We enjoyed meeting you and appreciated the information you provided. This letter is to request a reclassification of the property at 11990 SW 121st, Tigard, OR 97223, to SR3.3. Our proposed use for this property will be to serve five or fewer temporary residents who are involved in mental health care and are receiving short-term respite care at that site. It will be fully licensed by the State of Oregon and will have 24 -hour awake staffmg. At no time will there be more than five residents. A paid staff member will always be available to address any sort of concern involving the home's population and services. The management will be through Luke -Dorf, Inc., a mental health agency that has served Tigard for more than 20 years. The clientele will be people in need of a structured, supervised setting, but not in need of hospitalization or medical care. These people will be in the process of working on emotional issues, getting used to new medication, or settling some crisis in their lives such as loss of housing. All staff will be trained in management of the house and residents, and a supervisor will be on call 24 hours. We include a floor plan of this residence for your records. No major structural changes to the home are planned. Once this reclassification is granted, we would greatly appreciate your notifying the fire marshal so that we can expedite the fire inspection. As you indicated during our on -site meeting on July 25, 2003, the residence was previously utilized as a drug and alcohol counseling facility. The proposal is to change the use to provide short-term respite services on a 24 -hour basis for five or fewer clients. It will be licensed through the Oregon Department of Human Services as a Residential Treatment Home. Our understanding is the evacuation capability of the residents is classified as prompt. This puts the occupancy into the SR -3.3 category as defined by the State of Oregon Structural Specialty Code (OSSC), 1998 edition. The requirements for an SR -3.3 most typically resemble that of an R -3 Occupancy, which is a standard 1 &2 family dwelling. There are however, some minor modifications and a change of use /certificate of occupancy fee that will be necessary in order to have this change of use approved. The change of use will be approved subject to the following conditions. 1. The use is restricted to the 24 -hour care of five or fewer residents with an evacuation capability of 3 minutes or less. OSSC 312A.1.2 2. Smoke detectors may be battery operated in existing buildings. The existing smoke detectors shall be provided with 10 -year batteries. OSSC 310.9.1.3 and Table 3 -1 -3 3. The door to the garage shall be a solid wood or steel door not less than 1 3 /8 inches thick or a 20- minute rated fire door provided with an approved label. All doors shall be openable from the inside without the use of a key or any special knowledge or effort. 5. The existing egress windows in the bedrooms were installed under a previous code that allowed them to have the finished sill height not more than 48 inches above the floor. The current code requires the sill height to be not more than 44 inches above the floor. Because there are no structural modifications planned, and the egress windows were legal at the time the building was constructed, they will not be required to be lowered. A recommendation would be to locate the beds directly under these windows to facilitate emergency egress. OSSC 3401 6. A minimum fee of $62.50 shall be paid for the review and issuance of the Certificate of Occupancy. A copy of this letter will be forwarded to Jerry Renfro, Tualatin Valley Fire & Rescue Deputy Fire Marshal. To expedite this matter, Mr. Renfro could verify the conditions at the time of his inspection and forward his results to me.
