Adequate opportunity for recycling has been provided and the area where the franchise collects separated recyclable materials is at central locations accessible to the franchisee's hauling equipment; 5. The compactor can adequately serve the purpose for which it is installed, including: • Able to hold all wastes generated by the permittee; • Accessible, and easy for the permittee and Its tenants and employees to insert waste into the compactor in a safe manner; • Safety measures to prevent unauthorized or accidental operation, or attraction to minors; and Sanitary and tight design to prevent waste from leakage, drepping, blowing, or otherwise escaping from the compactor or unauthorized removal of waste from the compactor. 6. The compactor shall be located outside of any required building setback areas and (or) required buffered areas as required by the applicable zoning district and related Community Development Code or Municipal Code Standards. OPERATIONAL STANDARDS At all times, the applicant and the compactor shall remain incompliance with the following requirements: • Compliance with any applicable federal, state, and local health, safety, and environmental regulations including, but not limited to OAR 437 -02 -242 and the City's Solid Waste Management Cades (Chapter 11.04); • The compactor and surrounding area will be kept clean at all times; • The compactor will undergo regular preventive maintenance and adequate emergency maintenance shall be available; • The compactor and operation of the compactor shall remain in compliance with all representations made in the application for and the permit issued for the operation; and • There will be no operation of the compactor between the hours of 9:(() PM and 7:00 AM. SAFETY No stationary compactor or the other container for multi family residential commercial or industrial use shall exceed the safe loading design limit or operation of the collection vehicles provided by the franchisee serving the area. SIGN Each container shall be clearly labeled with the name, address, and telephone number of the permittee, and the name of the contact person. HEALTH Compactors containing putrescible waste shall be emptied at least weekly. REIMBURSEMENT FOR FINES Permittees shall reimburse the franchisee for any fines incurred by the franc -isee for weight or environmental violations, or any other violation caused by the ownership, operation, or use of the compactor, ADDITIONAL CONDITIONS OF APPROVAL hereby certify that I have read and understand the above conditions andistandards as they apply to Stationary Solid Waste Compactors. I acknowledge that this compactor approval may be revol•.ed if the above conditions have not or are being conducted in a manner contrary to the Solid Waste Management Chapter of the Tigard Municipal Code, Chapter 11.04. Box 820 Sherwood, OR 97140 Phone: (503) 625 -6177 Fax: (503) 625 -6179 April 14, 2006 Greenburg Oaks Apartments Attention: Martin Soloway PO Box 23206 Tigard, OR 97281 -3206 RE: Greenburg Oaks Apartments; Trash Enclosure & Compactor This letter is to confirm receipt of an email sent Friday, April 7, 2006 outlining updates to the construction of the new enclosure that will hold a 4yd trash compactor, recycling container (size to be determined due to straight -on access needed) and glass totes. • The curbing and light post have been removed to allow straight -on access for both the compactor and recycling container. • It is our understanding that the compactor will be placed in the enclosure in such a way to allow at least 12 — 18 inches on either side for maneuverability. • The gates will be mounted on full swing hinges, allowing for well over 105 degrees, up to 150 degrees. • The compactor opening will have two full swing gates, there will not be a center post; the recycling side will have a single full swing gate, no center post and there will be adequate room for the truck to enter for straight -on access (allowing room for the front forks & side mirrors). • All doors will have pins and pin holes to hold /lock them in the open position. The holes will allow for the widest door swing possible. With all of the above items in place, Pride Disposal will be able to service Greenburg Oaks Apartments for both trash and recycling. We will make the change in service (trash containers to compactor) once you have notified us that the compactor has been installed and it operational. Both property management and Pride Disposal will monitor the frequency of pick -ups on both the trash and recycling as the transition is made. Please notify me of the date to pull the 2 -6yd trash containers and begin service on the compactor, as well as switch out the size of the recycling container. As well, please let me know if there are any questions.
