MLP1995-00016 • • CITY OF TIGARD NOTICE OF DECISION MINOR LAND PARTITION MLP 95 -0016 DAVIS PARTITION APPLICATION: The applicant requests Minor Land Partition for a .49 acre parcel to create three (3) lots of 6,708, 6,000 and 4,829 square feet; and a Tract A for private street purposes. Zone: Multiple Family Residential (R -12). Location: 8735 SW Spruce Street (WCTM 1S1 35AD, Tax Lot 3400). SECTION I - DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above request subject to the following Conditions of Approval. The findings and conclusions on which the decision is based are noted in Section II. CONDITIONS OF APPROVAL PRIOR TO RECORDING OF THE PARTITION PLAT MAP THE FOLLOWING CONDITION SHALL BE SATISFIED OR FINANCIALLY SECURED: 1. The applicant shall provide for roof and pavement rain drainage to the public stormwater drainage system designed to prevent runoff onto the adjacent property. An agreement shall be executed by the applicant, on forms provided by the City, which waives the property owner's right to oppose or remonstrate against a future Local Improvement District formed to improve SW Hall Blvd. or SW Spruce Street, or both. The applicant shall obtain a permit from the State of Oregon Highway Division, to perform work and discharge runoff within the right -of -way of SW Hall Blvd. A copy of the permit shall be provided to the City Engineering Department prior to issuance of a Public Improvement Permit. Three (3) sets of detailed public improvement plans and profile construction drawings shall be submitted for preliminary review to the Engineering Department. Seven (7) sets of approved drawings and one (1) itemized construction cost estimate, all prepared by a Professional Engineer, shall be submitted for final review and approval (NOTE: these plans are in addition to any drawings required by the Building Division and should only include sheets relevant to public improvements. Three (3) mylar copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. B. Copy of recorded boundary survey for site. C. The partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05) Washington County, and by the City of Tigard. D. The partition plat shall include a note prohibiting direct vehicular access to SW Hall Boulevard from Lot 3. 7. The applicant shall pay a fee in -lieu of an on -site water quality facility as required by Unified Sewerage Agency Resolution and Order No. 91-47. STAFF CONTACT: Greg Berry, Engineering Department. Before approved construction plans are issued by the City, the Applicant (subdivider) shall: (a) Execute and file an agreement with the City Engineer specifying the period within which all required improvements and repairs shall be completed; and (b) Include in the agreement provisions that if such work is not completed within the period specified, the City may complete the work and recover the full cost and expenses from the applicant. 2. The agreement shall stipulate improvement fees and deposits as may be required to be paid and may also provide for the construction of the improvements in stages and for the extension of time under specific conditions therein stated in the contract. SECTION 18.160.180 Bond 1. As required by Section 18.160.170, the applicant shall file with the agreement an assurance of performance supported by one of the following: (a) An irrevocable letter of credit executed by a financial institution authorized to transact business in the State of Oregon; (b) A surety bond executed by a surety company authorized to transact business in the State of Oregon which remains in force until the surety company is notified by the City in writing that it may be terminated; or (c) Cash. 2. The applicant shall furnish to the City Engineer an itemized improvement estimate, certified by a registered civil engineer, to assist the City Engineer in calculating the amount of the performance assurance. 3. The applicant shall not cause termination of nor allow expiration of said guarantee without having first secured written authorization from the City. NOTICE OF DECISION MLP 95 -0016 - DAVIS PARTITION PAGE 3 • • 18.164.150 Installation: Prerequisite /Permit Fee 1. No land division improvements, including sanitary sewers, storm sewers, streets, sidewalks, curbs, lighting or other requirements shall be undertaken except after the plans therefor have been approved by the City, permit fee paid and permit issued. 18.164.180 Notice to City Required 1. Work shall not begin until the City has been notified in advance. 2. If work is discontinued for any reason, it shall not be resumed until the City is notified. 18.164.200 Engineer's Certification Required 1. The applicant's engineer shall provide written certification of a form provided by the City that all improvements, workmanship and materials are in accord with current and standard engineering and construction practices, and are of high grade, prior the City acceptance of the public works improvements or any portion thereof for operation and maintenance. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE DATE OF THE FINAL DECISION. SECTION II. FINDINGS OF FACT Background: This site has been zoned R -12 since the site was annexed to the City in April of 1987. A previous Minor Land Partition was approved for this site in 1989. At that time two new lots were partitioned at both corners of the property along the SW Spruce Street frontage. Vicinity Information: The site is adjoined by areas which are zoned for residential use. Much of this area is developed with detached single - family residences. NOTICE OF DECISION MLP 95 -0016 - DAVIS PARTITION PAGE 4 • • • Site Information and Proposal Description: The site is approximately .49 acres or 21,344 square feet in size and roughly rectangular with a "flag lot" type access extension of approximately 34 feet in width to SW Spruce Street. The applicant proposes to partition the parcel into three lots for development of single family residences. Other Staff Comments The Engineering Department has reviewed this application and provided the following findings: FINDINGS: 1. Streets: Access is provided by a common driveway to SW Spruce Street; no access to SW Hall Blvd. is proposed. The frontage along SW Spruce Street, a local street, has existing right -of -way of 60 feet in width. The street is improved with an 18.5 foot paved width, but without curbs or sidewalks. SW Hall Blvd. is a major collector under ODOT jurisdiction. The frontage is improved with only a drainage ditch. Additional right -of -way to increase the width from centerline to 45 feet was provided by a previous partition. This parcel is subject to an agreement waiving the property owner's right to oppose a future Local Improvement District formed to improve SW Spruce Street and SW Hall Blvd. The parcels resulting from this partition should be subject to a similar agreement. 2. Sanitary Sewer: Sanitary sewer service is provided by extending a public line from the existing sewer in SW Spruce Street along the common driveway. 3. Storm Sewer: The applicant proposes to provide storm drainage by installing a private line from the common driveway to a ditch along SW Hall Blvd. This will require a permit from ODOT. NOTICE OF DECISION MLP 95 -0016 - DAVIS PARTITION PAGE 5 ID • Although the applicant has proposed to provide surface water treatment by a public detention pond along the north end of Lot 3, a fee in -lieu of the facility should be required. The applicant has also not demonstrated that storm water from Lots 1 and 2 will drain to a public system. The pond as proposed does not meet design standards and would place an unreasonable maintenance burden upon the City because of the small size of the site and difficulty of access. Agency Comments: The Building Department reviewed this application and stated that the proposed utility plan does not adequately demonstrate how storm drainage will be directed towards a public storm sewer system for Lots 1 and 2. The applicant shall demonstrate this prior to recordation of the preliminary plat. No other comments have been received. SECTION III. ANALYSIS AND CONCLUSION COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Minor Land Partition Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet city and applicable agency standards (Ord. 89 -06; Ord. 83 - 52). Each of the proposed parcels would exceed the 3,050 square foot minimum. The proposed parcels comply with the R -12 Zoning District. The parcels as proposed would allow the development of one (1) residential dwelling unit for Lots 1 and 2 and up to two (2) dwelling units for Lot 3. The development as proposed does not exceed the maximum residential density allowed under Chapter 18.92 for a .49 acre R -12 property. The site yields the opportunity to develop up to five (5) dwelling units after deduction of street right -of -way. Upon completion of the appeal period the development will have complied with the statutory requirements of the City of Tigard for development review as required by Criteria #2. NOTICE OF DECISION MLP 95 -0016 - DAVIS PARTITION PAGE 6 • • Adequate public facilities are available or have been required to be provided to serve this site as set forth in Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164,100 (Storm Drain) as required by Criteria #3 as reviewed within the Engineering Departments comments contained elsewhere within this report. Prior to recordation of the preliminary plat the roof and site drainage for the new residences will be directed to a public facility. The new parcels do not exceed a two and one half to one length to depth ratio. The R -12 Zoning District does not have an average width requirement. For these reasons. the proposed parcel configurations conform with size and dimensional requirements of the R- 12 Zoning District as required by Criteria #4. All proposed improvements will comply with City and applicable agency standards in satisfaction with Criteria #5 as reviewed through the Building Permit Plan Check process. Two of the newly created parcels comply with the Basic Solar Access requirements because the north - south lot dimension exceeds 90 feet in length. The remaining parcel may be exempted from compliance with the Basic Standard due to numerous existing development constraints. The development of structures on all three of the parcels will require compliance with Solar Balance Point Standards of the Community Development Code. Section 18.162.050 contains the following provisions for lots created through the partition process: A. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. B. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. C. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. D. Setbacks: Setbacks shall be as required by the applicable zoning district. E. Front Yard Determination on flag lots: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to mavimize separation from existing structures. F. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be r €: auired to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. H. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. I. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. J. Where landfill andlor development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria A, B, C, and D are satisfied. The parcels will exceed the area requirement of 3,050 square feet set forth within the R -12 Zoning District. Each newly created parcel would have in excess of 15 feet of direct frontage on a private street in satisfaction of the lot frontage requirement in Criteria C. Standards for setbacks, landscaping and clear vision requirements will be reviewed at the time of Building Permit Plan Check Review in satisfaction of Criteria D. Criteria E and F have been addressed because the proposed lots will each have in excess of 15 feet of frontage to the proposed private street tract. For this reason a flag lot setback determination is not necessary and flag lot access screening is not required. Through the Building Permit Plan Check Review fire hydrants shall be consistent with Uniform Fire Code standards thereby satisfying Criteria G. Criteria H which requires reciprocal access maintenance agreement to maintain the proposed joint access easement has been required as a Condition of Approval. Criteria I is satisfied through the requirement for construction of 20 foot wide private street to serve the three parcels. Criteria J has been met because the parcel is not located within the 100 -year flood plain, or in areas with slopes exceeding 25 percent. ANALYSIS AND CONCLUSION COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Minor Land Partition Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet city and applicable agency standards (Ord. 89 -06; Ord. 83 -52). Each of the proposed parcels would exceed the 3,050 square foot minimum. The proposed parcels comply with the R -12 Zoning District. The parcels as proposed would allow the development of one (1) residential dwelling unit for Lots 1 and 2 and up to two (2) dwelling units for Lot 3. The development as proposed does not exceed the maximum residential density allowed under Chapter 18.92 for a .49 acre R -12 property. The site yields the opportunity to develop up to five (5) dwelling units after deduction of street right -of -way. Upon completion of the appeal period the development will have complied with the statutory requirements of the City of Tigard for development review as required by Criteria #2. NOTICE OF DECISION MLP 95 -0016 - DAVIS PARTITION PAGE 6 • Adequate public facilities are available or have been required to be provided to serve this site as set forth in Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drain) as required by Criteria #3 as reviewed within the Engineering Departments comments contained elsewhere within this report. Prior to recordation of the preliminary plat the roof and site drainage for the new residences will be directed to a public facility. The new parcels do not exceed a two and one half to one length to depth ratio. The R -12 Zoning District does not have an average width requirement. For these reasons the proposed parcel configurations conform with size and dimensional requirements of the R- 12 Zoning District as required by Criteria #4. All proposed improvements will comply with City and applicable agency standards in satisfaction with Criteria #5 as reviewed through the Building Permit Plan Check process. Two of the newly created parcels comply with the Basic Solar Access requirements because the north - south lot dimension exceeds 90 feet in length. The remaining parcel may be exempted from compliance with the Basic Standard due to numerous existing development constraints. The development of structures on all three of the parcels will require compliance with Solar Balance Point Standards of the Community Development Code. Section 18.162.050 contains the following provisions for lots created through the partition process: A. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. B. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. C. Lot Frontage: Each lot created through the partition process shall front a public right -of -way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. D. Setbacks: Setbacks shall be as required by the applicable zoning district. E. Front Yard Determination on flag lots: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. F. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. H. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. I. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. J. Where landfill andlor development is allowed within or adjacent to the one - hundred -year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrianlbicycle pathway with the floodplain in accordance with the adopted pedestrianlbicycle pathway plan. Criteria A, B, C, and D are satisfied. The parcels will exceed the area requirement of 3,050 square feet set forth within the R -12 Zoning District. Each newly created parcel would have in excess of 15 feet of direct frontage on a private street in satisfaction of the lot frontage requirement in Criteria C. Standards for setbacks, landscaping and clear vision requirements will be reviewed at the time of Building Permit Plan Check Review in satisfaction of Criteria D. Criteria E and F have been addressed because the proposed lots will each have in excess of 15 feet of frontage to the proposed private street tract. For this reason a flag lot setback determination is not necessary and flag lot access screening is not required. Through the Building Permit Plan Check Review fire hydrants shall be consistent with Uniform Fire Code standards thereby satisfying Criteria G. Criteria H which requires reciprocal access maintenance agreement to maintain the proposed joint access easement has been required as a Condition of Approval. Criteria I is satisfied through the requirement for construction of 20 foot wide private street to serve the three parcels. Criteria J has been met because the parcel is not located within the 100 -year flood plain, or in areas with slopes exceeding 25 percent. Along the East side property line there will be constructed a 6 ft. sidewalk meeting ADA requirements. This will provide walking access from the back lots to the front of the street. There is no existing storm control on the property to date. We propose a storm improvement that will contain all impervious area runoff and channel it through a water quality detention structure. The flow under controlled release will outfall from this structure to an existing ditch at the north end of the property. The Traffic Impact Fee program collects fees from new development based on the development's projected impact upon the City's transportation system. Engineering has approved plans for Davis that would result in a 3 foot fill at the northwest corner lot. The reasoning for this is that existing grades (prior to development) sloped to the northwest. Davis could not obtain off -site storm easements to drain his development so now he has to fill the northwest corner to get the drainage to flow out to the east toward Hall Boulevard. Davis has obtained approval from ODOT to make the necessary storm connection. We are still reviewing proposed revised plans from Davis' engineer that would raise the northwest grade another foot (total of 4 feet of fill), along with other changes that impact the lot at the corner of Spruce and Hall. I am not so concerned about the 4 feet of fill as I am the other issue with the corner lot. My opinion about the fill is that Moon's property will not experience an increase in runoff. In fact, theoretically, it will see far less runoff than what would be experienced during pre - developed conditions (based on a 25 -year storm). a 4 -foot high difference between properties is not significant. The only runoff he could experience is from what rain water will fall on the small slope; when the slope is planted with grass, he should not see any runoff. Until that time, erosion control fences must be up and functioning to prevent sediment from leaving the Davis site. The fill will not create a dam that will impact Moon because the topography on Moon's property slopes to the northwest (away from Davis). As far as a fence goes, Moon can re- install a fence on his own property if he wants, but we can not require Davis to install a fence on his site. I would imagine that the new home owners will install a fence of their own. Moon should remember that any fence over 6 feet high will require a building permit. Spruce St. (WCTM 15135 AD Tax lot 3400) east adjoining lot. At which time he requested that I go to the city and give him drainage e ectmenient rights to out scrods my property. 14e suggested that he could furnish drainage pipe and I could install it. That time I contacted the city as well as Dr. Gene Davis, and denied access drainage rights through my property. At that time Dr. Gene Davis told me if I did not let him go through my property , he would go around my property, through my surrounding neighbors, build up the grade of his property, and I was going to flood. The second week in July Dr. Gene Davis started filling the grade of the said lots. At the current rate by the time he reaches my bordering property, at the west end, his grade will reach 4 feet above my existing ground level. Which at the lower northwest end of my lot is already bad water drainage problems, which increased dramatically when the state built the adult foster care home. Raising their grade by 1 foot,and dry welling roof and surface water on north back side of there property, resulting in 2 inches of standing water and river running water through my property. At which time I complained to the city of Tigard which fell on deaf ears. If the city of Tigard plans to let 1)avis continue his reckless building and constructions habits, I will be forced into holding the city of Tigard responsible. If Dr. Gene Davis needs to build his current grade to such heights, I feel that there should be in place a retaining wall barrier to hold back" fill " and "water ". I also will be losing my privacy fence which borders our property, and feel that this section of fencing should maintain my right to a 6 foot privacy fence. Placing this section on top of the new filled grade. Final plat map has been reviewed and returned to the surveyor for correction and we are awaiting the submittal of the mylar copies of the plat for signature. 2. On 6/24/96, we issued ENG 96 -0030 to the Davis' to allow them to install their public improvements as required by the MLP approval. All necessary fees were paid ($ 764.00) and surety was secured through the Davis' insurance company. 3. Mrs. Davis has requested that they be allowed to start one house in the 3 -lot partition under the argument "we have one lot already, so we should be able to build one house ". Although I do not agree with that argument, I told her that I would consider signing off for one building permit under the following conditions: a. All utility work permitted under ENG 96 -0030, except for maybe the finishing of the driveway, shall be completed and inspected for compliance. b. The final plat needs to be signed by the City. c. Her surveyor will need to stake the new property corners of the lot she wishes to build on (this is to ensure the house gets placed in the right spot). 4. Soon after we issued ENG 96 -0030, the Davis' engineer submitted a proposed revision to the site plan that included grade changes that raised a concern. The raising of grades appears to cut off drainage from the house at the corner of Spruce and Hall. We have not approved the revised plan yet because we are working with Davis' engineer to resolve the issue. Regarding the list of items requested by the "Concerned Neighbors ", I do not feel compelled, nor do I consider it a priority, to produce copies of the material and send it out to everyone within 250 feet. The material they are concerned about is public record, and they can come to the office to review it if they want. If they want copies, they can pay for them. I would be very surprised if all neighbors within 250 feet are as concerned as the party(ies) who instigated this letter. With total disregard for other property owners rights the Davis's have started the illegal construction of the improvements for three lots in which the City of Tigard has granted Conditional Approval. Mr. Davis who holds himself out to be a Christian has threatened three of the neighbors. The police were contacted and dispatched July 12, 1996 due to his actions. Mr. Davis has a long history of threats and actions in total disregard to the City and his neighbors. We have extreme concern for the safety of the neighborhood. We find no evidence of any compliance to the requirements that were placed on the Davis' by the City of Tigard Minor Land Partition MLP 95 -0016. In the event the City continues to allow the illegal actions of Davis to continue and we sustain damages we will hold the City of Tigard responsible. To be specific we find no evidence that "PRIOR TO RECORDING OF THE PLAT MAP" any of the Conditions of Approval have been completed. We have found evidence that Davis has illegally begun sewer, water, gas and electric improvements and placing unimproved fill material, without satisfying the Conditions of Approval. The City of Tigard should require the illegal improvements be removed or provide proof of approved stamped engineered drawings, and all inspection reports. We formally ask for certified, dated copies of the above. We formally ask for certified copies of the satisfaction of items 1, 2, 3, 4, 5, 6, 7 of the MLP 95 -0016. We formally ask for a copy of the Improvement Agreement and the Bond and /or proof of a cash deposit. We formally ask for proof of that all City fees have been paid. We formally ask for proof of the Notice to the City of work is to begin. We formally ask for a Copy of the Certified Improvement Estimate. We formally ask for a copy of a Tree removal permit, ref. Section 18.150.20 • • In the event the City of Tigard can not provide certified copies of all of the items, Davis is in violation of Section 18.164.150. Findings: 1. Streets: Access is provided by a common driveway to SW Spruce Street; no access to SW Hall Blvd. is proposed. The frontage along SW Spruce Street, a local street, has existing right -of -way of 60 feet in width. The street is improved with an 18.5 foot paved width, but without curbs or sidewalks. SW Hall Blvd. is a major collector under ODOT jurisdiction. The frontage is improved with only a drainage ditch. Additional right -of -way to increase the width from centerline to 45 feet was provided by a previous partition. This parcel is subject to an agreement waiving the property owner's right to oppose a future Local Improvement District formed to improve SW Spruce Street and SW Hall Blvd. The parcels resulting from this partition should be subject to a similar agreement. 2. Sanitary Sewer: Sanitary sewer service is provided by extending a public line from the existing sewer in SW Spruce Street along the common driveway. 3. Storm Sewer: The applicant proposes to provide storm drainage by installing a private line from the common driveway to a ditch along SW Hall Blvd. This will require a permit from ODOT. Although the applicant has proposed to provide surface water treatment by a public detention pond along the north end of Lot 3, a fee in -lieu of the facility should be required. Before approved construction plans are issued by the City, the Applicant (subdivider) shall: 1. Include in the agreement provisions that if such work is not completed within the period specified, the City may complete the work and recover the full cost and expenses from the applicant. B. SECTION 18.160.180 Bond A. As required by Section 18.160.170, the applicant shall file with the agreement an assurance of performance supported by one of the following: 1. An irrevocable letter of credit executed by a financial institution authorized to transact business in the State of Oregon; 2. A surety bond executed by a surety company authorized to transact business in the State of Oregon which remains in force until the surety company is notified by the City in writing that it may be terminated; or 3. Cash. B. If work is discontinued for any reason, it shall not be resumed until the City is notified. F. 18.164.200 Engineer's Certification Required 1. The applicant's engineer shall provide written certification of a form provided by the City that all improvements, workmanship and materials are in accord with current and standard engineering and construction practices, and are of high grade, prior the City acceptance of the public works improvements or any portion thereof for operation and maintenance.
