BACKGROUND INFORMATION • Site History: This site has been zoned Commercial Professional since the City's Comprehensive Plan was adopted in 1983. In 1995, the applicant applied for and received Site Development Review to develop a 22,000 square foot office building. This approval expired on June 18, 1997 due to inactivity. A Site Development Review has been filed for the area shown as Tract 1 to develop a 32,735 square foot office building. The City has no record of other development applications having been filed for these properties. Vicinity Information: The site is located west of SW Hall Boulevard and south of the 217 Freeway. Areas to the west of the site are developed with detached single-family residences. The property immediately to the south is developed with apartments. One of the three properties to the east is developed with a detached single-family residence, to the south of that site is a vacant property and a third property to the east is developed with a commercial Day Care Center. Site Information and Proposal Description: The applicant has proposed a Lot Line Adjustment to transfer approximately 15,000 square feet of wooded area from a Tract 1 area owned by Michael Nedelisky and add this area to a Tract 2 area owned by the Brahma Premananda Ashram that is developed with a single-family residence. Before the adjustment, Tract 1 owned by. Michael Nedelisky contained approximately 71,130 square feet of area. After the adjustment, this property will include approximately 56,133 square feet of area. The Tract 2 area owned by Brahma Premananda Ashram presently includes approximately 75,070 square feet and would be adjusted to approximately 90,067 square feet. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Lot Line Adjustment - Approval Standards: Section 18.162.060 contains the following standards for approval of a lot line adjustment request: 1. An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and 3. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed lot line adjustment is consistent with these standards. The proposed adjustment will reconfigure the lot lines but no additional parcel will be created by the adjustment. Both parcels will continue to comply with the 6,000 square foot minimum lot size of the Commercial Professional Zoning District. The 50-foot average width standard is also met by this adjustment. No new structures are proposed at this time, but any proposed future structures will be reviewed for compliance with the underlying setback standards. Special Provisions for Lots Created Through Partition Process: Section 18.162.060 states that in addition to meeting the above standards, a Lot Line Adjustment must also meet the following criteria applicable to lots created through the Minor Land Partition process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet, or have a legally recorded minimum 15-foot-wide access easement 4. Setbacks: Setbacks shall be as required by the applicable zoning district 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard • is less than 10 feet Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development NOTICE OF DECISION MIS 97-0009/NEDELISKY LOT LINE ADJUSTMENT PAGE 3 OF 5 • • 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement that will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. 10. Floodplain: Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria 1 has been complied with because an average lot width of 50 feet has been maintained. Criteria 2 has been addressed because a minimum lot area well in excess of the 6,000 square feet has been maintained for each site after the adjustment. Criteria 3 is satisfied as both lots would continue to have an access easement to SW Hall Boulevard. Criteria 4 has been addressed because the existing residence will continue to comply with the setback standards of the Commercial Professional Zoning District. Criteria 5 and 6 are not applicable to the affected Tax Lots because the properties are designated for commercial use. Upon future development or redevelopment of these properties, fire hydrants and other required Uniform Fire Code standards will be addressed, thereby, satisfying Criteria 7. Criteria 8 has been addressed through a common access easement agreement. Criteria 9 has been addressed because Tract 1 will continue to have a minimum of 50 feet of frontage on an area designated to provide access. A joint access/maintenance agreement is existing for this purpose. Tract 2 includes the area designated to provide joint access within the legal description for the property. Criteria 10 is not applicable as neither parcel is within or adjacent to floodplain areas. SECTION V. OTHER STAFF COMMENTS. The Engineering Department will complete a detailed review of the survey map and legal descriptions prior to the applicant recording the Lot Line Adjustment. SECTION VI. AGENCY COMMENTS Service providing utilities will have the opportunity to review the proposal and decision within the ten (10) day appeal period and may request reconsideration of the decision if it may adversely affect the utility's or fire district's abilities to provide service to the subject properties or the neighboring properties. In 1995, the applicant applied for and received Site Development Review to develop a 22,000 square foot office building. This approval expired on June 18, 1997 due to inactivity. A Site Development Review has been filed for the area shown as Tract 1 to develop a 32,735 square foot office building. The City has no record of other development applications having been filed for these properties. Vicinity Information: The site is located west of SW Hall Boulevard and south of the 217 Freeway. Areas to the west of the site are developed with detached single-family residences. The property immediately to the south is developed with apartments. One of the three properties to the east is developed with a detached single-family residence, to the south of that site is a vacant property and a third property to the east is developed with a commercial Day Care Center. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Lot Line Adjustment - Approval Standards: Section 18.162.060 contains the following standards for approval of a lot line adjustment request: 1. An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and 3. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed lot line adjustment is consistent with these standards. The proposed adjustment will reconfigure the lot lines but no additional parcel will be created by the adjustment. Both parcels will continue to comply with the 6,000 square foot minimum lot size of the Commercial Professional Zoning District. The 50-foot average width standard is also met by this adjustment. No new structures are proposed at this time, but any proposed future structures. will be reviewed for compliance with the underlying setback standards. Special Provisions for Lots Created Through Partition Process: Section 18.162.060 states that in addition to meeting the above standards, a Lot Line Adjustment must also meet the following criteria applicable to lots created through the Minor Land Partition process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet, or have a legally recorded minimum 15-foot-wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement that will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. 10. Floodplain: Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria 1 has been complied with because an average lot width of 50 feet has been maintained. Criteria 2 has been addressed because a minimum lot area well in excess of the 6,000 square feet has been maintained for each site after the adjustment. Criteria 3 is satisfied as both lots would continue to have an access easement to SW Hall Boulevard. Criteria 4 has been addressed because the existing residence will continue to comply with the setback standards of the Commercial Professional Zoning District. Criteria 5 and 6 are not applicable to the affected Tax Lots because the properties are designated for commercial use. Upon future development or redevelopment of these properties, fire hydrants and other required Uniform Fire Code standards will be addressed, thereby, satisfying Criteria 7. Criteria 8 has been addressed through a common access easement agreement. Criteria 9 has been addressed because Tract 1 will continue to have a minimum of 50 feet of frontage on an area designated to provide access. A joint access/maintenance agreement is existing for this purpose. Tract 2 includes the area designated to provide joint access within the legal description for the property. Criteria 10 is not applicable as neither parcel is within or adjacent to floodplain areas. SECTION V. OTHER STAFF COMMENTS The Engineering Department will complete a detailed review of the survey map and legal descriptions prior to the applicant recording the Lot Line Adjustment. SECTION VI.
