' Tom McConnell (Project Planner) 9600 SW Oak Street, Suite 230 Portland, OR 97223 503.452.8003 1 1 1 1 Fanno Pointe CPA 1 Alpha Engineering, Inc. 1 • r 1 GENERAL INFORMATION: 1 The applicant is requesting a Comprehensive Plan Amendment to remove an existing man-made pond, which is identified as a significant resource on the City's Comprehensive Plan, and restore the historical drainage of Pinebrook Creek on the property. The subject site, specifically identified as Tax Lot 300 of Tax Map 2S1 2DD, is approximately 6.12 acres and is currently zoned R-12 (Residential, 3,050 square foot minimum lot size) by the City of Tigard. 1 The site has recently been developed with a 42-unit condominium ro'ect called Fanno Pointe. P J Fanno Creek, and its associated wetlands, is a dominant feature in the eastern portion of the site. 1 A man-made pond, fed by pipes diverting the hydrologic flow of Pinebrook Creek, is located in the northwest corner of the site. The pond has been identified as a significant resource on the 1 City's Wetland Inventory(Unit 7), as a result of the Fishman Environmental Services Wetlands Inventory update. The removal of the man-made pond and restoration of the historic flow of Pinebrook Creek on this property requires a Comprehensive Plan Amendment. PROJECT DESCRIPTION Approval of the Comprehensive Plan Amendment would allow the existing man-made pond to be removed, including the piping that diverts the waters of Pinebiook Creek and feeds the pond, I and allow for the restoration of the historical flow of Pinebrook Creek across the site. More specifically, the applicant is not seeking to remove a resource, but rather to modify the resource to a more natural condition. The restoration and enhancement of this area of the property is a 1 condition of approval from Clean Water Services that allowed the development of the Fanno Pointe Condominiums. 1 The proposed work on the Fanno Pointe site coincides with the City's efforts to obtain approvals for the construction of Wall Street to serve the adjoining new library site to the north of Fanno Pointe. The applicant has coordinated the proposed restoration plan on the Fanno Pointe site to 1 be compatible with the ultimate restoration of Pinebrook Creek the City is undertaking. Plant materials have been reviewed and approved by Fishman Environmental Services who is serving as the City's consultant for the Pinebrook Creek restoration being done in association with the Wall Street construction. 1 APPLICABLE DEVELOPMENT CODE CRITERIA 18.380: ZONING AND TEXT AMENDMENTS Section 18.380.030 states that the Commission shall make a recommendation to the Council on an application for a comprehensive plan map amendment. Subsection B of this section states, a 1 recommendation or a decision to approve, approve with conditions or to deny an application for a quasi-judicial amendment shall be based on all of the following standards: 1 1 Fanno Pointe CPA 2 Alpha Engineering, Inc. • • 1. Demonstration of compliance with all applicable comprehensive plan policies and map designations; ' RESPONSE: This proposal is in compliance with the applicable comprehensive plan policies and map designations as follows: Policy 3.4.1 — The City shall designate, in accordance with Goal 5, the following as areas of significant environmental concern: a. significant wetlands; c. areas valued for their fragile character as habitats for plants, animal or aquatic life, or having endangered species, or specific natural features, valued for the need to protect natural areas. ' Response: ' The City has identified an area in the northwestern corner of the subject site (labeled E-18 on the inventory) as a significant resource. The analysis completed by Fishman Environmental Services in December 1994 reads, in part, as follows: "Wildlife habitat also occurs in the middle of the unit east of Hall Boulevard and Fanno Creek where expansive uplands occur adjacent to the creek. The uplands include a large pasture and a large diverse mixed deciduous/coniferous woodland with two seasonal streams flowing through it. These large adjacent uplands increase ' wildlife habitat and aesthetic quality values of sites E14-16 and E18-21". This description does not refer to the man-made pond directly, however it does refer to the two seasonal streams, which includes Pinebrook Creek. This application seeks to restore and enhance Pinebrook Creek I by "daylighting" it within the subject site and remove the portions of it where it is piped and diverted to the pond. This application does not seek to remove a resource from the subject site but more accurately, re-designate it. The resulting resource will be of higher quality that what ' exists today. The City shall: a. Protect fish and wildlife habitat along stream corridors by managing the riparian habitat and controlling erosion, and by requiring that areas of standing trees and natural vegetation along natural drainage courses and waterways be maintained to the ' maximum extent possible. Response: ' This proposal will help enhance fish and wildlife habitat by removing a man-made pond and restore a natural drainage course of Pinebrook Creek. The waters within the pond are too warm during summer months to benefit fish habitat. The restoration of the natural drainage course with t appropriate plantings will provide water quality and appropriate shading to control water temperatures. This proposal better achieves this policy than the existing resource in its current condition. ' The preceding are the policies most directly applicable to the request to eliminate the existing man-made pond (a designated natural resource on the City's inventory) and restore the site's natural drainage characteristics and create a new resource in the same area of the site. Demonstration of compliance with all applicable standards of any provision of this code or other applicable implementing ordinance; and: ' RESPONSE: The applications has been submitted and will be processed in accordance with the City's Development Code, more particularly in compliance with Section 18.380 of the Code. Additionally, this narrative addresses the applicable provisions of Section 18.775, Sensitive Lands. 3. Evidence of change in the neighborhood or community or a mistake or inconsistency in the f g g �v y comprehensive plan or zoning map as it relates to the property which is the subject of the ' development application. ' RESPONSE: There is significant change occurring in the neighborhood. The subject site, previously a single family home on acreage, is now developed as a 42-unit condominium project. The adjoining ' property to the north is being prepared to be the site of the new City library. In coordination with these development projects, SW Hall Boulevard in this vicinity is being widened and improved. Lastly, a new roadway(SW Wall Street),is proposed to provide access to the Library site as well I as the ultimate access to the Fanno Pointe condominiums. The applicant is working with the City and the City's environmental consultants to provide for a comprehensive and cohesive restoration of the natural drainage along this portion of Pinebrook Creek as it flows towards Fanno Creek. ' This application focuses on that portion of the Pinebrook Creek restoration that lies on the Fanno Pointe site. The proposed plantings for this restoration were done in coordination with the City's ' consultant for the environmental work being done in conjunction with the library and SW Wall Street construction. 18.775: SENSITIVE LANDS ' Pursuant to section 18.775.130, the applicant shall demonstrate that an amendment subject to this section is justified by the following: A. ESEE analysis. The applicant may prepare an Environmental, Social, Economic and Energy (ESEE) consequences analysis prepared in accordance with OAR 660-23-040. ' I. The analysis shall consider the ESEE consequences of allowing the proposed conflicting use, considering both the impacts on the specific resource site and the comparison with other comparable sites within the Tigard Planning Area; Response: The following analysis describes each of these consequences: Fanno Pointe CPA 4 Alpha Engineering, Inc. 1 Economic Consequences ' It is intuitive that proximity to natural resources would increase the value of surrounding properties. The applicant is not aware of any studies on the economic ' impact of removing a man-made pond and restoring the natural drainage of a creek. However, it could be expected that a well-designed, restored stream and adjacent riparian area would have a greater value to adjoining property than artificial pond that ' exists there today. Social Consequences ' The social consequences of restorin g this section of Pinebrook Creek would include the scenic value associated with the creek and adjacent riparian area and the quality of life related to the restoration of wetland and wildlife habitat, both at the point of restoration and downstream at Fanno Creek. ' The restoration of this portion of Pinebrook Creek also fits in with the larger restoration being considered as part of the new City library and SW Wall Street ' construction. These are related, though separate, positive social consequences. Environmental Consequences ' The environmental consequences of the proposed stream restoration are positive in nature. The existing man-made pond provides poor water quality and higher water ' temperatures. The proposed restoration will provide better wildlife habitat, water quality and cooler water temperatures. The proposed plantings associated with the restoration project were coordinated with City's environmental consultant and would ' be compatible with the larger-scale restoration of Pinebrook Creek. Energy Consequences ' The applicant is not aware of any energy consequences to the proposed Pinebrook Creek restoration. 2. The ESEE analysis must demonstrate to the satisfaction of the Tigard City Council that the adverse economic consequences of not allowing the conflicting use are sufficient to justify the loss, or partial loss, of the resource; ' Response: The proposal does not propose a conflicting use.
