Tax Lot 1200 is approximately 33,009 square feet and Tax Lot 1201 is approximately 233,329 square feet. The combined area proposed for annexation is approximately 6.12 acres. Both tax lots are located to the north of SW Bull Mountain Road, at its intersection with SW Roshaks Road. Tax Lot 1201 abuts SW Bull Mountain Road and Tax Lot 1200 is adjacent and to the north of Tax Lot 1201. The current Washington County zoning for the parcels is R-15, Residential. Upon annexation, both tax lots will be converted to the City of Tigard zoning designation of R- 7, Residential, Medium Density. Applications for 3-lot partitions have been submitted for each of the two tax lots, for a total of six new tax lots in the annexation area. The City of Tigard requires the development site plan to indicate what the potential full build-out of the site could be under the R-7 zone. A "shadow plat" was created to show how a total of 30 new lots could be built, although the applicant is only applying for the creation of six lots. Existing Site Conditions Tax Lot 1201: The vegetation of Tax lot 1201 is dominated by pasture grasses, brush, and a few scattered trees. There is one existing building (an old shed proposed for demolition). There are no natural hazards or environmental overlays associated with Tax Lot 1201. The site topography is gently sloping from the southeast to the northwest. The estimated average percent slope, as measured perpendicular to contour intervals for Tax Lot 1201 is approximately 5%. Existing Site Conditions Tax Lot 1200: The vegetation of Tax lot 1200 is dominated by coniferous and deciduous trees. There are no existing buildings on the tax lot. There are no environmental overlays associated with Tax Lot 1200. The site topography is sloping from the southeast to the northwest. There are steep slopes (defined by the Tigard Development Code as >25%) on the subject tax lot. APPLICANT'S RESPONSE: The applicable Comprehensive Plan policies are addressed below and have been satisfied. City of Tigard Comprehensive Plan Policies for Annexation (Section 10.1 Annexation of Land) 10.1.1 Prior to the annexation of land to the City of Tigard: a. The City shall review each of the following services as to adequate capacity, or such services to be made available, to serve the parcel if developed to the most intense use allowed, and will not significantly reduce the level of services available to developed and undeveloped land within the City of Tigard. The services are: 1. Water; APPLICANT'S RESPONSE: There is adequate water supply to serve the annexation area if developed to the most intense use allowed. There is an existing water main along SW Bull Mountain Road. According to the Water Department, there is adequate pressure and flow to serve the site. An eight inch main and five fire hydrants are proposed to service the annexation area. Additionally, a new distribution water line will be constructed to service the three new proposed lots in the partition of Tax Lot 1200. SW Bull Mountain Road Annexation Page 2 2S1 08AB Tax Lot 1200 and 1201 • Has required by the City, the entire system has been designed to serve the number of lots allowed to be created under zoning standards (the most intense use of the land), although the applicant is only applying for six lots at this time. 2. Sewer; APPLICANT'S RESPONSE: There is adequate sewerage to service the proposed annexation area. A sanitary sewer mainline is proposed to gravity drain from south to north within the proposed public road of Tax Lot 1201. The mainline is proposed to continue north through Tax Lot 1200, approximately seven feet from the west property line. The proposed line continues north through the adjacent park and eventually connects to an existing sanitary sewer manhole on SW 156th Terrace. The City has required the system be designed for the most intense use allowed by zoning of the land. The system has been designed to accommodate up to 30 lots, although the applicant is only applying for six lots at this time. 3. Drainage; APPLICANT'S RESPONSE: There are no drainageways/creeks in the annexation area. The preliminary storm water design has been designed to collect, treat, and discharge storm water from the site. For purposes of storm water calculations, a preliminary storm water report defined the project site to be analyzed for ultimate build-out. Pre-developed and post-developed areas have been calculated and detailed in the preliminary storm water report submitted for review with the two partition applications. The preliminary design collects the storm water in a series of catch basins and ditch inlets, and distributes the storm water into a network of pipes sized to carry the storm water. In discussion with City staff, a storm water vault would be accepted and used to treat the collected storm water from the site and then discharge into the natural vegetated drainage swale it currently drains into. An overflow by-pass system has been included in the preliminary design to take large storm events around the vault system per City of Tigard and Clean Water Services. The current storm water drains into the existing vegetated swale located at the northeast corner of the site and transverses toward and through the undeveloped park directly to the north. The impacts to the storm water drainage system are minimal and designed to current City and Clean Water Services standards. Streets; APPLICANT'S RESPONSE: As Tax Lot 1200 and 1201 are contiguous, the applicant is providing a master plan indicating street connections to adjacent parcels. As proposed, a public street will extend from SW Bull Mountain Road to the north through the middle of Tax Lot 1201. The public street is proposed to have a large circular turnaround area with connections proposed to the east and north. The street proposed to the north of the turnaround will serve the three lots being created on Tax Lot 1200. The street proposed to the east is a 54' wide easement for future public right-of-way to provide connectivity to any future development to the east. A Traffic Circulation Plan has been designed for future street connections over adjacent lots to ensure the proposed connections are viable. Approval of the street system from the Tualatin Valley Fire & Rescue and Pride Disposal has been obtained. 5. Police; APPLICANT'S RESPONSE: The City of Tigard Police Chief has reviewed the proposed site plan for the development. The City of Tigard Planning staff has indicated they will work directly with the Police Chief for service provision to the annexation area. 6. Fire Protection. APPLICANT'S RESPONSE: Tualatin Valley Fire & Rescue has reviewed the submitted subdivision site plan and indicated personnel and equipment can responds to an emergency incident and implement actions as may be necessary for fire and/or rescue operations. b. If required by an adopted capital improvements program ordinance, the applicant shall sign and record with Washington County a Nonremonstrance Agreement... APPLICANT'S RESPONSE: Does not apply. The applicant is not aware of any requirements for a Nonremonstrance Agreement in an adopted capital improvements program ordinance for Local Improvement Districts for extension of services or for the formation of a special district for services. The City shall provide Urban Services to areas within the Tigard Urban Planning Area of with the Urban Growth Boundary upon Annexation. APPLICANT'S RESPONSE: The area of proposed annexation is within the Tigard Urban Planning Area of the Urban Growth Boundary and will receive urban services upon annexation. 10.1.2 Approval of proposed Annexations of land by the City shall be based on findings with respect to the following: a. The annexation eliminates an existing "pocket" or "island" of unincorporated territory; or b. The annexation will not create an irregular boundary that makes it difficult for the police in an emergency situation to determine whether the parcel is within or outside the City; c. The Police Department has commented upon the Annexation; d. The land is located within the Tigard Urban Planning Area and is contiguous to the City boundary; e. The annexation can be accommodated by the services listed in 10.1.1(a). APPLICANT'S RESPONSE: The City of Tigard Planning Department requires the area to be annexed into the City. The annexation area does not eliminate an existing "pocket" or "island" of unincorporated territory. The annexation will not make it difficult for the police to determine whether the parcel is within or outside of the City. The Police Department has received a copy of the proposed development. The land is located within the Tigard Urban Planning Area. The annexation area can be accommodated by the services listed in 10.1.1(a), as previous discussed above. 10.1.3 Upon Annexation of Land into the City which carries a Washington County zoning designation, the City of Tigard Shall assign the City of Tigard zoning district designation which most closely conforms to the County zoning designation. APPLICANT'S RESPONSE: The current Washington County zoning for the parcels is R-15, Residential. Upon annexation, both tax lots will be converted to the City of Tigard zoning designation of R-7, Residential, Medium Density.
