HOP1988-00004 • CITY OF TIGARD NOTICE OF DECISION HOP 88-04 HASTING APPLICATION: A request by Sharon M. Hasting for a Home Occupation Permit to allow operation of a dog grooming business (d.b.a. "Pretty Pooch Dog Grooming ") on property zoned R -4.5 (Single Family Residential, 4.5 units /acre). Location: 9555 SW Lewis Lane. DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED the above request subject to certain conditions. The findings and conclusions on which the Director based his decision are as noted below. A. FINDING OF FACT 1. Background No previous applications have been reviewed by Planning Division staff with respect to the subject property. 2. Vicinity Information Properties in all directions but north are zoned and developed R -4.5 (Single Family Residential, 4.5 units /acre). Properties to the north are zoned R - -12 (Multi — family Residential, 12 units /acre). 3. Site Information and Proposal Description The applicant proposes to bathe and groom dogs in a 400 square foot detached garage on the property. Only 200 square feet are intended for use in conjunction with the business. No customers or clients will come to the property as the applicant intends to pick up and deliver the groomed dogs herself. No non— resident employees will be involved and no matrials or dogs will be stored outside. 4. Agency and NPO Comments NOP #2 will be notified of this decision and will be given the right to appeal. B. ANALYSIS AND CONCLUSION The applicant indicates that the potential barking of dogs may be a source of noise which could be heard outside of the structure. Section 18.142.050(j) of the Code states that a home occupation shall not produce any noise, etc., "detectable to normal sensory perception" outside the structure. The adjacent properties do not contain any structures which could be impacted by the barking. Staff warns, however, that should the City receive a validated complaint concerning any dog barking emanating from the property, then this home occupation permit may be subject to cancellation. All other regulations pertaining to home occupations contained in Chapter 18.142 are satisfied. C. DECISION HOP 88 -04 is hereby approved subject to the following conditions: 1. There shall be no noise emitted from the home connected with the business which is audible to abutting residences. 7. There shall be no outdoor storage of materials, vehicles, or products on the premises. Indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the Building, Fire, Health, and Housing Codes. 8. This approval is valid if exercised within one year of the final decision date noted below. D. PROCEDURE 1.
