I feel certain issues need to be brought to your attention to forestall any misunderstandings. The City of Tigard has a solid waste hauling ordinance that gives exclusive rights to three waste haulers for any waste hauling. I have enclosed a document I authored that may answer questions you may have. Your business is hauling from construction sites and is affected in the following manner. Normally this type of business is not allowed. However, - this is presently under study by the city legal department as being either sanctioned or enforced as written in this ordinance. Until a determination is made, by the city, anyone hauling from such sites MAY continue to do so without penalty. If the ruling upholds the enforcement of the present ordinance, without this exclusion, you will be in violation if you continue past a future date. I suggest you attend the coming Franchise Committee Meeting at 7:OOpm on MAY 15th at City Hall. This issue will be formally addressed by the City Attorney and your questions may be answered. There will be others there also concerned with this matter. This meeting is open to the public and anyone is encouraged to attend. These waste haulers may be unaware of the requirements the city has at this time. This attempt is made to acquaint everyone involved with the following information. Tigard Municipal Code #11.04 SOLID WASTE MANAGEMENT was adopted by the Tigard City Council to regulate who would be given permission to haul waste materials from private homes and businesses. The ordinance gives exclusive rights to companies who have been granted a waste haulers franchise by the City. This ordinance regulates all waste haulers and /or anyone contracting with them. Violation of this ordinance is an UNCLASSIFIED MISDEMEANOR. Anyone found to be in violation may be cited and fined up to $500 upon conviction. For the purposes of this ordinance the following definitions apply: "Solid waste' means all putrescible and nonputrescible wastes, including but not limited to garbage, rubbish, refuse, ashes, wastepaper and cardboard; residential, commercial, industrial, demolition and construction wastes; discarded home and industrial appliances; vegetable or animal solid and semisolid wastes; dead animals and other wastes'. • 'Waste" means any material no longer wanted or usable by the generator, pro- ducer or source of the material, which material is to be disposed of or to be resource - recovered by another person'. Anyone generating the above wastes may haul the materials away themselves or contract with a "franchised" waste hauler. Non - franchised waste haulers may not transport waste within the City of Tigard for a fee or for no charge. The purpose of this solid waste franchise ordinance is to provide the best and most stable service at the lowest cost.
