APPLICATION SUMMARY CASE: FILE NAME: TIGARD CORPORATE PARK LOT LINE ADJUSTMENT Lot Line Adjustment MIS 98-0020 PROPOSAL: The applicant has requested Lot Line Adjustment approval to adjust the common property line between two parcels under the common ownership of Tigard Triangle I, LLC. APPLICANT/OWNER PARCEL 1: Tigard Triangle I, LLC 4650 SW Macadam, Suite 220 Portland, OR 97201 • OWNER PARCEL 2: Same LOCATION: The parcels are located at the southwest corner of SW 68th Parkway and SW 68th Avenue, west of the 1-5 freeway and northeast of Highway 217. The parcels are Tax Lots 00102 and 00103 on WCTM 2S101 DA. COMPREHENSIVE PLAN DESIGNATION: Mixed Use Employment. ZONING DESIGNATION: MUE; Mixed Use Employment. The purpose of the MUE zoning district is to create a mixed use employment district to provide opportunities for employment and for new business and professional services in close proximity to retail centers and major transportation facilities, to provide • for major retail goods and services accessible.to the general public and minor retail goods and services accessible to the public which works • and lives within the MUE district. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.32, 18.62, 18.67 and 18.162. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. NOTICE OF DECISION MIS 98-0020-TRIANGLE CORPORATE PARK LOT LINE ADJUSTMENT PAGE 1 OF 6 • • • CONDITION OF APPROVAL PRIOR TO THE RECORDING OF THE LOT LINE ADJUSTMENT, THE FOLLOWING CONDITIONS SHALL BE SATISFIED: UNLESS OTHERWISE NOTED, THE STAFF CONTACT SHALL BE BRIAN RAGER IN THE ENGINEERING DEPARTMENT (503) 639-4171. 1. A Lot Line Adjustment survey map and legal descriptions showing the existing and proposed lot lines shall be reviewed and approved by the Engineering Department. , The survey map shall include all access and utility easements. 2. The Lot Line Adjustment survey map and legal descriptions shall demonstrate that a recorded easement exists for access to Parcel 1 from SW 68th Parkway. STAFF CONTACT: M. J. The deed restriction shall have the effect of prohibiting the environmentally constrained Parcel 1 from inclusion in any development proposal except in conjunction with future site modification or redevelopment of Parcel 2. BACKGROUND INFORMATION Site Information: The site received Site Development Review approval in 1996 (SDR 96-0019) as part of the Tigard Corporate Park project. The subject site comprises the western portion of the Tigard Corporate Park development and is made up of two parcels. under common ownership. The western portion of the site is wooded and contains wetlands and a ravine. The central and eastern portions of the site are currently under development as an office building and associated parking. Proposal Description: The applicant proposes to adjust the common property line between the subject parcels as shown on the applicant's map entitled "Exhibit Map: Property Lines". The purpose of the lot line adjustment is to include the undeveloped portion of the site in one parcel (Parcel 1) and all of the site improvements in another (Parcel 2). Parcel 1 currently contains approximately 5.01 acres and Parcel 2 is approximately 2.10 acres in size. The adjustment would move and straighten the common boundary line to the west as shown on the exhibit map and transfer approximately 3 acres from Parcel 1 to Parcel 2. Final parcel sizes after the proposed adjustment would be approximately 2.06 acres (Parcel 1) and approximately 5.24 acres (Parcel 2). APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.162.060 contains the following standards for approval of a Lot Line Adjustment request: An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; The applicant's plan shows that the proposed lot line adjustment will not create an additional parcel. The subject properties are located in the MUE zoning district which has the same dimensional requirements as the C-G zone for commercial and industrial uses and the same dimensional requirements as the R-25 zone for residential uses (18.67.050.A). The C-G zone has no minimum lot size requirement but requires a 50-foot minimum lot width. The R-25 zone has a minimum lot size of 3,050 square feet for single-family and 1,480 square feet for multi-family development. There is no minimum lot width requirement in the R-25 zone. Parcel 1 is proposed to be reduced in size by the lot line adjustment but because it is currently undeveloped and no future development is proposed; neither of the above sets of dimensional standards apply. However, even after adjustment, Parcel 1 would be over 2 acres in size so that the minimum lot size of the R-25 zone is met and the average width would be over the 50-foot minimum of the C-G zone. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; This criterion applies to • the Parcel 1 since it would be reduced in size under this proposal. As noted above, Parcel 1 will comply with all potentially applicable lot size requirements of the MUE zone. The parcel is undeveloped and no future development is proposed. Therefore, there are no further applicable zoning district requirements and the site development standards of the Development Code do not apply. Therefore, the proposed reduction in the size of the parcel will not create a violation of the site development or zoning district regulations and this criterion is satisfied. The resulting parcels are in conformity with the dimensional standards of the zoning district. As noted above, Parcel 1 would be in conformity with the dimensional standards of the MUE zone. Parcel 2 is currently being developed with an approved commercial use and so the 50-foot minimum lot width standard of the C-G zone applies. The adjusted Parcel 2 would retain an average lot width after adjustment in excess of this standard. Setbacks in the C-G zone apply where a residential zoning district abuts a site, however the MUE zone is considered a primarily commercial zone and this standard would not apply. Based on the above analysis, staff finds that this criterion is satisfied. SPECIAL PROVISIONS FOR LOTS CREATED THROUGH PARTITION PROCESS: Section 18.162.060 states that in addition to meeting the above standards, a Lot Line Adjustment must also meet the following criteria applicable to lots created through the. Minor Land Partition process: Lot Width: The minimum width of the building envelope area shall meet the lot • requirement of the applicable zoning district. As noted above, there are no applicable setbacks associated with either parcel. Parcel 2 has corner frontage on SW 68th Parkway NOTICE OF DECISION MIS 98-0020-TRIANGLE CORPORATE PARK LOT LINE ADJUSTMENT PAGE 3 OF 6 • • • • and SW 68th Avenue so that the standards of Chapter 18.102, Visual Clearance Areas must be satisfied. However, the proposed lot line adjustment will not affect the building placement in relation to the visual clearance triangle; therefore, this criterion does not apply. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. As noted above, where a minimum lot area requirement is applicable, the reconfigured parcels will exceed that minimum. Neither parcel is a flag lot. Therefore, this criterion has been met. Lot Frontage: Each lot created through the partition process shall front a public right- of-way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement. This lot line adjustment will not create a new lot and, therefore, this criterion does not apply. However, if this criterion should be found to apply, staff finds that both lots have at least 15 feet of frontage on a public right-of-way or private driveway easement as shown on the exhibit map. Therefore, this criterion has been met. Setbacks: Setbacks shall be as required by the applicable zoning district. As noted above, required yards are inapplicable for both parcels. Therefore, this criterion does not apply. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side.yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. As noted above, the applicant has not proposed a partition and neither parcel is or will become a flag lot as a result of the proposal. Therefore, this criterion does not apply. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. As noted above, neither parcel is a flag lot and, therefore, this criterion does not apply. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. The proposed lot line adjustment will not change the length of any accessway and no development is proposed as part of this application. Therefore, this criterion does not apply. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. Parcel 1 will have access to SW 68th Parkway via a private access easement across the flagpole portion of the parcel located to the west (Tax Lot 104). A condition of approval will require an access easement NOTICE OF DECISION MIS 98-0020-TRIANGLE CORPORATE PARK LOT LINE ADJUSTMENT PAGE 4 OF 6 • • in favor of Parcel 1 across this portion of Tax Lot 104 (see Exhibit Map). This criterion is, therefore, satisfied. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. As noted above, Parcel 1 will have access via an easement over a private driveway tract at the north property line. The driveway tract is 30 feet wide, in conformance with City standards. Staff finds that the accessway meets City standards and that this criterion is, therefore, met. Floodplain: Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. According to the City's floodplain map, neither parcel is impacted by the 100-year floodplain. Therefore, this criterion does not apply. SECTION V. OTHER STAFF COMMENTS The Engineering Department will complete a detailed review of the submitted Lot Line Adjustment survey map and legal descriptions prior to recording of the Lot Line Adjustment. SECTION VI. AGENCY COMMENTS Service providing utilities will have the opportunity to review the proposal and decision within the ten (10) day appeal period and may request reconsideration of the decision if it may adversely affect the utilities or fire district's abilities to provide service to the subject properties or the neighboring properties. Pursuant to our discussion, it is my understanding that our prior submissions of survey information and draft deeds have previously been reviewed and approved by the City. As such, we believe this is the only outstanding condition requiring final approval from the City. The western portion of the site is wooded and contains wetlands and a ravine. The central and eastern portions of the site are currently under development as an office building and associated parking. The purpose of the lot line adjustment is to include the undeveloped portion of the site in one parcel (Parcel 1) and all of the site improvements in another (Parcel 2). The adjustment would move and straighten the common boundary line to the west as shown on the exhibit map and transfer approximately 3 acres from Parcel 1 to Parcel 2. Final parcel sizes after the proposed adjustment would be approximately 2.06 acres (Parcel 1) and approximately 5.24 acres (Parcel 2). APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.162.060 contains the following standards for approval of a Lot Line Adjustment request: An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; The applicant's plan shows that the proposed lot line adjustment will not create an additional parcel. The subject properties are located in the MUE zoning district which has the same dimensional requirements as the C-G zone for commercial and industrial uses and the same dimensional requirements as the R-25 zone for residential uses (18.67.050.A). The C-G zone has no minimum lot size requirement but requires a 50-foot minimum lot width. The R-25 zone has a minimum lot size of 3,050 square feet for single-family and 1,480 square feet for multi-family development. There is no minimum lot width requirement in the R-25 zone. Parcel 1 is proposed to be reduced in size by the lot line adjustment but because it is currently undeveloped and no future development is proposed; neither of the above sets of dimensional standards apply. However, even after adjustment, Parcel 1 would be over 2 acres in size so that the minimum lot size of the R-25 zone is met and the average width would be over the 50-foot minimum of the C-G zone. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; This criterion applies to the Parcel 1 since it would be reduced in size under this proposal. As noted above, Parcel 1 will comply with all potentially applicable lot size requirements of the MUE zone. The parcel is undeveloped and no future development is proposed. Therefore, there are no further applicable zoning district requirements.and the site development standards of the Development Code do not apply. Therefore, the proposed reduction in the size of the parcel will not create a violation of the site development or zoning district regulations and this criterion is satisfied. The resulting parcels are in conformity with the dimensional standards of the zoning district. As noted above, Parcel 1 would be in conformity with the dimensional standards of the MUE zone. Parcel 2 is currently being developed with an approved commercial use and so the 50-foot minimum lot width standard of the C-G zone applies. The adjusted Parcel 2 would retain an average lot width after adjustment in excess of this standard. Setbacks in the C-G zone apply where a residential zoning district abuts a site, however the MUE zone is considered a primarily commercial zone and this standard would not apply. Based on the above analysis, staff finds that this criterion is satisfied. SPECIAL PROVISIONS FOR LOTS CREATED THROUGH PARTITION PROCESS: Section 18.162.060 states that in addition to meeting the above standards, a Lot Line Adjustment must also meet the following criteria applicable to lots created through the Minor Land Partition process: Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. As noted above, there are no applicable setbacks associated with either parcel. However, the proposed lot line adjustment will not affect the building placement in relation to the visual clearance triangle; therefore, this criterion does not apply. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. As noted above, where a minimum lot area requirement is applicable, the reconfigured parcels will exceed that minimum. Neither parcel is a flag lot. Therefore, this criterion has been met. Lot Frontage: Each lot created through the partition process shall front a public right- of-way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement. This lot line adjustment will not create a new lot and, therefore, this criterion does not apply. However, if this criterion should be found to apply, staff finds that both lots have at least 15 feet of frontage on a public right-of-way or private driveway easement as shown on the exhibit map. Therefore, this criterion has been met. Setbacks: Setbacks shall be as required by the applicable zoning district. As noted above, required yards are inapplicable for both parcels. Therefore, this criterion does not apply. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side. yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. As noted above, the applicant has not proposed a partition and neither parcel is or will become a flag lot as a result of the proposal. Therefore, this criterion does not apply.. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. As noted above, neither parcel is a flag lot and, therefore, this criterion does not apply. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. The proposed lot line adjustment will not change the length of any accessway and no development is proposed as part of this application. Therefore, this criterion does not apply. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. Parcel 1 will have access to SW 68th Parkway via a private access easement across the flagpole portion of the parcel located to the west (Tax Lot 104). This criterion is, therefore, satisfied. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. As noted above, Parcel 1 will have access via an easement over a private driveway tract at the north property line. The driveway tract is 30 feet wide, in conformance with City standards. Staff finds that the accessway meets City standards and that this criterion is, therefore, met. Floodplain: Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. According to the City's floodplain map, neither parcel is impacted by the 100-year floodplain. Therefore, this criterion does not apply. SECTION V. The adjusted lot line will provide a greater than 50 foot minimum lot width. The C- P zone does not have minimum setback standards for the proposed adjustment. This criterion is met. The resulting parcels are in conformity with the dimensional standards of the zoning district. As stated above, there are no setback standards for the area affected by the proposed lot line adjustment, therefore this standard does not apply. • I City of Tigard October 1, 1998 Page 3 of 3 The provisions of Section 18.162.050 shall also apply to lot line adjustments. Section 18.162.050 discusses lot width, lot area, lot frontage and setback standards. The minimum lot width in the C-P zone is 50 feet which is met, as shown on Exhibit 1. The minimum lot area in the C-P zone is 6,000 square feet which both adjusted parcels meet. Parcel 1 will be provided with 40.53 feet of frontage onto a private street which directly accesses SW 68th Parkway and Parcel 2 has legal frontage on SW 66th Avenue and SW 68th Parkway. Both of the parcels are provided with the legal frontage required by the City of Tigard Development Code. As previously stated within this narrative, the subject zoning district does not have setbacks for the areas adjusted by the proposed lot line adjustment. This criterion is met. A lot line adjustment is not considered a development action for purposes of determining whether floodplain, green way, or right-of-way dedication is required. The applicant is aware of this provision of the Development Code. Section 18.162.070 - Preliminary Application Submission Requirements All submission requirements as required by this section of the City of Tigard Code have been included with this lot line adjustment submittal. The applicant has complied with the necessary lot line adjustment criteria identified in Chapter 18.162 of the City of Tigard Community Development Code and addressed within this letter. Any application for a major or minor land partition or lot line adjustment shall be in conformity with all state regulations set forth in ORS Chapter 92, Subdivision and Partitions. The proposed Lot Line Adjustment is in conformance with all applicable state regulations set forth in ORS Chapter 92. The applicant is required to meet with the Director for a pre-application conference in accordance with Section 18.32.030. The applicant's representative, Westlake Consultants, Inc. has attended a pre- application conference with Julia Hajduk, Associate Planner, as allowed by City of Tigard Staff. Section 18.162.060 - Lot Line Adjustments: Approval Standards An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; Additional lots will not be created through the proposed Lot Line Adjustment process. The properties are zoned Professional/Administrative Office Commercial District (C-P). The minimum lot size in the C-P zone is 6,000 square feet. If approved, Parcel 1 will have 89,864.28 square feet and Parcel 2 will have 228,210.84 square feet. Both parcels exceed the minimum required square footage of 6,000 square feet. By reducing the lot size, the lot or structures on the lot will not be in violation of the site development or zoning district regulations for that district; The proposed lots will not be in violation with the dimensional requirements of the C-P zone. The adjusted lot line will provide a greater than 50 foot minimum lot width. The C-P zone does not have minimum setback standards for the proposed adjustment. This criterion is met. The resulting parcels are in conformity with the dimensional standards of the zoning district. hl City of Tigard • • September 24, 1998 Page 3 of 3 As stated above, there are no setback standards for the area affected by the proposed lot line adjustment, therefore this standard does not apply. The provisions of Section 18.162.050 shall also apply to lot line adjustments. Section 18.162.050 discusses lot width, lot area, lot frontage and setback standards. The minimum lot width in the C-P zone is 50 feet which is met, as shown on Exhibit 1. The minimum lot area in the C-P zone is 6,000 square feet which both adjusted parcels meet. Parcel 1 will be provided with 40.53 feet of frontage onto a private street which directly accesses SW 68th Parkway and Parcel 2 has legal frontage on SW 66th Avenue and SW 68th Parkway. Both of the parcels are provided with the legal frontage required by the City of Tigard Development Code. As previously stated within this narrative, the subject zoning district does not have setbacks for the areas adjusted by the proposed lot line adjustment. This criterion is met. A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required. The applicant is aware of this provision of the Development Code. Section 18.162.070 - Preliminary Application Submission Requirements All submission requirements as required by this section of the City of Tigard Code have been included with this lot line adjustment submittal. The applicant has complied with the necessary lot line adjustment criteria identified in Chapter 18.162 of the City of Tigard'Community Development Code and addressed within this letter.
