The Planning Division has reviewed this request and found that the structure complies with the requirements for accessory structures. The proposed tower is not located in the required front yard and complies with applicable side and rear yard setbacks. Due to its design and location, the accessory structure would not be expected to encroach upon, or interfere with the use of an adjoining property or public right-of-way including streets, alleys and public or private easements. The Tigard Community Development Code Section 18.98.010 states that, projections such as chimneys, spires, towers excluding TV dish receivers, aerials, flag poles and other similar objects not used for human occupancy, are not subject to the building height limitations of this title. Therefore, the proposed radio tower is not restricted to the 30 foot height requirement of the R-4.5 zoning district. The proposed tower is designed to be attached to the residence. As such, it is considered as a part of the principal structure and must comply with standard side and rear yard setbacks. Section 18.144.070(A)(3) which requires setbacks equal to, or greater than, the height of the accessory structure is not applicable to this application as this tower is not a freestanding tower.
