APPLICATION SUMMARY FILE NAME: ALEXANDER LANDSCAPING ADJUSTMENT CASE NO.: Adjustment (VAR) VAR2006-00067 PROPOSAL: The applicant requests an adjustment to use existing on-site trees as new street trees, as required by a condition of approval in the decision approving MLP2004-00009. ZONING DESIGNATION: R-7: Medium Density Residential District. The R-7 zoning district is designed to accommodate attached single-family homes, detached single-family homes with or without accessory residential units, at a minimum lot size of 5,000 square feet, and duplexes, at a minimum lot size of 10,000 square feet. Mobile home parks and subdivisions are also permitted outright. Some civic and institutional uses are also permitted conditionally. APPLICABLE RE VIE W CRITERIA: Community Development Code Chapters 18.370,18.390,18.510 and 18.745. SECTION H. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request, subject to the condition below. The findings and conclusions on which the decision is based are noted in Section IV. NOTICE OF TYPE I DECISION VAR2006-00067 ALEXANDER LANDSCAPING ADJUSTMENT PAGE 1 OF 3 CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED PRIOR TO ISSUANCE OF THE SITE AND/OR BUILDING PERMITS: Contact City Forester Matthew Stine at 503 718-2589 or inspection an approva : 1. The applicant shall have the project arborist install protection fenc' around Tree # 12. This fencing shall Be inspected and approved by the City Forester prior to builg permit issuance for Parcels 2 and 3. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION SECTION III. BACKGROUND INFORMATION Site Information and Proposal Description: The subject property is located on SW 135`' Avenue, between SW Walnut Lane and SW Fern Street. The lot is 0.82 acres and is in the process of a minor land partition. The City approved MLP2004-00009 to divide the lot into three lots of 7,131 SF, 5,315 SF and 23,950 SF. An existing dwelling is located on the 23,950-SF lot. The applicant proposes to use 4 existing trees along the eastern boundary of the site (adjacent to the side walk) as street trees. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Tigard Development Code Section 18.370 allows the following development Adjustment by means of a Type I procedure: Adjustment to use of existing trees as street trees (18.370.020.C.6.a). By means of a Type I procedure, as governed by Section 18.390.030, the Director shall approve, approve with conditions, or deny a request for the use of existing trees to meet the street tree requirements in Section 18.745.030 providing there has been no cutting and filling around the tree during construction which maylead to its loss, unless the following can be demonstrated: The ground within the drip-line is altered merely for drainage purposes. Trees # 9, 10 and 11 are not in the construction area, as indicate by the site plan. Therefore, the ground within the drip-line will not be affected by construction and shall be altered for draining p oses only. Concerning Tree # 12, the applicant has not demonstrated that the ground within the drip-line wiIl be altered for draining purposes only. No tree protection fencing is shown on the plan rovided. The applicant shall have the project arborist install tree protection fencing around Tree # 12. Ibis fencing shall be inspected and approved by the City Forester prior to building perrnit issuance for Parcels 2 and 3. It can be shown that the cut or fill will not damage the roots and will not cause the tree to die. Trees # 9, 10 and 11 are not in the construction area, as indicated by the site plan. Therefore, no cut or fill related to construction should be affecting these trees. Concerning Tree #.17,. the applicant has not shown that the cut or fill will not damage the roots or cause the tree to die. This criterion shaIl be satisfied upon the Qty Forester's inspection and approval of protection fencing around Tree # 12. FINDING: Based on the analysis above, the adjustment criteria have been satisfied for Trees # 9-11, but not for Tree # 12. Approval is subject to the condition. Section 18.745.040 E states that "existing trees may be used as street trees if no cutting or filling takes place within the drip-line of the tree". This is true for our partition and construction project. 18.370.020C 1 a. The special circumstances affecting the property are that the trees are similar to the trees in the neighborhood, as they are well-established evergreens. 18.370.020C1b. The adjustment is necessary for the proper design or function of the subdivision, as planting smaller street trees would not be as aesthetic to this neighborhood. 18.370.020C1c. As the dripline of the neighboring trees to the north cover about a quarter of the proposed parceled property, it is unavoidable to have construction activity underneath.
