There is also a 5 -foot dedicated public easement on Parcel A at the east property line adjacent to 92nd Avenue. The new fence located at 16283 SW 92nd Avenue encloses that private easement and is a violation of the deed similar to trespass. The City of Tigard does not recognize private easements, regardless of initiation by subdivision /partition plat or deed encumbrance. This means that the fence location is a private or civil matter. Prior to 1983, land partitions were recorded with the tax assessor's office, but not reviewed for zoning and /or building code violations. This is one reason why the easement is not shown on the Washington County tax assessor's maps.
