Correspondence 1 9 13 MEMORANDUM 40I TO: Hap Watkins, Kim McMillan, Gary Lampella ..�.... - FROM: Albert Shields RE: Gettysburg Apts., 10735 SW 69 & Carol Schoewe, 10720 SW 71 CC: Property Files DATE: Friday, October 22, 2004 FYI and by copy to the above property files, we have received the attached letter from Kathy Mattison, manager of the Gettysburg Apartments, to Carol Schoewe, the owner of 10720 SW 71 Ave, which is the property immediately downhill from Gettysburg and where the drainage ditch is located that Gettysburg's recently repaired rain drains discharge into. With this letter Gettysburg has, as we had requested, offered to deepen the channel of the ditch so as to minimize the possibility of rain drain discharge from Gettysburg causing flooding on the Schoewe property. With the Gettysburg rain drains repaired under permit, the ditch determined to qualify as a pre- existing and established drainage ditch, and Gettysburg now offering to deepen that ditch, we consider all of the outstanding issues in this case to have been resolved and Gettysburg and all other parties to be in compliance with Plumbing and Housing Code requirements regarding their rain drain discharge and use of the drainage ditch. Schoewe 10720 SW 71s Ave. Tigard, OR 97223 Valerie Kirkendall 9250 SW Tigard, St. Tigard, OR 97223 Re: Drainage ditch located on the North side of 10720 SW 71 Ave. I am in receipt of the letter from Valerie Kirkendall to Albert Shields, City of Tigard, dated September 28, 2004 and the letter sent to Carol SchoeweNalerie Kirkendall from Albert Shields, City of Tigard dated October 8, 2004. In an effort to solve any additional problems with the water runoff from Gettysburg Apartments onto Carol Schoewe's property, I would like to ask that we have permission from Carol Schoewe to access her property so that we may deepen the drainage ditch that runs along the North side of her property. It appears to me that by deepening parts of the ditch, we could help to keep the runoff water from posing any additional problems on her property that were not solved by the new drainage construction on Gettysburg Apartments. Based on the time of year, we would like to start the digging as soon as possible in order to alleviate any further problems on the property. I look forward to your answer.
