A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required.
