Duplexes and attached single- family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally. LOCATION: 10120 SW Tigard Street; WCTM 1 S135CC, Tax Lot 3400. COMPREHENSIVE PLAN DESIGNATION: Low-Density Residential. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.370, 18.390 and 18.510. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request, subject to the following condition of approval. The findings and conclusions on which the decision is based are noted in Section IV of this decision. NOTICE OF TYPE I DECISION VAR2005-00026 AND 27 /SCHLESINGER SETBACK ADJUSTMENTS PAGE 1 OF 4 CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED PRIOR TO ISSUANCE OF A BUILDING PERMIT: 1. Submit a copy of this decision with your building permit submittal. THIS DECISION SHALL REMAIN VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION SECTION III. BACKGROUND INFORMATION Pro ertHisto : The subject parcel is located within the City of Tigard. The property is designated Low Density Residential on the Tigard Comprehensive Plan Map. The subject lot was divided from Lot 10 of Greenburg Heights Addition subdivision. This lot was partitioned in 2002 (MLP2002-00012) which created the access drive to the subject flag lot. Site Information and Proposal Descri tions e su ject property is approximately 11,269 square feet and is predominantly flat. The site is accessed via an easement to SW Tigard Street. As the parcel meets the definition of a flag lot, increased side yard setbacks are required. Based on the narrow width of the site, the required 10 foot side yard setbacks would leave a very small building envelope (40 feet). By reducing the setbacks from 10 to 8 feet, the applicant would be able to site the proposed dwelling. SECTION IV. Can be met Minimum Landscape Requirement NOTICE OF TYPE I DECISION VAR2005-00026 AND 27 /SCHLESINGER SETBACK ADJUSTMENTS PAGE 2 OF 4 DEVELOPMENT ADJUSTMENT - APPROVAL STANDARDS: Section 18.370.020.6.1. provides that up to a 25% reduction of the dimensional standards for the front yard setbacks and up to a 20% reduction of the dimensional standards for the side yard setbacks required in the base zone may be approved as a Type I Development Adjustment. Section 18.370.020.13.2, Approval Criteria, provides that a development adjustment shall be granted if there is a demonstration of compliance with all of the applicable standards: A demonstration that the adjustment requested is the least required to achieve the desired effect; The applicant has requested a 20% reduction to the side yard setbacks as applied to flag lots. This would reduce the north and south side yard setback from 10 feet to 8 feet. All other setbacks will be adhered to. The reason for this request is that the width of the lot was originally narrow (75 feet). After a lot line adjustment was completed, the lot was reduced to 60 feet. With the required 10 foot setbacks on each side, the building envelope was reduced to 40 feet. The applicant has a specific design that requires 44 feet of width. The setbacks will still remain 3 feet wider than the standard 5 foot setback required of other R-4.5 zoned properties. The adjustment will result in the preservation of trees, if trees are present in the development area; No trees are within the proposed house footprint and the trees that are on site are to be protected through the construction process per the conditions of the previous partition review. Therefore, this standard is met. The adjustment will not impede adequate emergency access to the site; and The adjustment will not affect emergency access. A 20 foot wide access drive will service the lot, and with the side yard setback exceeding three feet (minimum required fire clearance), emergency personnel will still have access to the rear yard. Therefore, this criterion is satisfied. There is not a reasonable alternative to the adjustment, which achieves the desired effect. In order to build the proposed home, the wider building width is necessary. This is made more necessary due to the fact that the applicant's proposed home will only be a single story. Additionally, with the high water table and poor area drainage, adding basement space is not feasible. SECTION V. PROCEDURE AND APPEAL INFORMATION A setback adjustment is a Type I procedure. As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant, whichever occurs first. The Director's decision may not be appealed locally and is the final decision of the City. THIS DECISION IS FINAL ON APRIL 14, 2005 AND BECOMES EFFECTIVE ON APRIL 15, 2005.
