BACKGROUND INFORMATION Property History: The subject parcels were created through the Momingstar subdivision plat recorded in June of 1994. The Final Order approving the subdivision (SUB 93-12) states that tract C was to remain in the ownership of Cascade Communities to allow consolidation with abutting properties. No other development applications were found to have been filed with the City. IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Community Development Code Section 18.162.060 contains standards for approval of a lot line adjustment request: 1. An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and 3. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed lot line adjustment is consistent with these standards. The proposed adjustment will reconfigure the lot lines, however, an additional parcel will not be created by the adjustment. Both lots will exceed the 7,500 square foot minimum lot size and the minimum 50 foot lot width requirement of the R-4.5 zone. All site development improvements applicable to these lots will remain consistent with code requirements. Code Section 18.162.050. In addition to meeting the above a Lot Line Adjustment must also meet the following criteria applicable to lots created through the Minor Land Partition process. 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet, or have a legally recorded minimum 1.5 foot wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. 5. Front Yard Determination for Flaq Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 3 6. Screening on Flaq Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with, Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Floodplain: Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria 1 is satisfied as the minimum lot widths of parcel one (1), (Lot #6300) and parcel two (2) (Lot #6400) are 80 and 75 feet respectively, thereby, exceeding the 50-foot minimum lot width. Tract C is exempted from the minimum lot width criteria. Criteria 2 is satisfied as the lot areas are approximately 15,596 and 11,605 square feet, exceeding the minimum 7,500 minimum lot size requirement. Tract C is exempted from the minimum lot size criteria. Criteria 3 is satisfied as the lots contain approximately 58 and 45-feet of frontage on SW Femridge Terrace, exceeding the minimum 15-foot minimum width requirement. Tract C is exempted from the minimum lot frontage criteria. The proposed adjustment will not effect setbacks to the existing structures, thereby, satisfying Criteria 4. Criteria 5 and 6 are not applicable as these lots are not flag lots. Fire hydrants shall be consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8 is not applicable as these lots do not share a common driveway. Criteria 9 is satisfied as both parcels will continue to use existing driveways. Criteria 10 is not applicable as neither parcel is within the floodplain. V. BACKGROUND INFORMATION Property History: The subject parcels were created through the Morningstar subdivision plat recorded in June of 1994. The Final Order approving the subdivision (SUB 93-12) states that tract C was to remain in the ownership of Cascade Communities to allow consolidation with abutting properties. No other development applications were found to have been filed with the City. IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Community Development Code Section 18.162.060 contains standards for approval of a lot line adjustment request: 1. An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and 3. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed lot line adjustment is consistent with these standards. The proposed adjustment will reconfigure the lot lines, however, an additional parcel will not be created by the adjustment. Both lots will exceed the 7,500 square foot minimum lot size and the minimum 50 foot lot width requirement of the R-4.5 zone. In addition to meeting the above standards, a Lot Line Adjustment must also meet the following criteria applicable to lots created through the Minor Land Partition process. 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. • 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accesswav: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria 1 is satisfied as the minimum lot widths of parcel one (1), (Lot #6300) and parcel two (2) (Lot #6400) are 80 and 75 feet respectively, thereby, exceeding the 50-foot minimum lot width. Tract C is exempted from the minimum lot width criteria. Criteria 2 is satisfied as the lot areas are approximately 15,596 and 11,605 square feet, exceeding the minimum 7,500 minimum lot size requirement. Tract C is exempted from the minimum lot size criteria. Criteria 3 is satisfied as the lots contain approximately 58 and 45-feet of frontage on SW Femridge Terrace, exceeding the minimum 15-foot minimum width requirement. In addition, methods for maintenance of slope stability and erosion control will be submitted for approval in conjuction with the detailed grading and public improvement plans and building permits. Tree Preservation/Open Space: The subdivision complies with Policies 3.4.2 and 3.5.1. The developer has proposed a Planned Development which minimizes the impact to trees by providing larger lots on the steeper slopes. The Natural Resources Element of the Comprehensive Plan and the Bull Mountain Community Plan also identifies Low Density Detached Single Family Residential as the preferred land use for this area in order to preserve trees to the extent possible. The Bull Mountain Community Plan further identifies the subject site as an Area of Special Concern #3. Since the development application is being reviewed through the Planned Development process, wildlife habitat within sensitive lands areas and drainage corridor will be protected through the establishment of open space tracts and conservative easements. Approximately 8.0 acres of open space areas are proposed for this development. Applicant has proposed to dedicate both open space areas to the City. In response to the proposed dedication, the City has decided to accept dedication of the 0.9 acre northeast open space tract. The 7.1 acre northwest open space tract will be retained and maintained by the homeowners association. Planning staff requests that the Planning Commission give further consideration to the proposed dedication of this open space area with regards to the long term benefit of this tract of land to the City, and whether it should be dedicated to a homeowners association or the City. In addition, conservation easements and four tracts of land were also proposed to ensure that natural vegetation and wildlife habitats were preserved. The northeast open space tract shall be dedicated to the City of Tigard. Tract "D" (a proposed one foot reserve strip) shall be deeded to the City of Tigard.
