This responds to your request for information regarding periodic inspections and outstanding code violations at the property at 13221 SW 68 Parkway, Tigard. The Building Division does not make periodic inspections of this or any other properties in Tigard. You may wish to contact Tualatin Valley Fire and Rescue (TVF &R) regarding any findings they may have from the periodic inspections conducted by the Fire Marshall. Seven Building and Electrical permits for work within this building are in Expired (X) status because they never received fmal inspection approval (and in some cases received no inspections at all) and because more than six months has passed since the last activity under the permit. The dates of these permits range from 2001 to 2004. Technically, it is a violation of the respective Building or Electrical Codes to occupy a space or put an electrical circuit or installation into service without first receiving final approval under the relevant permit. Under the Electrical Code it is also a violation to fail to make corrections and call for re- inspection within 20 days of a correction being issued. • Accordingly, there is a violation associated with each of these expired or incomplete permits. We have not, however, at least at this time, issued formal Notices of Violation or Citations regarding these permits. It is the general policy and practice of the City of Tigard to allow such permits to expire after 6 months of inactivity, as provided in the codes, and to allow responsibility for properly completing the work and liability for any incomplete or improper work to rest with the property owner and/or tenant unless we have reason to believe that fire or life safety issues are involved, in which case we do serve Summonses and Complaints and impose penalties. In this case and at this point we have no reason to believe that any such fire or life safety issues exist and we have taken no action beyond expiring the permits. Nonetheless, the City reserves the right to take formal enforcement action at any time if it deems it appropriate to do so. If the property owner wishes to clear the record regarding these expired permits and the work they represent that lacks inspection and approval by our office, new permits and permit applications will be required. New permits are required, as opposed to reinstatement, because of the length of time since the original permits were issued and the 13125 SW Hall Blvd., Tigard, OR 97223 (503) 639 -4171 TDD (503) 684 -2772 work inspected. With cooperation from the property owner in this regard we will be happy to work with the owner's representatives or the contractors to resolve these issues as promptly as possible. For your records and consideration I have attached copies of our activity record for each of the seven subject permits. Those records show the general scope of work, the tenant responsible, and the record of activities.
