A new roof top air conditioner will be installed with screening. The C-G zoning district is designed to accommodate a full range of retail, office and civic uses with a City-wide and even regional trade area. Except where non-conforming, residential uses are limited to single-family residences which are located on the same site as a permitted use. A wide range of uses, including but not limited to adult entertainment, automotive equipment repair and storage, mini-warehouses, utilities, heliports, medical centers, major event entertainment, and gasoline stations, are permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.360, 18.390, 18.520 and 18.745, 18.765, and 18.790. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. MMD2010-00006 TVF&R Generators and RTAC Decision 041210 Page 1 CONDITIONS OF APPROVAL PRIOR TO THE REQUEST FOR FINAL BUILDING INSPECTION, THE FOLLOWING CONDITIONS SHALL BE SATISFIED 1. Applicant shall request final inspection of this land use permit by the Planning Division prior to requesting final inspection by the Building Division for certificate of occupancy. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcel is located at 11945 SW 70`" Ave., WCTN1 2S136DC, Tax Lot 04400. The primary building and site were approved under SDR2006-10001 as an office building. The primary building will be occupied by TVF&R for offices and emergency operations center. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: Section 18.360.050.B contains the following criteria for approval of a request for Minor Modification: Section 18.360.050.B states that the Director shall determine that a major modification will result if one or more of the following changes are proposed. There will be: 1. An increase in dwelling unit density, or lot coverage for residential development; There are no dwelling units on the property. Therefore, this criterion does not apply. 2. A change in the ratio or number of different types of dwellings; There are no dwelling units on the property. Therefore, this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposal does not require additional on-site parking. There are 128 parking spaces on the site and 11 will be removed, leaving 117 spaces, 15 more than the 102 required. Therefore, this criterion is satisfied. A change in the type of commercial or industrial structures as defined by the Uniform Building Code; There are no proposed changes in the type of structures. Therefore, this criterion does not apply. 5. An increase in the height of the building(s) by more than 20%; There is no proposed change in building height. Therefore, this criterion does not apply. 6. A change in the type and location of access ways and parking areas where off-site traffic would be affected; The proposal does not change the type or location of access ways or parking areas where off- site traffic would be affected. Therefore, this criterion does not apply. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day; The proposal does not increase traffic to and from the site. Therefore, this criterion is satisfied. 8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet; The proposal does not involve an increase in floor area more than 10% and is less than 5,000 sq. ft. Therefore, this criterion is satisfied. 9. A reduction in the area reserved for common space and/or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10%; The proposal does not reduce the area reserved for common space or usable open space. Therefore, this criterion does not apply. 10. A reduction of project amenities below the minimum established by this code or by more than 10% where specified in the site plan: a. Recreational facilities; b. Screening; and/or c. Landscaping provisions. The proposal will result in a net gain of 122 sq. ft. of landscaping. This criterion is satisfied. 11. A modification to the conditions imposed at the time of site development review approval which are not the subject of B 1 through 10 above of this subsection. The proposal involves re-locating 4 mitigation trees required in SDR2006-10001 as shown on the approved site plan. Eleven parking spaces will be replaced by the generator enclosure, landscaping and loading space. Net parking requirements exceed the 102 minimum by 15. This criterion is satisfied. FINDING: Based on the analysis above, Staff finds that the criteria for minor modification of a site development have been met. The use is public facility/commercial office. The facility is currently being seismically upgraded to Type IV Essential Facilities structural standards. Part of the upgrade is the future installation of two ground mounted diesel generators and a rooftop unit to make the facility independently operable in a seismic or other catastrophic event. The two generators and its related above ground fuel tank will be located in a screened enclosure west of the existing structure in the middle of the west parking lot. Seven parking spaces will be lost but the facility has adequate minimum parking without these spaces. There are 128 total existing spaces, with 117 remaining after the enclosure is built. The minimum number of spaces required is 102. The enclosure will have pre-finished metal siding of a dark bronze color and have a 26'-0" x 65'-0" footprint (1,690 SF). The total lot coverage percentage will not change as the location is already paved. The Cummins generators will have sound rated enclosures to dampen the motor noise. The enclosure shall reduce the sound level of the generator set while operating at full rated load to a maximum of 66 dBA at any location 7 meters from the generator set in a free field environment. The enclosure will also increase the noise dampening effect. The enclosure will displace 544 square feet of landscaping. TVF&R is adding 680 square feet of new landscaping, resulting in a surplus area of 136 square feet more than the existing SF which exceeds the required minimum. The existing trees will be relocated to the new landscape areas (see attached revised plan). Part of the site security will include a vertical pivoting gate on the north side of the building isolating the westerly parking lot from public access. The gate is made of painted black aluminum and matches the existing ornamental fencing on the site. The gate is 25'-0" wide and 8'-0" high. The security gate will be in an open position during normal business hours Monday through Friday. The gate will only be lowered at night for security of stored TVF&R staff vehicles. No staff is required to park there for their normal business operations and only staff vehicles being stored on site overnight will located in the secure area. The public is allowed to park there during normal business hours. The existing parking lot illumination will be maintained on the west side of the west parking lot with the addition of two additional lighting fixtures on the west face of the generator enclosure. The fixtures will be indirect wall mounted wall packs with 100 watt metal halide lamps with no light spillage or glare to the adjacent properties. (Fixture cut attached) The roof will receive a second 30 ton air handler which will be fully screened with a unit mounted screen system. The screen system will match the existing screen system on the existing air handling unit and be by Cityscapes. The unit is 7'-10" wide x 4'-10" high x 24'-0" long. There is one 5 foot long section that is 7'-10" high. This second unit is required for operational redundancy and backup for emergency operations. One internal parking lot light will be removed and replaced to provide even internal light coverage with no light spillage to adjacent properties.
