Correspondence - joie Albert Shields - 11085 SW 78th Ave., Tigard, OR 97223 Page 1 From: Albert Shields To: bhereth102 @aol.com Date: 12/16/2004 10:21:22 AM Subject: 11085 SW 78th Ave., Tigard, OR 97223 Brenda, as we discussed in our phone conversation, this requests a statement from the owner of this property, which I understand to be Washington Mutual, regarding information the City of Tigard received earlier this year to the effect that the house had been found to have a serious mold infestation, reports to that effect had been posted in the window of the house, and the health of the previous owners, the Winchesters, had been impaired by the mold condition. At this time I do not have evidence that these reports were either true or false but the fact that they came from multiple sources gives us concern about the habitability of the property. Our records indicate that the bank's foreclosure agent, NW Trustee Services, was aware of the reported mold issue when City personnel spoke with them in June, 2004. Would you please ask Washington Mutual and /or NW Trustee Services to tell us what they learned about or did about the reported mold problem? Specifically, whether an appropriate testing or remediation firm confirmed and treated for a mold problem or documented that'no such problem existed? Your permit request for electrical reconnect suggests that ownership issues have been resolved and that reoccupancy may soon be desired. To demonstrate our cooperation, I have asked our staff to proceed to issue the electrical reconnect permit. However, please advise the owners and all interested parties that issuance of this permit does not constitute an affirmative approval by the City of reoccupancy of the property and the City reserves the right to bar such reoccupancy if it determines that sufficient grounds exist to declare that conditions in or at the property constitute a hazard to the public health or the health of any occupants. We would appreciate having the cooperation of the current owners in determining and documenting the facts about this reported mold issue as soon as possible. Thanks for your cooperation.
