The R-25 zoning district is designed to accommodate existing housing of all types and new attached single- family and multi-family housing units at a minimum lot size of 1,480 square feet. A limited amount of neighborhood commercial uses is permitted outright and a wide range of civic and institutional uses are permitted conditionally. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request, subject to the following condition. The findings and conclusions on which the decision is based are noted in Section V. NOTICE OF TYPE II DECISION VAR2006-00066 Wr1LNU'f CREEK SUBDIVISION VARIANCE PAGE- 10174 • • CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED PRIOR TO ISSUANCE OF THE SITE AND/OR BUILDING PERMITS: Include a cover letter with your submittal and indicate where in the submittal the condition has been met. Submit the following to the Engineering Department (Kim McMillan, (503) 718-2642) for review and approval: 1. Two copies of a plan showing that the proposed cul-de-sac bulb complies with the fire code (to be approved by Engineering and Tualatin Valley Fire & Rescue) OR a PFI plan indicating that automatic sprinkler systems will be installed in the houses on Lots 1 through 9 (to be approved by Engineering). SECTION III. BACKGROUND INFORMATION Site Information and Proposal Description: The 6.9-acre Walnut Creek subdivision is located on SW Walnut Street, on the east side of SW Barrows Road. The applicant requests a variance to the to the cul-de-sac standard for "Street C" in the subdivision, as required by a condition of approval for the SUB2005-00025. Vicinity Information: The surrounding properties are mostly designated medium- to high-density residential. Parcels on the southwest corner of SW Barrows Road and SW Walnut Street are zoned C-C (Community Commercial). The Beaverton city limits begin on the other side of SW Barrows Road. Site History: The City approved the Walnut Creek Subdivision (SUB2005-00025) with conditions on May 19, 2006. At the same time, VAR2005-00104 (adjustment to interior setback of 108 dwellings) and VAR2006-00023 were approved (adjustment to access spacing standard). SECTION IV. APPLICATION SUMMARY The applicant has requested a variance to Section 18.810.030.L: Cul-de-sacs, which states, "A cul-de-sac shall be no more than 200 feet long and shall not provide access to greater than 20 dwelling units, and shall only be used when environmental or topographical constraints, existing development pattern, or strict adherence to other standards in this code preclude street extension through circulation." The applicant desires to extend the maximum permitted length of a cul-de-sac to 240 feet from 200 feet for Street C." This applicant requests approval of a variance to meet a condition of approval for SUB2005-00025. The applicant has submitted the necessary materials for staff to review this application. SECTION V. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET No comments were received from property owners within 500 feet. SECTION VI. APPLICABLE REVIEW CRITERIA AND FINDINGS VARIANCES AND ADJUSTMENTS: Section 18.370.010 states that the Director shall approve, approve with conditions, or deny an application for a variance based on finding that the following criteria are satisfied: a. The proposed variance will not be materially detrimental to the purposes of this title, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity; NOTICE OF TYPE II DECISION VAR2006-00066 WALNUT CREEK SUBDIVISION VARIANCE PAGE 2 01 74 The proposed variance Mkot be materially detrimental to the purpo of this title or to other properties in the same zoning district or vicinity. As explamed below in Section V (b), special circumstances exist which would make connecting "Street C" to Walnut Street unsafe. In addition, while cul-de-sacs can serve a maximum of 20 dwelling units, "Street C" would only serve about 12 units. Concerning other applicable policies and standards, the proposed variance does not meet the fire district code for cul-de-sacs in excess of 150 feet. The variance will not be detrimental to the purposes of the fire code if it meets one of the following conditions: 1) Desiggnn a cul-de-sac bulb that would meet current TVF&R turnaround standards (IFC 503.2.4, 503.2.5 and D103.3); or 2) Install automatic sprinkler systems in houses on Lots 1 through 9. Therefore, the applicant shall satisfy one of the two conditions above for the cul-de-sac to be in compliance with the fire code. b. There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; Special circumstances exist which are peculiar to the shape and location of the subject property, over which the applicant has no control and which are not applicable to other properties in the same zoning district. The lot's triangular lot shape and location on an arterial and near a major street intersection present a lack of options for street connection with safe access. If "Street C" were connected to Walnut Street, the intersection would be too close to the intersection of SW Barrows Road and Walnut Street (within the area of influence) and too close to the intersection of Northview Drive and Walnut Street (within the 600-foot access spacing standard for an arterial). C. The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while permitting reasonable economic use of the land; The requested variance will not result in a change of use that is not permitted within an R-25 zone. d. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were developed as specified in the title; and Without a variance, "Street C" would still be a cul-de-sac because of the special circumstances related to the lot's shape and location. Therefore, the variance would not adversely affect physical and natural systems more than if the subject were developed as specified in the title. e. The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. FINDING: Based on the analysis above, the variance criteria have been met. SECTION VII. OTHER STAFF COMMENTS The Building Division and Police Department have reviewed the proposal and have no objections. SECTION VIII. AGENCY COMMENTS The Washington County Department of Land Use and Transportation and the City of Beaverton Planning Department have reviewed the proposal and have no objections. Tualatin Valley Fire and Rescue (TVF&R) has reviewed the proposal and endorses the proposal, if one of the three conditions below is satisfied: NOUCE OF TYPE 11 DECISION VAR2006-00066 WALNUT CREEK SUBDIVISION VARIANCE PAGE 3 OF 4 1) Design a cul-de-sac -lu b that would meet current TVF&R turnaround standards (IFC 503.2.4, 503.2.5 and D103.3); or 2 Provide an emergency access for fire apparatus to SW Barrows Road; or 3~ Install automatic sprinkler systems in houses on Lots 1 through 9. Response: Staff has addressed these comments in Section V (Variances and Ad'ustments (a)) of this report and has required #1 and #3 of the above list as conditions of approval. Sta~f has not required #2 as a condition of approval because an emergency access road to SW Barrows would not be possible, given the shape of the site and its location at a major intersection. SECTION IX. Tualatin Valley Fire & Rescue endorses this proposal predicated on the following criteria and conditions of approval: 1) DEAD END ROADS: Dead end fire apparatus access roads in excess of 150 feet in length shall be provided with an approved turnaround. (IFC 503.2.5) The cul-de-sac design at the west end of Street "C" does not meet the fire district's design standard. 2) FIRE APPARATUS ACCESS ROAD EXCEPTION FOR AUTOMATIC SPRINKLER PROTECTION: When buildings are completely protected with an approved automatic fire sprinkler system, the requirements for fire apparatus access maybe modified as approved by the fire code official. (IFC 503.1.1) 3) FIRE APPARATUS ACCESS ROAD WIDTH AND VERTICAL CLEARANCE: Fire apparatus access roads shall have an unobstructed width of not less than 20 feet (12 feet for up to two dwelling units and accessory buildings), and an unobstructed vertical clearance of not less than 13 feet 6 inches. Where fire apparatus roadways are less than 26 feet wide, "NO PARKING" signs shall be installed on both sides of the roadway and in turnarounds as needed. Where fire apparatus roadways are more than 28 feet wide but less than 32 feet wide, "NO PARKING" signs shall be installed on one side of the roadway and in turnarounds as needed. Where fire apparatus roadways are 32 feet wide or more, parking is not restricted. (IFC 503.2. 1) The fire district does not endorse the design concept wherein 20 feet of unobstructed roadway is not provided. 4) FIRE APPARATUS ACCESS ROADS WITH FIRE HYDRANTS: Where a fire hydrant is located on a fire apparatus access road, the minimum road width shall be 26 feet. (IFC D103.1) 5) TURNING RADIUS: The inside turning radius and outside turning radius shall be not less than 28 feet and 48 feet respectively, measured from the same center point. (IFC 503.2.4 & D103.3) The turning radii at the intersection of SW Northview Drive and Street "A" as well as the intersection of SW Northview Drive and Street "C" does not meet the fire district's design standard. 6) SINGLE FAMILY DWELLINGS - REQUIRED FIRE FLOW: The minimum available fire flow for single family dwellings and duplexes served by a municipal water supply shall be 1,000 gallons per minute. If the structure(s) is (are) 3,600 square feet or larger, the required fire flow shall be determined according to IFC Appendix B. (IFC B105.1) 7) FIRE HYDRANTS - ONE- AND TWO-FAMILY DWELLINGS & ACCESSORY STRUCTURES: Where a portion of a structure is more than 600 feet from a hydrant on a fire apparatus access road, as measured in an approved route around the exterior of the structure(s), on-site fire hydrants and mains shall be provided. (IFC 508.5. 1) 8) FIRE HYDRANT NUMBER AND DISTRIBUTION: The minimum number and distribution of fire hydrants available to a building shall not be less than that listed in Appendix C, Table C 105.1. Considerations for placing fire hydrants may be as follows: • Existing hydrants in the area may be used to meet the required number of hydrants as approved. Hydrants that are up to 600 feet away from the nearest point of a subject building that is protected with fire sprinklers may contribute to the required number of hydrants. • Hydrants that are sated from the subject building by railroad*ks shall not contribute to the required number of hydrants unless approved by the fire code official. • Hydrants that are separated from the subject building by divided highways or freeways shall not contribute to the required number of hydrants. Heavily traveled collector streets only as approved by the fire code official. • Hydrants that are accessible only by a bridge shall be acceptable to contribute to the required number of hydrants only if approved by the fire code official. 9) FIRE HYDRANT DISTANCE FROM AN ACCESS ROAD: Fire hydrants shall be located not more than 15 feet from an approved fire apparatus access roadway. (IFC C102.1) 10) REFLECTIVE HYDRANT MARKERS: Fire hydrant locations shall be identified by the installation of reflective markers. The markers shall be blue. They shall be located adjacent and to the side of the centerline of the access road way that the fire hydrant is located on. In case that there is no center line, then assume a centerline, and place the reflectors accordingly. (IFC 508.5.4) 11) ACCESS AND FIRE FIGHTING WATER SUPPLY DURING CONSTRUCTION: Approved fire apparatus access roadways and fire fighting water supplies shall be installed and operational prior to any combustible construction or storage of combustible materials on the site. The lot is triangular with the majority of the frontage along Walnut Street. Current Zoning: R-25 Plan Designation: Medium High-Density Residential District Project Area: Approximately 302,500 sq. ft. or 6.94 acres Introduction & Subdivision Description The Applicant is requesting an adjustment to the length of the proposed cul-de-sac located on the western portion of the site. The cul-de-sac is approximately 240-feet in length, as measured from the centerline intersection point of the two streets to the radius point of the bulb, as stated in the code standards of Sub- Section 18.810.L.2 of the Tigard Development Code.. The proposed layout of the cul-de-sac will serve approximately 12 lots, under the maximum of twenty lots as stated in Section 18.810.L. There are numerous purpose of having an extended cul-de-sac length is because of the triangular shape of the lot. Finally, if the street was to go through and connect to Walnut Street the street connection will be too close to the intersection of Barrows Road (within the area of influence) and too close to the intersection of Northview Drive and Walnut Street (less than 600-feet). The Applicant has also applied for other adjustments to the subdivision including side yard setbacks, "skinny street" option B and a reduced cul-de-sac radii with curb tight sidewalks. Theses adjustments have already been reviewed by City staff and are not apart of this application. A. Purpose. The purpose of this section is to establish two classes of special variances: 1. Development adjustments which allow modest variation from required development standards within proscribed limits. Because such adjustments are granted using clear and objective standards, these can be granted by means of a Type I procedure, as opposed to the more stringent standards of approval and procedure for variances. 2. Special adjustments which are variances from development standards which have their own approval criteria as opposed to the standard approval criteria for variances contained in Section 18.370.020.C. Comment: The Applicant is requesting an adjustment to the length of the proposed cul-de-sac located on the western portion of the site. Section 18.810.E Cul-De-Sacs states that: "A cul-de-sac shall be no more than 200 feet long shall not provide access to greater than 20 dwelling units, and shall only be used when environmental or topographical constraints, existing development pattern, or strict adherence to other standards in this code preclude street. extension and through circulation: 1. All cul-de-sacs shall terminate with a turnaround. Use of turnaround configurations other than circular, shall be approved by the City Engineer; and 2. The length of the cul-de-sac shall be measured from the centerline intersection point of the two streets to the radius point of the bulb. 3. If a cul-de-sac is more than 300 feet long, a lighted direct pathway to an adjacent street may be required to be provided and dedicated to the City." For this specific case, the cul-de-sac is approximately 240-feet in length, as measured by the development code standards of Sub-Section 18.810.L.2 (above). C. Special adjustments 11. Adjustments for street improvement requirements (Chapter 18.810). By means of a Type II procedure, as governed by Section 18.390.040, the Director shall approve, approve with conditions, or deny a request for an adjustment to the street improvement requirements, based on findings that the following criterion is satisfied: Strict application of the standards will result in an unacceptably adverse impact on existing development, on the proposed development, or on natural features such as wetlands, steep slopes or existing mature trees. In approving an adjustment to the standards, the Director shall determine that the potential adverse impacts exceed the public benefits of strict application of the standards. Comment: The Applicant finds that by applying the code in its strictest would restrict the use of the land and would adversely affect not only the existing proposed development but also the surrounding developments.
