BACKGROUND INFORMATION Site Information: The subject parcel is located on the west side of Highway 217 and the east side of SW 95th Avenue. Proposal Description: The applicant has requested Lot Line Adjustment approval. No development is proposed at this time. The proposed adjustment will take the north property line of Tax Lot 02400 and move it 100 feet south to add 9,180 square feet to Tax Lot 02500, thus enlarging Tax Lot 02500 to 32,267 square feet. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT -APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request: Section 18.410.040 - Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No new lots will be created as part of this adjustment; two (2) lots exist and two (2) lots will remain after the proposed adjustment. The minimum lot size for the R-12 zone 3,050 square feet. In any event, the lots will be 10,422 and 32,267 square feet after the adjustment. Therefore, this standard is satisfied. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Reducing the size of the smaller lot and increasing the size of the larger lot will not create a violation of the development or zoning district regulations for either building. NOTICE OF TYPE I DECISION MIS2000-00005-ABRAMS LOT LINE ADJUSTMENT PAGE 2 OF 4 • • • The resulting parcels are in conformity with the dimensional standards of the zoning district, including: • The minimum width Of the building envelope area shall meet the lot requirement of the applicable zoning district; • The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; • Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and • . Setbacks shall be as required by the applicable zoning district. The minimum lot size for the R-12 zone is 3,050 square feet. The smaller of the two lots is 10,422 square feet. No flag lot will result from this application, each lot has frontage onto a public street and each lot has at least one access that is at least 15 feet wide. As a result of this application, no buildings will be in violation of the minimum setbacks of the R-12 zone. With regard to flag lots: • When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. • A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Neither lot will be a flag lot; therefore, this standard does not apply. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. No change to the existing access is proposed as part of this Lot Line Adjustment. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. A common drive is not proposed; therefore, this criterion does not apply. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. Lot 02400 has access to SW Longstaff Street and Tax Lot 02500 has access onto SW 95th Avenue. Therefore, this standard is met. Floodplain, greenway or right-of-way dedication is not an issue with this application. Therefore, this standard does not apply. Variances to development standards: An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370, Variances and Adjustments. The applicant has not requested a variance or an adjustment with this application. FINDING: Based on the analysis above, staff finds that the Lot Line Adjustment criteria have been met. SECTION V. Approval of this request will solve a longstanding dispute between the owner of Tax Lot 2400 (Bozich) and the owner of the surrounding property(Abrams) over access. Mr. Abrams as made an offer to purchase the property of the Bozich Estate, subject to this request. Enclosed is the purchase agreement outlining this agreement. Mr. Abrams has made claims for access to Tax Lots 4600, 4700, and 100 by way of Longstaff Street. Longstaff is not recognized as a public street by the City of Tigard, and no other public access is available to these Tax Lots. For several years,Mr. Abrams has attempted to negotiate access with Mrs. Bozich, to no avail. She passed away last year, and her sons have agreed to sell the property to Mr. Abrams. By granting this lot line adjustment,Mr. Abrams can access these Tax Lots through Tax Lot 2500, or complete negotiations with Mrs. Anderson, the owner of Tax Lot 1700, for access along Longstaff St. In either case, the existing residence on Tax Lot 2400 can be retained. The sturcture located on Tax Lot 2500 is not habitable due to falling tree damage, and will be removed with redevelopment. Please call me if you have any questions. To the extent of any conflict in the terms of this Exhibit I and any other terms the terms of this Exhibit 1 shall prevail. I. Seller will cooperate with purchaser in the Seller's application for a lot fine adjustment/partition of the subject property and will sign documents as required by • government agencies to accomplish the lot line adjustment/partition. Estate of Merin Ro/ich.Washington County Circuit Court Case No. C990202CV, ("Action') shall be dismissed without prejudice and without attorney fees or costs for or against any party. 6. RELEASES AND tNDEMNITY. Conditioned upon the closing of this transaction, Seller, Abeco Corporation and Purchaser hereby fully and finally waive, release and discharge the claims and counterclaims pled in the Action and all claims know or unknown then existing or arising at any time in the future related to Property. If this transaction does not close then all claims and counterclaims subject to this condition are expressly reserved. To the fullest extent permitted by law,Purchaser agrees to defend,indemnify and hold the Seller harmless from any and all claims related to the Property. 7. PROPERTY. The Purchaser understands end agrees that the claims and counterclaims•pled in the Action("Action's Claims)are permitted exceptions to any deed to the Property and the any title policy related to this Agreement may except such claims and counterclaims as well as provided other exceptions arising therefrom as well as except any warranty of access to the Property. .8. SEVERABILITY Nothing contained herein shall be construed so as to require the commission of any act contrary to law, and wherever there is any conflict between any provisions contained herein and any present or future statue,law,ordinance or regulation contrary to which • the parties have no legal right to contract, the latter shall prevail; but the provision of this Agreement which is effected shall be curtailed and limited only to the extent necessary to bring it within the requirements of the law. 9. MODIFICATION OR AMENDMENTS No amendment, change or modification or this Agreement shall be valid, unless in writing and signed by all the parties hereto. 10.
