BACKGROUND INFORMATION Site History: Both properties are part of the Tigard Towne Square shopping center, which was approved under SDR 87-05. There were additional applications associated with the original SDR approval including M87-02, V87-05 and SL87-02. The site of the existing Albertson's recently received SDR approval (SDR 98-0018) for a major modification to increase the retail space. A condition of approval of that decision was this lot line adjustment. No other land use actions, other than temporary use approvals, were found to have been filed with the City of Tigard. Vicinity Information: To the south of the development site is property zoned R-4.5. To the east of the development site is property zoned R-25 and to the north is property zoned R-25 and C-G. Pacific Highway is to the west with King City across the street. Site Information and Proposal Description: WCTM 2S115BA, Tax lot 00100 is currently developed with the Albertson's Store. WCTM 2S115AB, Tax lot 01900 is developed with additional retail space. The purpose of this adjustment is to move the lot line to allow the Albertson's Store and the area of expansion approved by SDR 98-0018 to be on one tax lot. The adjustment will result in tax lot 100 being increased by .5 acres and tax lot 1900 being decreased by that same amount. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request: 18.410.040 - Approval Criteria. The Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No new lots will be created as part of this adjustment. There is no minimum parcel size in the C-G zone. NOTICE OF DECISION MIS 99-0001-ALBERTSON'S LOT LINE ADJUSTMENT PAGE 2 OF 4 • • By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; The C-G zone allows zero lot lines for the interior setbacks. The only lot line being adjusted is an interior side yard setback, therefore, this criterion has been satisfied. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation; c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and d. Setbacks shall be as required by the applicable zoning district. The resulting parcels will continue to be in conformity with a-d above. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.745.040. Screening may. also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Neither lot is a flag lot, therefore, this standard does not apply. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. Accessways are not being created or altered,therefore, this standard does not apply. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. Based on the plans provided, it appears numerous access easements already exist and are not being altered. Both lots will continue to have frontage. Any accessway shall comply with the standards set forth in Chapter 18.705, Access, Egress, and Circulation.
