BACKGROUND INFORMATION Site Information and Proposal Description: The subject parcel is Lot 19 of the Kessler Estates Subdivision (SUB2003-00013), located between SW Home Street on the south and Templeton Elementary School on the north. The subject parcel is 7,894 square feet in size. The proposal is to reduce the standard 20-foot front yard setback to 16 feet to accommodate an expanded deck to afford a view of Mt. Hood. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Tigard Development Code Section 18.370.020 allows the following development Adjustments by means of a Type I procedure: Front yard setbacks. Up to a 25% reduction of the dimensional standards for the front yard setback required in the base zone. Setback of garages may not be reduced by this provision. The applicant has requested an Adjustment to the front yard setback to accommodate an expanded deck that affords a view of Mt. Hood. The required setback is 20 feet.Provided the following criteria are met, a 4-foot reduction of this setback may be allowed because it reduces the setback by 20 percent,which is the less than the maximum allowed for front yard setbacks. The existing dwelling includes a garage which is approximately 30 feet from the front property line, as shown in the applicant's site plan. Interior setbacks. Up to a 20% reduction of the dimensional standards for the side and rear yard setbacks required in the base zone. Lot coverage. Up to 5% increase of the maximum lot coverage required in the base zone. A development Adjustment shall be granted if there is a demonstration of compliance with all of the applicable standards: A demonstration that the Adjustment requested is the least required to achieve the desired effect; The adjustment is being requested to allow a four-foot deck extension (4 feet by 18 feet = 72 square feet) to afford a view. The information submitted by the applicant shows that the proposed setback reduction would be the minimum necessary to achieve the desired effect. The proposed adjustment request is in compliance with this standard. The Adjustment will result in the preservation of trees, if trees are present in the development area; There are no trees present in the development area. Therefore,this standard does not apply. Therefore, the adjustment will not adversely affect emergency access to the subject dwelling or adjacent dwellings, consistent with this standard. There is not a reasonable alternative to the Adjustment which achieves the desired affect. The applicant proposes to capture a view of Mt. Hood from the front deck. Therefore, there is no reasonable alternative to the proposed adjustment. FINDING: Based on the analysis above,the adjustment standards have been satisfied. SECTION V. PROCEDURE AND APPEAL INFORMATION Notice: Notice was mailed to the applicant and owners. Final Decision: A setback Adjustment is a Type I procedure. As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant, whichever occurs first. The Director's decision may not be appealed locally and is the final decision of the City. The purpose for the addition is to achieve a view of Mt.Hood. The deck will remain similar in design to the original deck,just extended to the south. Per 18.370.020.B.1.a,it is requested that the existing front yard setback of 20 ft.be reduced by 25%,to 16 ft. This will provide a view of Mt.Hood,which is not currently available for this residence. Per 18.370.020.2.b,no trees will be removed to achieve the desired effect. Per 18.370.020.3.c,no changes to emergency access will be changed with this proposal,as the deck will largely remain similar to the original deck,just extended to the south. Per 18.370.020.3.d,no other reasonable alternative exists to achieve the desired effect. The only other potential alternatives involve major renovations and remodeling to the residence.
