Correspondence October 14, 1998 • Joe Dailey CITY OF TIG 13266 SW 136` Place Tigard OR 97223 OREG Mr. Dailey: I have enclosed print outs of the permit MST94 -0173 which shows the building final was approved and a Certificate of Occupancy was granted on January 27, 1995. I am unable to print a copy of the actual Certificate at this time. I hope this will suffice. I have also enclosed additional information. On June 18, 1996, MEC96 -0188 was issued to Allied Mechanical for an air conditioner. On July 1, 1996, ELC96 -0429 was applied for by Richard Whiteman. A fee of $36.75 is due for the electrical permit before it can be issued. According to our records, the air conditioner has not been inspected. As the current property owner, you are the responsible party for these outstanding permits. Please contact me at 639 -4171 ext. 310 to verify whether or not an air conditioner was installed. If it was installed, it must be inspected. Before we can perform inspections, the outstanding electrical fee must be paid and the permit issued. I have enclosed the names of the contractors and their phone numbers (at the time the permits were applied for), for your convenience. Another matter I would like to discuss with you is the phone call made to the City by Mrs. Dailey in December, 1997 regarding the gas fireplaces and the fact she was concerned about the heat and smell coming from them. I would like to confirm that Mrs. • Dailey was contacted by a City Inspector. I look forward to the opportunity of helping you resolve all the above issues. Since we were made aware of the non - compliant items we have worked with you to resolve them. To this end, we provided you with written notices documenting the non- compliant items needing correction. We cannot address items of the construction which meet code minimums or are not code related. Our inspector has observed that the non - compliant items have been corrected, with the exception of the issue of a foundation drain for a portion of the foundation wall. To be in compliance, we have given you the option of providing the foundation drain or leaving a minimum of 12 inches between the concrete foundation wall and the wood framing which encloses the useable basement area. How you achieve compliance is at your discretion. Regarding your contention that the builder is responsible for all non - compliant items, please be advised that you need to resolve that issue with the builder. If you are not satisfied with the builder's response to your concerns, you should exercise your ability to take the matter to the State Builder's Board, which is established for just that purpose.
