HOP1986-00028 • . CITY OF TIGARD NOTICE OF DECISION HOP 28 -86 APPLICATION: Request by Dan Stephenson for a Home Occupation Permit to allow an engineering consultant business (d.b.a. "Dan Stephenson, P.E. ") on property zoned R -25 (PD) (Multiple Family Residential, 25 units per acre, Planned Development). Location: 11065 SW Summerfield Drive #10 (WCTM 2S1 10DD Tax Lot 109). DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED the above application subject to certain conditions. The findings and conclusions on which the Director based her decision are as noted below. A. FINDINGS OF FACT 1. Background Information No previous applications have been received by the Planning Division with respect to the subject property. 2. Vicinity Information Immediate properties in all directions are all zoned R -25 (PD). Otherwise, properties to the east are zoned R -7 (Single Family Residential, 7 units per acre) and to the west are zoned C —G (PD) (General Commercial, Planned Development). 3. Site Information and Proposal Description There is a 702 square foot home on the property. The applicant proposes to use 84 square feet for the business. The applicant will occupy the remainder of the home. The business as proposed will not occupy more than 25% of the home. 4. Agency and NPO Comments NPO #6 will be notified of the Director's decision and will be given the right to appeal. B. ANALYSIS AND CONCLUSION The proposal meets the provisions set forth in Chapter 18.142 of the Tigard Municipal Code. C. DECISION Home Occupation Permit HOP 28 -86 is approved subject to the following conditions: 1. There shall be NO paid employees working in the home in conjunction with the business who are not residents of the home. 2. There shall be no signs or advertising visible from the exterior of the premises. NOTICE OF DECISION — HOP 28 -86 — PAGE 1 • 3. There shall be NO customers or clients coming to the residence in conjunction with the business. 4. The Home Occupation Permit shall be renewed annually. 5. A Business Tax shall be paid annually for the business. 6. There shall be no noise emitted from the home connected with the business which is audible to abutting residences. 7. There shall be no outdoor storage of materials, vehicles or products on the premises. Indoor storage of material or products shall not exceed the limitations imposed by the provisions of the Building, Fire, Health and Housing Codes. 8. This approval is valid if exercised within one year of the final decision date noted below. D. PROCEDURE 1. Final Decision: THE DECISION SHALL BE FINAL ON October 17, 1986 UNLESS AN APPEAL IS FILED. 3. For example: If your neighbor has a fire which destroys your furnishings, our fire insurance doesn't cover your loss. PLEASE MAINTAIN YOUR OWN FIRE AND THEFT IN- SURANCE FOR PERSONAL PROPERTY. 20. Management is not responsible for items left in storage facilities. 21. To a 72 -hour notice to vacate the apartment or pay your rent if you have allowed your rent to become 7 days overdue. 22. Not to sub -let, assign, nor allow anyone else to live in the apartment without first obtaining our written consent which may be withheld at our sole discretion. 23. You are responsible for ALL DAMAGES caused to the premises by your neglect or deliberate acts, or negligence or acts of people or guests under your control. BOTH OF US AGREE: 24. Either of us may terminate this agreement at any time by giving at least a sixty (60) day written notice, or as otherwise allowed by Oregon law. If you abandon the apart- ment (see no. 28 below) or if you attempt to terminate this Lease, without giving sixty (60) days prior written notice, you will remain liable for sixty (60) days rent, or until the apartment is re- rented, whichever occurs first. In addition, we may give the following notices: A. 72 -hour notice to vacate the apartment or pay your rent if you have allowed your rent to become 7 days overdue. B. 24 hour notice to move out if you, or 'someone in your control, or your pet: (a) seriously threatens immediately to inflict personal injury or inflicts any substantial personal injury, upon.the Managing Agent or other residents: (b) intentionally inflicts any substantial damage to the apartment or the premises; or (c) commits any act which is outrageous in the extreme. C. 10 -day notice to move out if you, in violation of this rental agreement, keep on the premises a pet capable of causing damage to persons or property and you refuse to remove the pet from the premises prior to the date specified in a notice to do so. D. Breaches. Notices of any violation of this Lease or of the Rules and Regulations, and any other notices provided for by Oregon law. • • 25. Time is of the essence of this agreement. Landlord reserves all of the rights and remedies it has under law and the election to invoke any one of them shall not be a waiver of any other such right or remedy.
