APPLICATION SUMMARY FILE NAME: CROSS REAR YARD SETBACK VARIANCE CASE NO.: Variance (VAR) VAR2006-00090 PROPOSAL: The applicants request approval for a Variance to the rear yard setback requirement of 15 ft in an R-7 zone. The applicants propose a 40% reduction to 9 ft. The variance would allow the applicants to build a 144-sq. ft. (12 ft. by 12 ft.) garden room addition at the rear of the house. APPLICANT: Malcom A. & Marcia L. Cross 8317 SW Char Court Tigard, OR 97224 OWNER: Same as Applicant LOCATION: 8317 SW Char Court; Washington County Tax Map 2S102DD, Tax Lot 3200. ZONE: R-7: Medium Density Residential District. The R-7 zoning district is designed to accommodate attached single-family homes, detached single-family homes with or without accessory residential units, at a minimum lot size of 5,000 square feet, and duplexes, at a minimum lot size of 10,000 square feet. Mobile home parks and subdivisions are also permitted outright. Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.370,18.390 and 18.510. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. BACKGROUND INFORMATION Site and Vicini Information: The subject property is art of the Finley Park Subdivision, located just east of the intersection of SW Hall Blvd and SW McDonald Street. The 7,220-sgcare foot property is adjacent to the Fanno Creek Trail. The north and east side of the property abut City-owned property. There is a pedestrian easement and a sanitary sewer easement along the east side of the property. Site History: Finley Park Subdivision was approved in 1993 (SUB93-00006). There have been no land use decisions related to the subject property since. SECTION IV. APPLICATION SUMMARY The applicants request a variance to the rear setback requirement of 15 ft in an R-7 zone. While a 20% reduction to 12 ft is possible by applying for an adjustment, the applicants propose a 40% reduction to 9 ft. The variance would allow the applicants to build a 144-sq ft (12 ft by 12 ft) garden room addition at the rear of the house. The applicants argue that the property is irregular in shape and short in depth compared to typical properties in the surrounding area. In addition, pedestrian and utility easements on the property limit the placement of an addition to the rear of the house. The applicants propose to remove the existing 172-sq ft (roughly 14 ft x 14 ft) deck, which is larger than the proposed addition but not subject to the same rear setback requirements. SECTION V. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET Staff notified property owners within 500 feet of the subject property and received one comment in support of the variance request. Nancy Davis, who owns the residential property on Dee Ann Court directly west of the subject property, writes that the lot is odd-shaped and the variance requested seems appropriate. She adds that the Cposs s take good care of their property, enhancing the neighborhood and experience of those walking along the path by Fanno Creek. Staff has considered the odd shape of the lot in this decision. SECTION VI. APPLICABLE REVIEW CRITERIA AND FINDINGS VARIANCES AND ADJUSTMENTS: Section 18.370.010 states that the Director shall a pprove, approve with conditions, or deny an application for a variance based on finding that the foIlowing criteria are satisfied: a. The proposed variance will not be materially detrimental to the purposes of this title, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity, The proposed variance will not be materially detrimental to the purposes of this title, to any other applicable policies and standards and to other properties in the same zoning district or vicinity for the following reasons (discussed furs r in this decision): special circumstances exist that do not apply to other properties in the same zone; the use will not change; the subject property complies with all other development standards; and the variance requested is the minimum to alleviate the hardship. b. There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; NOTICE OF TYPE II DECISION VAR2006-00090 CROSS REAR SETBACK VARIANCE PAGE 2 OF 4 The special circumstances th- t in this case are the short depth of *t, the irregular shape of the lot and a pedestrian easement and sanitary sewer easement that prohibit development on the east side of the property. The subject property is 80 feet long, but if it was 90 feet long as is the typical property in the zone, the proposed addition would not require a variance. In addition, the location o the house and easements limit the placement of the addition to the rear and front of the house. To avoid encroaching into the front setback, a variance for which is unlikely, the only choice is to build the addition at the rear of the house. C. The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while pernutting reasonable economic use of the land; The garden room addition is for single-family residential use only. Therefore, the use proposed will be the same as permitted under this title. In addition, City standards will be maintained to the greatest extent possible while permitting reasonable economic use o} the land. While the requested variance will result in less than the standard setback with an adjustment, the subject property will comply with all other development standards. The result will also e different from that of a reduced rear setback on a typical property in the same zone. Because the subject prope is adjacent to a City-owned open space tract, there is no adjacent home that would be affected by the re du rty ced setback d. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were developed as specified in the title; andy The requested variance will not impact traffic, dramatic landforms or parks, and will have little effect on drainage or existing physical and natural systems. The variance would result in an additional 144 square feet of impervious surface, causing a 2% increase in the building footprint d impervious surface on the site. The property still exceeds the minimum landscaping requirement of 200%anwith Landscaping covering roughly 67 to 68-0/6 of the site. With an adjustment, but not a variance, the owners are permitted to build an addition that is 36 sq feet smaller than the proposed addition. Lastly, the special circumstances limit the property to well below the permitted maximum lot coverage of 80%. Lot coverage of the subject property is currently 29% and would be 32% with the variance. Therefore, the proposed variance will not adversely affect the above-mentioned systems more than if it were developed as specified in the title. e. The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. The hardship is not self-imposed because the lot is shorter than the typical lot in the zone and the shape of the lot and easements limit the placement of the addition to the rear of the house. The variance requested is the minimum variance which would alleviate the hardship. The owners initially wanted to cover and screen the existing deck to be protected from insects in the summer. After researching designs, they found that the best solution would be a patio room designed by Champion. This 12 ft by 12 gt room is designed in 4 four- foot sections, which is the smallest that would allow a table and chairs. FINDING: Based on the analysis above, the Variance criteria have been met. SECTION VII. OTHER STAFF COMMENTS The City of Tigard Building Department has reviewed the proposal and has no objections. The City of Tigard Police Department has been given the opportunity to comment but did not provide comments. The City of Tigard Public Works Department has been given the opportunity to comment but did not provide comments. SECTION VIII. AGENCY COMMENTS Staff did not request comments from non-City agencies. (see exhibit B) The variance requested is a reduction of the 15 foot (R-7) setback from the rear (north) property line. It should be noted that the adjoining property (Tract "C" on exhibit C) is open space owned by the City of Tigard. There are no structures on this property, nor will there be in the future. Narrative demonstrating compliance with Development standards 18.370.10 C. Approval process and standards. a. The proposed variance will not be materially detrimental to the purposes of this title, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity. The proposed variance will not be detrimental to any property in the area. The immediately adjacent property is publicly owned (and partially maintained by the petitioners). {see exhibit A) There is no structure (nor will there be a structure in the future) on the lot adjacent to where the variance in requested. The public enjoys access to a path which partially crosses our property on the east side. On the north side of our house (where the variance is requested) the public path runs in a north south direction and does not cross our property. The proposed structure will be 28 square feet smaller than the deck which it replaces. {see exhibit B) It will also be at least 2 feet further from the public path. (The distance to the path from the deck currently is 22 feet to the north and about 36 feet to the east. With the proposed structure, the distance to the path will be 24 feet to the north and about 38 feet to the east.) There are no utility rights-of-way on the north side of the house where the addition is proposed. The new room will not require any sewer hook-up or new utility access. The lot is 7220 sq. ft. and the current use breaks down as follows: (1) Landscaping 4860 sq. ft. 67% (2) Impervious surface 2120 sq. ft. 29% 2360 sq. ft. 33% (including semi-pervious porch & deck) (3) Building footprint 1662 sq. ft. 23% If variance is granted, the use will break down as follows: (1) Landscaping 4888 sq. ft. 68% (2) Impervious surface 2264 Sq. ft. 31% 2332 sq. ft. 32% (including semi-pervious porch), (3) Building footprint 1806 sq. ft. 25% b. There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district. The total depth of the lot is only 80 (or perhaps 81) feet. All other lots in the Finley neighborhood are at least 90 feet. (see exhibit C) In addition there is a public pedestrian path easement and a sanitary sewer easement on the east side of the property. That prohibits any expansion to the east and the resulting location of the house on the lot prohibits any expansion to the west. The only options are to the north or south. Of those options, the expansion to the north will have, by far, the least impact on neighbors. In fact, the proposed room is smaller than the existing deck. c. The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while permitting reasonable economic use of the land. There is no proposed change in the use of the property. No other city standards will be affected. While the requested variance will result in less than the normal 15-foot rear setback, there is no adjacent property owner or structure that will be affected. If applicant property was 90 feet deep (as is the case for nearby neighbors) there would be no setback issue. The proposed structure is smaller in area and further from the public right-of-way than the current deck. The applicants have worked with the City in the "Adopt-A- Stream program to help maintain the public property by removing blackberries, ivy and other invasive species. We have great personal interest in not only maintaining, but improving, the adjacent public land for everyone's benefit. d. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were developed as specified in the title. There will be no affect on traffic, emergency access, drainage, parks or any existing physical and natural system. The only effect will be an additional 144 sq. ft. of impervious surface on the lot but we will be well below the 80% minimum. By my calculation the developed area will be about 2,296 Square feet or 32% of the lot area. Run-off from the roof will be sent into the adjacent natural area, not into the storm sewer system. Clean Water Services found "no impact" on the sensitive natural area surrounding the nearby stream. e. The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. We would like to cover and screen our deck so that we can use it in any weather and to protect from insects which can be numerous in summer. After researching possible designs, the best solution appeared to be a patio room designed by Champion. This room is designed in four-foot sections. The smallest room that would allow a table and chairs is 12 x 12. The shape of our lot and sewer and public pedestrian right-of-ways prohibit any expansion to the east or west. Our only option is north or south. Of those options, the expansion to the north is more aesthetically appealing and will have far less impact on neighbors. The hardship is that, while our lot is a large or larger than surrounding lots, it is only about 80 feet deep. That means any addition is too close to the 15 foot rear setback line. As noted above, the house currently includes a deck that extends 14 feet from the house. The deck has been on the house since it was built and approved by the City of Tigard and it has caused no objections from neighbors. The proposed patio room would be only 12 feet from the house or 2 feet shorter than the current deck. As stated above, the 12 x 12 patio room is the smallest available size that would accommodate a table and furniture. The proposed variance would have no effect on traffic flow, emergency access, drainage, natural systems, utilities, or neighborhood aesthetics. There is a public bike and pedestrian path located approximately 36 feet north of applicant property (at its nearest point). The removal of the existing deck and construction of sun porch will increase the distance from the built area to the path by 2 feet. There will be no impact on roads, drainage systems, water systems, parks or sewer systems. There is an existing sewer right-of-way on the east side of applicant property but the proposed change will not encroach on the right-of-way nor will it require any hook-up to sewer. The creek (on the west) and the sewer easement (on the east) effectively prohibit development east-west. The proposed sun room on the north side of the house would occupy slightly less area than existing deck and would be two feet further from the path. Anyone walking or riding on the path would assume the path to be the property boundary and the proposed room would be 24 feet from the nearest point on the path. The owners are not aware of the reason the back property line of our property is about 10 feet less deep than nearby lots. When the owners volunteered to do habitat restoration on the surrounding public lands, Eric Hand examined the property and he (and we) assumed the property line more or less followed the path (with the west side boundary parallel to the small creek). The proposed room should have no impact on habitat (as concluded by Clean Water Services) and no impact on transportation or any other public benefit. Site Development Plan (see exhibits B & D) The only proposed change is the removal of an existing deck (172 sq. ft.) and addition of covered sun room (144 sq. ft.) in the same footprint. Covering and enclosing the space will allow use during cooler weather as well as when insects are a nuisance. As noted above, while the variance will increase the size of the building footprint, it will decrease the overall footprint by 28 sq. ft.
