The MUC-1 zoning district, which is designed to apply to that portion of the Durham Quarry site within the City of Tigard, is a mixed -use commercial district bounded by 72nd Avenue, Findlay Street and the Tigard, Tualatin and Durham city limits. This site is the subject of an intergovernmental agreement between the cities of Tigard and Tualatin. Pursuant to that agreement the City of Tualatin shall furnish all planning, building and associated development review /permit services for the property with the exception of sign permits. This zoning district is intended to mirror the City of Tualatin's Mixed Use Commercial Overlay District (TDC, Chapter 57). It permits a wide range of uses including commercial lodging, general retail, offices and housing. Additional uses, Including but not limited to major event entertainment and motor vehicle retail fuel sales, are permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.370, 18.385, 18.390, 18.520 and 18.780. SECTION II. The applicant shall ensure that the following parameters are followed for any sign illumination: A. Surface brightness. The surface brightness of any sign shall not exceed that pp roduced by the diffused output obtained from 800 milliampere fluorescent li sources spaced not closer than eight inches, center on center. B. No exposed incandescent lamps. Any exposed incandescent lamp which exceeds 25 watts shall not be used on the exterior surface of any sign so as to expose the face of such bulb or lamp to any public street or public right-of- way with the exception of electronic information signs. • 2. Provide a copy of this decision with your sign permit application. SECTION III. BACKGROUND INFORMATION Site HistoT, This site is part of the Durham Quarry special district. That district was established through amendments to the zoning map and comprehensive , plan and ultimately designated as the MUC -1 zone. A predominant portion of the MUC -1 zone is in the City of Tualatin, with only a single parcel lying within Tigard. Through an intergovernmental agreement, the City of Tualatin is responsible for reviewing land use proposals for this district. The Bridgeport Village project was approved on an appeal to the Tualatin City Council. That decision is final. The intergovernmental agreement stated that following the initial review, subsequent approvals, including sign permits, would be the responsibility of the corresponding jurisdiction. When Tualatin reviewed the proposed design for the Regal Cinemas, the height of the tower element on the building was an issue, and through the decision was required to be lowered to 70 feet That review did not consider the signage that was to be placed on the tower. While Tualatin's sign code would permit such a sign, Tigard's sign code prohibits signs above the roof line. Vicinity Information: The site is located on the west side of Interstate 5, at the intersection of SW Bridgeport Road and. SW 72 " Avenue. To the south is City of Tualatin, to the west is the City of Durham. To the north are Tigard industrial uses and to the east are commercial retail uses. There are two single family homes to the northwest of the site that Immediately are adjacent to this site. Proposal Description; The applicant is seeking to obtain a variance to the limitations against placement of wall signs above the roof line. This is in part due to the unusual placement of the building and its orientation to the site, as well as to accomplish a specific design theme that is intended to complement the architectural elements of the building. The sign will be placed on the tower element and extend approximately 15 feet above the roof line. Because the sign code exception criteria do not address this particular type of deviation from the sign standards, a standard variance is required. VAR2005.00025 - REGAL CINEMAS SIGN ADJUSTMENT PAGE 2 OF 7 04/27/2005 09:21 5036243681 TIGARD BUILDING DEPT PAGE 04/10 SECTION IV. PUBLIC COMMENTS Several phone inquiries were received, generally having to do with the overall Bridgeport Project and not specifically the proposed sign. Some neighbors to the southwest worried that they would be able to see the sign. One owner of commercial property noted that the sign may direct people to park on his property and use the pedestrian cut through to get to the theatre. Three letters were received from Roland Signett (City Administrator for the City of Durham), Patricia Saab, and James Church. These letters raise the following general issues: 1) The neon sign projecting 20' to 30' above adjacent buildings is out of character with other signage and the architecture of the project The building design and pylon, to which the sign is attached, was approved by the Tualatin Design Review Board. Mlle Tualatin's Design Review Board did not approve the sign attached to the pylon, the drawings that they reviewed included this signage. There was no discussion regarding a need to limit or reduce the height of the proposed letters. The applicant further notes that both the owner and developer of the Bridgeport Village are in support of the proposed signage. 2) The sign appears to serve no purpose in attracting casual passersby as it is not clearly visible from either SW Bridgeport Road or SW 72 Ave. The sign serves as an apex to the visual corridor in the Bridgeport Village design. Bridgeport Village is coined a "Lifestyle Center" with entertainment uses a. cornerstone of this particular product. The Regal Cinemas building is emphasized by its placement at the end of the vista, with the sign pylon to signify the node. Similar to a clocktower, it draws the viewer's attention and helps identify a place to gather. Could this be achieved without signage? Indeed, but it loses its significance and ability to communicate the purpose of both the pylon and the main building to which it is attached without some sort of message as to what is contained in the building. 3) The largest concern is with light spillover to other Immediate properties. If approved, there should be no reflective surface behind the letters or to the side that . would cause additional light dispersal. If possible the light should be shielded so that It is only visible to the south driveway approach. Tigard's sign code contains the following restrictions with regard to lighting levels: Surface brightness. The applicant shall be so advised. How are residents going to be able to sleep or to have peaceful enjoyment of their homes? It is circumstances such as this that may be covered by Measure 37. It Is important that the scope of this variance be considered. Between what is presently allowed, and what is proposed, the difference is the addition of three letters. It is beyond reason to assume that this will have any effect to property values. By requiring the lighting levels of the sign to meet the standards described previously, there should be no glare onto adjacent properties that would Impact peaceful enjoyment of their homes. Also, Measure 37 only applies to limitations on uses of your own property, not what is permitted on an adjacent parcel. In fact, the opposite may be true; the applicant may have a Measure 37 claim against Tigard since the restrictions on signage were not put into effect until after the property was purchased. SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS VARIANCES AND ADJUSTMENTS: The Director shall approve approve with conditions, or deny an application for a variance based on finding that the following criteria are satisfied: a. The proposed variance will not be materially detrimental to the purposes of this title, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity; The applicant notes that the intent of the purpose for the signage code is to maintain reasonable signage size and prevent signs from exceeding the maximum building height in the zone. Staff adds that another aspect of the restriction on signs projecting above the roof line is to prevent the situation of each business attempting to overshadow the businesses in front or behind them. This was more common in the past, and the result was a clutter of roof signs extending ever higher along the skyline. In this particular case, the entire complex has been designed as a complementary array of styles and signage that were designed to work In concert with each other: The applicant states that the sign in this case is attached to an architectural pylon constructed under the City of Tualatin building permit and which met the final approved height through the architectural review board. The architectural pylon is integral to the design of the Cinema building and the greater Bridgeport Village. Other properties in the vicinity, most notably to the south (the direction the sign is oriented) are retail commercial impacted and will not be mpacted by the sign height. Residential properties are at a vantage point that from which the sign will not be visible. As a result, it is determined that this is an unusual case resulting from a design established through an agreed upon process and code. There is no evidence that granting the variance would be detrimental to other properties. This zone applies only to the Bridgeport Village project and likewise, these particular circumstances only apply to this project. b. There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; The special circumstance in this case is the fact that this project was approved through an intergovernmental agreement between Tigard and Tualatin. Following Tualatin's design approval (which did not approve signage) another intergovernmental agreement was signed to clarify what jurisdiction would be responsible for future land use and signage reviews. The applicant has submitted a letter from the City of Tualatin that explains that the signage as proposed would meet the City of Tualatin's sign code restrictions. Should the applicant been aware earlier on in the process, perhaps a completely different approach to the building element or design would have been proposed. Unfortunately, this VAR2005.00025 - REGAL CINEMAS SIGN ADJUSTMENT PAGE 4 OF 7 04/2 09:21 5036243681 TIGARD BUILDING DEPT PAGE 06/10 could not have been made apparent to the applicant since the controlling regulations for signage had not yet been assigned. The applicant had no control over the change in the requirements that occurred in the midst of the development approval process. While the change would affect all other properties in the same zoning district, this property is the only MUC -1 zoned parcel in the City. Other MUC -1 parcels are under the City of Tualatin's jurisdiction. c. The use proposed will be the same as permitted under this title and City standards wilt be maintained to the greatest extent that is reasonably possible while permitting reasonable economic use of the land; There is no exception to the proposed use. Indoor entertainment is an outright permitted use in the MUC -1 zone. City standards, apart from the limited exception afforded for three of the five letters in the proposed sign, will continue to be met. The building height will not be exceeded. d. Existing physical and natural systems such as but not limited to traffic, drainage dramatic land forms or parks will not be be affected any more than would occur if the development were developed as specified In the title; and The installation of a sign in the proposed location will have no effect on traffic, since traffic will only see the sign once travelers enter the Bridgeport Village site. There will be no effect on drainage, since storm water will not be impeded by the signage and all runoff will be conveyed via the approved drainage system in the development. There are no dramatic land forms or parks identified nearby that would be influenced by this sign variance. e. The hardship is not self - imposed and the variance requested is the minimum variance which would alleviate the hardship. As discussed previously, the applicant is subject to this special circumstance due to a handoff of 1'unsdictional review from Tualatin to Tigard. This is not a self imposed hardship. The request will result in a sign that is the same as what was presented to the public during the Design Review for the cinemas. Although the sign was not approved during that review, the other elements of the building's design were created and the sign developed as an integrated package. The requested variance will allow a minor extension of the proposed sign above the roof line, that will be partially mitigated for by the fact that the sign is on one side of the pylon extension, faces interior to the project, and is below the uppermost part of the pylon. C OpMME LAL, ZONE STAND RDS: hapter 18.520 specifies the base zone requirements for the MUC -1 Zone. The proposed use, indoor entertainment, is a permitted use in the MUC -1 zone, per Section 18.520.030. VAR2005-00025 - REGAL CINEMAS SIGN ADJUSTMENT PAGE 5 OF 7 • • 04/77/2005 09:21 5036243681 TIGARD BUILDING DEPT PAGE 07/10 The proposed sign is located toward the rear of the Bridgeport Village project, but in the front of the cinema building. The pinnacle of the building pylon is 70 feet tall. The sign, while not specifically subject to the building height limitations in the zone, will nevertheless be 5 feet shorter than the maximum height allowed for buildings in this zone. No other aspects of the site will be affected by the proposal. A large extensive front facade could have been created to increase the height of the roofline, and would permit such a sign, yet the design of such a conforming facade would have questionable aesthetic appeal. SIGNS: Chapter 18.780 specifies the types of signs and the restrictions for their placement . and design. Signs in the MUC-1 Zone are subject to the same sign requirements as signs in the C-0 zone. Section 18.780.130.C.2 permits wall signs subject to the following standards: 2. Wall Signs: (a) Wall signs, including illuminated reader- boards, may be erected or maintained but shall not exceed in gross area 15 percent of any building face on which the sign is to be mounted; (b) Wall signs may not project more than 18 inches from the wall or extend above the wall to which they are attached; and (c) If it is determined under the development review process that the wall sign's visual appeal and overall design quality would be served, an additional 50% of the allowable sign area may be permitted. No copy will be permitted, however, in the additional area permitted. For purposes of this subsection, "copy" includes symbols, logos, and letters. The proposed sign and associated additional signs do not even approach the 15% of the wall area limitation. The letters on the sign will not project more than 6 inches, but will extend above the wall to which it is attached. That particular provision is the subject of this variance. No additional sign area is being requested as part of this application. SECTION VI. OTHER STAFF COMMENTS No staff comments were received. SECTION VII. AGENCY COMMENTS No comments from other agencies were received. A letter from the City of Durham was received and is discussed under public comments at the beginning of this decision. SECTION VIII.
