Staff has reviewed the application and narrative and finds that, based on this information, the Tree Removal permit may be approved. Highlands #3). This site is located in the western portion of Tigard on the north edge of SW Bull Mountain Road, east of SW 129th Avenue. Submittal Date: May 27, 1999 • . INTRODUCTION General Development: 49-lot subdivision(including Lot 30 of Mt. Highlands#3) in the R-7 district toward the western portions of the City of Tigard. The main development will occur on an existing lot of record: tax lot#1100& 3900, tax map 2S1 9 AA&AD. This parcel is currently zoned R-7: the residential subdivision is an allowed use. The subdivision incorporates 48 homes, four public streets and three private streets. The site slopes to the east and north with a prominent drainageway bisecting the northern portion of the property. The subdivision plan has been configured around this drainageway, to remain in its natural state. In addition,the layout has been adjusted around retention of more than twenty-seven (27%) percent of trees 12" and greater in diameter, which will make this subdivision highly marketable and very desirable to prospective buyers. The project will be an asset to the community, and has been shown to meet the criteria of the Community Development Code. Specific Proposal: This application is for tree removal within sensitive lands identified as lands with slopes greater than 25%. Proposed tree removal within the sensitive lands will occur within the limits of tree removal as approved by the City ofTigard. Within this boundary,there are slopes of varying percentages. Some of the land contains slopes of 25%or greater. These lands are classified as sensitive under section 18.775.010.D.4 by their slope of 25%or greater. These are the lands for which the permit is sought. Two identified drainageways exist on-site which are tributaries of Fanno Creek. There are no tree removal or disturbance areas within 50 feet of these drainageways except for one 20 foot wide tree removal area for a pedestrian and utility foot bridge which will minimize impact once installed. The attached site plan exhibits tree numbers and slope percentages. The slope category of 25% - 100%is shown in green. The limit of tree removal is shown as a thick,dashed,black line shaded with diagonal lines from right to left. Along the clearing boundary, signs will be posted which prohibit the removal of additional trees, the planting of non-native plant species and prohibit further development. The trees which are within the clearing limits and are in green areas are the trees for which the permit is sought. This application for tree removal does not include removing the stumps of trees. Therefore,very little soil will be loosed during this phase of development. However, an erosion control fence has been installed along the clearing limit boundary to ensure that no soil is allowed to erode into the drainageways during the further phases of development. The boundary for tree removal has been precisely specified as to retain as many trees as possible. The boundary is close to the approved building footprints and is not excessive in regards to the use of the site. Only those trees within rights-of-way,building footprints,or those which would be covered by grading fill will be removed. With excessive slopes. The appropriate approval authority shall approve, approve with conditions or deny an application request for a sensitive lands permit on slopes of 25% or greater or unstable ground based upon findings that all or the following criteria have been satisfied: 1. The extent and nature of the proposed land form alteration or development will not create site disturbances to an extent greater than that required for the use; The tree removal boundary mirrors the proposed housing footprint or, extends only to the grading limits needed for each home's foundation. These extents have been carefully and accurately placed to allow existing trees and vegetation to remain. Only those trees necessary for removal by their location within approved right-of-ways,building footprints,or those which will be covered by grading fill. The close proximity of the clearing limits to the housing footprints allows many trees on individual lots to remain. This is shown on the attached plan by retaining trees and vegetation in- between approved building footprints. Oftentimes, all subdivision lots are totally cleared to allow the individual home owner to install their own landscaping. The closeness ofthis clearing limit retains many trees on these individual lots. This will not only reduce the site disturbance area to an extent no greater than required, it will decrease the usual disturbance area normally associated with individual lot homes. This criterion is met. 2. The proposed land form alteration or development will not result in erosion, stream sedimentation, ground instability, or other adverse on-site and off-site effects or hazards to life or property; Tree removal during this development phase will not include stump removal. Therefore, very little sediment will be loosed during tree removal activities. However, for grading and stump removal purposes,and in case of any unforseen sediment being loosed during tree removal,an erosion control fence has been erected and will prevent any sediment from escaping the boundary. The ground will not be further destabilized because the stumps will remain until grading. These stumps,their roots,and the remaining ground vegetation will keep the soil from eroding. Therefore, the proposed land alteration will not result in any adverse effects on or off-site. The criteria of this section are met. The structures are appropriately sited and designed to ensure structural stability and proper drainage of foundation and crawl space areas for development with any of the following soil conditions: wet/high water table; high shrink-swell capability; compressible/organic, and shallow depth-to-bedrock; and The site does not contain a high water table. The site was tested by Carlson Testing Incorporated, and their test pits found no high water tables. This same test showed that the site contained silt soils which have a low expansion potential. The Soil Conservation Service mapping for Washington County concurred that the soils have a low shrink-swell rating. Bedrock was found in two test pits at depths of 10.5 feet and 8 feet. However, both of these test pits are within slopes of 20% or greater, where more erosion occurs. Both of these test pits yielded the shallowest topsoil results, showing that they are in areas of increased erosion. Therefore, the encountering of bedrock is possible in localized areas with steeper slopes, but it is not a general rule. Therefore all of these criteria are met. 4. Where natural vegetation has been removed due to land form alteration or development, the areas not covered by structures or impervious surfaces will be replanted to prevent erosion in accordance with Chapter 18.745, Landscaping and Screening. All areas which will be cleared ofnatural vegetation and are not contained within impervious surfaces or covered by buildings will be required to be replanted in accordance with Chapter 18.745 as provided in the subdivision's CC&R's. This criterion will be met. Removal Permit required. Tree removal permits shall be required only for the removal of any tree with is located on or in a sensitive land area as defined by Chapter 18.775. The permit for removal of a tree shall be processed as a Type I procedure, as governed by Section 18.390.030, using the following approval criteria: 1. Removal of the tree must not have a measurable negative impact on erosion, soil stability, flow of surface waters or water quality as evidenced by an erosion control plan which precludes: a. Deposits of mud, dirt, sediment or similar material exceeding Y2 cubic foot in volume on public or private streets, adjacent property, or into the storm and surface water system, either by direct deposit, dropping, discharge or as a result of the action of erosion; The tree removal within these sensitive lands will not promote deposits of mud, dirt, sediment onto any street,property, storm or surface water system due to two factors: First, tree removal will not include the tree stumps. Therefore, very little soil will be loosed during this activity. Second, during the grading and stump removal process, an erosion control fence has already been erected to ensure that no soil will escape the approved boundary. These criteria are met. b. Evidence of concentrated flows of water over bare soils; turbid or sediment-laden flows; or evidence of on-site erosion such as rivulets on bare soil slopes where the flow of water is not filtered or captured on site using the techniques of Chapter 5 of the Washington County Unified Sewerage Agency Environmental Protection and Erosion Control rules. Any visual erosion generated by tree clearing will be contained by the existying erosion control fence. This fence will prevent any erosion from entering the public surface water system. For further development activities, permanent and temporary works will be provided to capture and filter generated surface water before entering the public system. Per Chapter 5.07.2 of the Washington County Unified Sewerage Agency Environmental Protection and Erosion Control rules trees will not be felled outside the work area. This work area has been delineated on-site along the entire tree removal boundary by an erosion control fence, and a construction fence. These criteria are met. Within Stream or wetland corridors, as defined as 50 feet from the boundary of the stream or wetland, tree removal must maintain no less than a 75% canopy cover or no less than the existing canopy cover if the existing canopy cover is less than 75%. There are no identified stream or wetland corridors on-site. However, there are two drainagesays identified on-site. There are no tree removal or disturbance areas within 50 feet of these drainageways except for one 20 foot wide tree removal area for a pedestrian foot bridge which will minimize impact once installed. The footbridge is permitted by the U.S. Army Corps of Engineers. These criteria are not applicable.
