APPLICATION SUMMARY CASE: FILE NAME: CARDWELL/HEIM Lot Line Adjustment MIS 95-0022 PROPOSAL: The applicant requests approval of a Lot Line Adjustment to adjust two (2) parcels of approximately 12,000 and 7,000 square feet into two (2) parcels of approximately 10,000 and 9,000 square feet. LOCATION: 6909 SW Pine Street (WCTM 1S1 36AD, tax lot 2900) and 6913 SW Pine Street (WCTM 1S1 36AD, tax lot 2800). Northwest corner of SW 69th Avenue and SW Pine Street. APPLICABLE REVIEW CRITERIA: Community Development Code Sections 18.50, 18.162.050 and 18.162.060. II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to the following conditions: CONDITIONS OF APPROVAL 1. The applicant shall provide evidence that lots 3000 and 2800 have been consolidated into one (1) tax lot. NOTICE OF DECISION G4RDWEWNE/M-MIS 95-0022 PAGE I • • 2. A lot line adjustment survey map and legal descriptions showing the existing and proposed lot lines shall be reviewed and approved by the Engineering Department. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE FINAL DECISION DATE NOTED UNDER THE PROCESS AND APPEAL SECTION BELOW. III. BACKGROUND INFORMATION Property History: In 1992, tax lot 2800 received a Lot Line Adjustment approval (MIS 92-0009) to adjust the property lines with the adjoining property to the north (then tax lot 3000). It appears that this adjustment was not recorded, as tax lot 2800 was supposed to encompass the area now made up of lot 2800 and lot 3000 (current tax map lot 3000). (Note: There is no record on file of a Minor Land Partition which would have created tax lot 3000 as it exists on current tax maps. Washington County records tax lot 3000 as being created on January 8, 1993 by warranty deed.) No other development applications were found to have been filed with the City. Tax lot 2800 is currently considered a non-conforming lot, as it contains only 7,000 square feet, whereas, the R-4.5 zone requires a minimum lot size of 7,500 square feet. The proposed adjustment would bring tax lot 2800 into conformity with the R-4.5 standards. Staff has talked with the applicant regarding the creation of tax lot 3000, since it is under the same ownership as lot 2800. The applicant has agreed to consolidate these lots as part of this development application. Consolidating the lots would provide lots which are identical to what was approved under the 1992 lot line adjustment (MIS 92-0009). IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Community Development Code Section 18.162.060 contains standards for approval of a lot line adjustment request: 1. An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and NOTICE OF DECISION CARDWEWHEIM-MIS 95-0022 PAGE 2 !n • • 3. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed lot line adjustment is consistent with these standards. The proposed adjustment will reconfigure the lot lines, however an additional parcel will not be created by the adjustment. Both lots will exceed the 7,500 square foot minimum lot size and the minimum 50 foot lot width requirement of the R-4.5 zone. All site development improvements applicable to these lots will remain consistent with code requirements. Code Section 18.162.050. In addition to meeting the above standards, a Lot Line Adjustment must also meet the following criteria applicable to lots created through the Minor Land Partition process. 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district 2. Lot Area: The lot area shall be as required by the applicable zoning district In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement 4. Setbacks: Setbacks shall be as required by the applicable zoning district 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090.. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accessway; Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. 10. Floodplain: Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria 1 is satisfied as the minimum lot widths of parcel one (1), (Lot #2800) and two (2) (Lot #2900) are 90 and 100 feet respectively, thereby, exceeding the 50 foot minimum lot width. Criteria 2 is satisfied as the lot areas are approximately 8,937 and 10,063 square feet, exceeding the minimum 7,500 minimum lot size requirement. Criteria 3 is satisfied as the lots contain approximately 90 and 100 feet of frontage on SW Pine Street, exceeding the minimum 15 foot minimum width requirement. As indicated on the site plan, the proposed adjustment will continue to satisfy the setback standards, thereby, satisfying criteria 4. Criteria 5 and 6 are not applicable as these lots are not flag lots. Fire hydrants shall be consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8 is not applicable as these lots do not share a common driveway. Criteria 9 is satisfied as both parcels will continue to use existing driveways. Criteria 10 is not applicable as neither parcel is within the floodplain. V. OTHER STAFF COMMENTS The City of Tigard Engineering Department and Building Division have reviewed the proposal and have offered no comments or objections. The Engineering Department will complete a detailed review of the submitted lot line adjustment survey map and legal descriptions prior to recording of the Lot Line Adjustment. VI. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE FINAL DECISION DATE NOTED UNDER THE PROCESS AND APPEAL SECTION BELOW. III. BACKGROUND INFORMATION Property History: In 1992, tax lot 2800 received a Lot Line Adjustment approval (MIS 92-0009) to adjust the property lines with the adjoining property to the north (then tax lot 3000). It appears that this adjustment was not recorded, as tax lot 2800 was supposed to encompass the area now made up of lot 2800 and lot 3000 (current tax map lot 3000). (Note: There is no record on file of a Minor Land Partition which would have created tax lot 3000 as it exists on current tax maps. Washington County records tax lot 3000 as being created on January 8, 1993 by warranty deed.) No other development applications were found to have been filed with the City. Tax lot 2800 is currently considered a non-conforming lot, as it contains only 7,000 square feet, whereas, the R-4.5 zone requires a minimum lot size of 7,500 square feet. The proposed adjustment would bring tax lot 2800 into conformity with the R-4.5 standards. Staff has talked with the applicant regarding the creation of tax lot 3000, since it is under the same ownership as lot 2800. The applicant has agreed to consolidate these lots as part of this development application. Consolidating the lots would provide lots which are identical to what was approved under the 1992 lot line adjustment (MIS 92-0009). IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Community Development Code Section 18.162.060 contains standards for approval of a lot line adjustment request: 1. An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and NOTICE OF DECISION CARDWEIUHEIM-MIS 95-0022 PAGE 2 • • 3. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed lot line adjustment is consistent with these standards. The proposed adjustment will reconfigure the lot lines, however an additional parcel will not be created by the adjustment. Both lots will exceed the 7,500 square foot minimum lot size and the minimum 50 foot lot width requirement of the R-4.5 zone. All site development improvements applicable to these lots will remain consistent with code requirements. Code Section 18.162.050. In addition to meeting the above standards, a Lot Line Adjustment must also meet the following criteria applicable to lots created through the Minor Land Partition process. 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. 10. Floodplain: Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain: This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria 1 is satisfied as the minimum lot widths of parcel one (1), (Lot #2800) and two (2) (Lot #2900) are 90 and 100 feet respectively, thereby, exceeding the 50 foot minimum lot width. Criteria 2 is satisfied as the lot areas are approximately 8,937 and 10,063 square feet, exceeding the minimum 7,500 minimum lot size requirement. Criteria 3 is satisfied as the lots contain approximately 90 and 100 feet of frontage on SW Pine Street, exceeding the minimum 15 foot minimum width requirement. As indicated on the site plan, the proposed adjustment will continue to satisfy the setback standards, thereby, satisfying criteria 4. Criteria 5 and 6 are not applicable as these lots are not flag lots. Fire hydrants shall be consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8 is not applicable as these lots do not share a common driveway. Criteria 9 is satisfied as both parcels will continue to use existing driveways. Criteria 10 is not applicable as neither parcel is within the floodplain. V. OTHER STAFF COMMENTS The City of Tigard Engineering Department and Building Division have reviewed the proposal and have offered no comments or objections. The Engineering Department will complete a detailed review of the submitted lot line adjustment survey map and legal descriptions prior to recording of the Lot Line Adjustment. VI.
