Vicinity Information: The surrounding properties to the north, south, and west, are zoned C-P (Professional Commercial). Interstate-5 is located to the east of the subject site. The area is predominantly developed with commercial development. Site Information and Proposal Description: The properties are currently undeveloped with the exception of the Farmers Insurance office building. The applicant proposes to adjust six (6) parcels of approximately 2.35, 2.34, 4.21, 1.96, 1.94 and 11.32 square feet into six (6) parcels of approximately 4.36, 3.78, 4.8, 1.51, .48, and 9.19 square feet. • NOTICE OF DECISION MIS 96-0011-FARMERS INSURANCE PAGE 2 ,+ .. . • SECTION IV: APPLICABLE REVIEW CRITERIA AND FINDINGS • COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Lot Line Adjustment-A• • oval Standards: Section 18.162.060 contains the following standards for approval of a lot line adjustment request: 1. An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structure(s) on the lot will not bean violation of the site development or zoning district regulations for that district; and = 3. The resulting parcels are in conformity with the dimensional standards of the zoning district The proposed lot line adjustments are consistent with these standards. The proposed adjustments will reconfigure the lot lines, however, an additional parcel will not be created by the adjustments. All lots will meet the 6,000 square foot minimum lot size and the 50-foot average minimum lot width requirements of the C-P zone. All site development yro improvements applicable to lot 2200 will remain consistent with Code requirements. Development improvements on the remaining parcels will be reviewed when they are developed. Special Provisions for Lots Created Through Partition Process: Section 18.162.060 =_ states that in addition to meeting the above standards, a Lot Line Adjustment must also meet the following criteria applicable to lots created through the Minor Land Partition process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district 2. Lot Area: The lot area shall be as required by the applicable zoning district In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement 4. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where.a.common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accessway: Any accessway. shall comply with the standards set forth in Chapter 18.108; Access, Egress,and Circulation. 10. Floodplain: Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria 1 is satisfied as the minimum lot widths of lots 200, 300, 400, 500, 700 and 2200 are 160, 160, 200, 160, 50 and 200 feet respectively, thereby, exceeding the 50-foot minimum lot width. Criteria 2 is satisfied as the lot areas are approximately 4.36, 3.78, 4.8, 1.51, .48 and 9.19 acres, exceeding the minimum 6,000 minimum lot size requirement. Criteria 3 is partially satisfied as lots 200, 300, 400, and 2200 contain frontage on SW 68th Parkway, satisfying the minimum 15-foot, minimum width requirement. Lots 500 and 700 do not have frontage on a public street, nor is there documentation that these lots have easements to a public street. Documentation shall be provided that demonstrates that these lots have a legally recorded minimum 15-foot access easement to a public street. As indicated on the site plan, setbacks are satisfied on lot 2200, thereby, satisfying Criteria 4. Criteria 4 shall be satisfied on the remaining parcels as setbacks will be reviewed when they are built upon. Criteria 5 is not applicable to lots 200, 300, 400, and 2200 as they are not flag lots. Front yard determination on lots 500 and 700 shall be determined when they are built upon. Criteria 6 will be satisfied on lots 500 and 700 as compliance with screening standards will be reviewed when they are built upon. Fire hydrants shall be consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. A reciprocal access easement and joint use and maintenance agreement will not be recorded with the approved lot line adjustment survey map as a common driveway is not being proposed, thereby, satisfying Criteria 8. Criteria 9 will be satisfied on the remaining parcels as accessways shall be reviewed during site development reviews on the parcels. Criteria 10 is not applicable as none of the parcels are within the floodplain. SECTION V: OTHER STAFF COMMENTS The City of Tigard Engineering Department and Building Division have reviewed the proposal and have offered no comments or objections. The Engineering Department will complete a detailed review of the submitted Lot Line Adjustment survey map and legal descriptions prior to recording of the Lot Line Adjustment. SECTION VI AGENCY COMMENTS Service providing utilities will have the opportunity to review the proposal and decision • within the 10 day appeal period and may request reconsideration of the decision if it may adversely affect the utility's or fire district's abilities to provide service to the subject properties or the neighboring properties. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement. 4. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. 10. Floodplain: Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria 1 is satisfied as the minimum lot widths of lots 200, 300, 400, 500, 700 and 2200 are 160, 160, 200, 160, 50 and 200 feet respectively, thereby, exceeding the 50-foot minimum lot width. Criteria 2 is satisfied as the lot areas are approximately 4.36, 3.78, 4.8, 1.51, .48 and 9.19 acres, exceeding the minimum 6,000 minimum lot size requirement. Criteria 3 is partially satisfied as lots 200, 300, 400, and 2200 contain frontage on SW 68th Parkway, satisfying the minimum 15-foot, minimum width requirement. Lots 500 and 700 do not have frontage on a public street, nor is there documentation that these lots have easements to a public street. Documentation shall be provided that demonstrates that these lots have a legally recorded minimum 15-foot access easement to a public street. As indicated on the site plan, setbacks are satisfied on lot 2200, thereby, satisfying Criteria 4. Criteria 4 shall be satisfied on the remaining parcels as setbacks will be reviewed when they are built upon. Criteria 5 is not applicable to lots 200, 300, 400, and 2200 as they are not flag lots. Front yard determination on lots 500 and 700 shall be determined when they are built upon. Criteria 6 will be satisfied on lots 500 and 700 as compliance with screening standards will be reviewed when they are built upon.
